Verbal Update 09/23/15:I have spoken with the owner of Integrity Automotive, he has offered and I am accepting that they will keep $of my deposit and return $to me, please call me today with resolution on this offer so that I can close the complaint as resolved

Mrs [redacted] inquired to our dealership via email to my salesperson Chez about an Audi aWe took the vehicle all the way across town as she was too busy to come inWe took her the Audi aas well as a lexus Issport she wanted to seeWe worked numbers on both vehiclesShe said she liked the Abut that she could feel a slight vibration so we brought the vehicle back and aligned and balanced the tires for herShe stated she had to return her rental car she was in and asked if she could use the Afor a day before she made a final decisionWe let her use it for a day and she brought it back saying she didn't want it and that she saw a Audi Qon our website and it was less expensive and she wanted that vehicle insteadShe asked to take that one for an extended test drive over night also to make sure it's what she wanted and so that she could thoroughly inspect it before making her final decisionThe vehicle was priced at $and she came in after having the vehicle for days and she offered $which is $over wholesale book and after hours of negotiating we agreedShe also wanted us fix a scuff she found on the rocker panel and she wanted new OEM floor mats ($380) from Audi and the reflector light had a small crack in it and she wanted that replaced alsoMy sales manager Paul told her no that we would not have agreed to the lower had she told us we would have to fix these problems alsoShe asked for us to take her home that if we didn't fix the things she wanted she wasn't going to buy it even after we discounted the priceSo we took her homeMy salesman came to me ( [redacted] owner) and told me how he had been working with Ms [redacted] for almost a week now and has driven across town several times detailed cars plus gas and that this deal would give him his bonusI told him to call Ms [redacted] and fix the things she asked for at no cost to her and order her accessories she requested and I'll pay for themChez called our lot attendant who was driving Ms [redacted] home and told him to turn around that he talked the owner in to doing her deal the way she wanted itShe came back, I the owner went outside personally and asked Ms [redacted] to show me exactly what she wanted so that I was on the same page and she was completely satisfiedWe walked around the vehicle she showed me the things she wanted to make her happy and I agreed to take care of them and we shook hands and agreed to the dealShe came in did paperwork signed contracts gave us $down and took delivery of the vehicleWe got her approved as contracted but found her a lower interest rate if she could give us proof of incomeSo we called her and asked if she could get us proof of incomeShe gave us proof of income on her primary job but said she would bring us her proof of additional income laterShe then texted Chez and stated she changed her mind and was just going to bring the car backWhen she showed up a couple of days after we did the deal, she tried to just hand us the car backI told her we had already paid for the parts she requested and she had already bought the vehicle and took delivery that she could't just return itThis would not only cost my company money but would also cost the salesman his bonus and eliminate all of his hard work and time invested in this deal not only by him but my shop manager my finance manager and my selfWe also called her prior to her wanting to return the vehicle telling her there were actual Audi floor mats in the vehicle already and she stated "well I guess that means I get sets then" so we ordered them for her anywaysI tried to find out what exactly is the problem and she stated because she found another ding on the car and that the tire pressure light came onSo I checked and the tire pressure light was not on and she said it went offI explained that this is common when the vehicle is cold or the climate changes and will sometimes warn you to check which means it workingShe then brought up a car she found out of state in Palo Alto with less miles priced at $34k and that now she wants that one instead because she feels it's a better dealSo I gave her some optionsI told her I would exchange the car at full credit for what she paid for another vehicle or I would unwind the deal completely for a $restocking fee in order to cover our expenses or that I would give $more discount and still fix everything she is asking and give her the already purchased accessories and lower her interest rate a full point if she could prove her additional incomeShe then asked for $off and everything else and she would do itI told her I couldn't discount it that much and fix everything she is asking for and that we are not required by law to return the vehicle that I am only trying to be fair and keep my customer happy with out costing my company money since we have done nothing wrongShe then stated that she was lied to because my salesman said I bought the car from my friend in Phoenix and that she asked someone else and they said I bought from an auction in phoenix and that she is friends with [redacted] the attorney General and that she already spoke to her attorney and started making threatsI told her that's not fair The car is a one owner vehicle out of Phoenix it has never been in an accident and has no mechanical problems what so ever that the only thing that has happened is you are having buyers remorse because you found another vehicle you like more and to threaten me after the service and time we have put into this deal is completely unfairShe said "well than give me $off and fix everything and we will be done" I told her no, I gave you your options the rest is up to you if you don't pick an option that I am offering in order to be more than fair than we can just stick to our original agreementShe left and the left the car on our lot and I have her parts and accessories here waiting for herI will give her hours to take advantage of the options I offered but I am unwilling to allow Complaint: [redacted] I was just made aware that the warranty company denied claim which during the time period of my first response had not been deniedThe reason for denial was due to the fact that this vehicle had been to Audi previously for oil consumption problems in the past and was denied coverage due to low oil levels and build up of old oil when the motor was taken apartThe consumer who traded this vehicle to Integrity was well aware of it’s issues and had the oil freshly changed before trading it in to us Intentionally deceiving us and making it impossible for us to see any problems upon our inspectionWe were completely forthcoming on our part as the vehicle had immaculate service records and it had brand new oil and was only a quart low upon inspection which we topped off before sellingIn order for us to know the vehicle was burning all of it’s oil in two to three weeks it would’ve actually required us to drive it for two weeksObviously this is not possibleThe vehicle was sold in good running condition, and unfortunately the motor blew outside of the day mile warranty which is why we were referring them to the extended warranty we provided them and not just to blow them offHowever, even though by law I don’t believe we are liable, I am an honest dealer and I would never intentionally deceive our customerTherefor, I am willing to work with the customer to find an amenable solution if they are willing to work with usIn support of this effort I will give them full trade credit towards the purchase of another vehicle and apply their down payment of $ towards the new carDue to the credit history Mr [redacted] , he must understand that his options are limited and european luxury cars may not be an optionIf they are willing to work with us, we can get to work on this immediately for them and we will take care of their rental car expenses, the bill at Audi, and pay off the original loan in fullWe had no way of knowing this would happen and that this vehicle was having previous problemsHad we known that, we would have sold this car “as-is" at an auctionThis unfortunate event will cost my small business thousands of dollars in order to do what I am offeringI hope Mr [redacted] understands the position we are in and is willing to work things out amicably.Regards,Brian ***

Complaint: [redacted] I am rejecting this response because: this is a complete breech of the contract I signed I am not to sure which one of these fabrications to address The contract that I signed does not, anywhere say that it was non refundable It was contingent on me purchasing the vehicle This is absolute crockery, I called the dealership applied for financing over the phone, was approved over the phone, purchased insurance over the phone and drove to the dealership drove the car around the block and went inside signed the papers and took the car homeI was in the dealership a total of one hour This vehicle was purchased almost sight unseenMy plans were to leave to Florida that weekend, but the trip was delayed until the following weekendThe issues that you claim arose with the lender could have been dealt with very easily if you would have called me the day you got notice from the lender But you called me and lied, saying my plates were in, for me to go get them instead of telling me the funding fell through and for me to return the carI returned the vehicle the same day at pm, parking it safely on the lot with the doors locked, and took the keys with meI did not leave them in the vehicleI have someone who can attest to thatThey were returned the following day to the dealership as witnessed by several of your employees, and gave them to Charli in person Your business hours said you would be open; however no one was there I dropped the car off for several reasons, Number one because the transmission was slipping, number because the funding fell through, and number three because I had someone who could follow me and give me a ride back homeWhen [redacted] gave the keys to Charli, she told [redacted] that everything was fine and she would be waiting for my This was a day before I left town and I had several errands and loose ends to tie up before I leftAlso, I never called and harrassed anyoneI called and left one voice mail and your mother called me back with in minutesYou can say whatever you want about my employment, but the truth of the matter is that the lender did not question the validity of my employment I received a letter from the lender, stating the reason they chose not to offer financing, and it did not have a damn thing to do with the validity of my employment or income In my opinion, you wanted further documentation to apply with a different lender, and when I didn’t have the time to go search my storage unit for the bank statements and 1099, you decided to rob me of my down paymentThis is a blatant attempt to keep my down payment money The car was in perfect shape when I returned it, and there was nothing wrong with the wheels, or the bumper You are jumping around trying to cover all the bases so you can steal my down paymentI am respectfully requesting that the Revdex.com review the integrity of this business owner Your claim of abuse of process is a smoke screen to deflect from the truth I can prove the validity of my employment, and the validity of my employer But in all honesty I don’t think that is or has ever been the issueI believe that no matter what proof I provide, this business owner will not, under any circumstance, return my moneyHe wants to force this deal on me because he knows the warranty on that little car is null and void because the transmission was not serviced at thousand miles The bottom line here is the contractThe contract does not state that the down payment is not refundable It says it is contingent on the purchase and financing of the car Return my money, and take the name integrity out of your business name It is a statement, you have no integrity Regards, [redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason the complaint will be closed Answered]

*** *** put a NON- refundable deposit of $on a Mitsubishi Outlander she wanted to purchase from Integrity AutomotiveShe asked us to hold the check until everything was approved and we didOnce everything was approved she came in and took delivery of the vehicleWe then deposited her
check and the deal was doneWhen the deal went to the lender for funding a red flag came up when the work numbers on her application were invalid and the address for the company pulled up on google maps as a private homeSo GM financial ran her paycheck stubs for fraud and they came back as pay stubs that were fraudulentThe pay stubs were printed on adp format and was verified by adp to be fakeThe actual website info where she obtained the fake pay stubs was given to us by GM financial in order to let us know for sure that were in deed fakeWe told Mrs*** about the issue with work numbers and she gave us new numbers that only went to answering machines and employment could still not be verifiedShe said she could bring bank statements to prove it so we told her to bring them in but she never did stating more excuses such as I closed that old account and I got a new one so it won't showWe said just to bring proof of one of those paystubs being cashed at a bank and she couldn'tWe were told lie after lie after lieMrs*** provided us with a fraudulent application and fraudulent documentsWe told her to come in and let us look at the vehicle as she was stating there might be an issue with the transmissionShe would not come in for several days and we were extremely worried that she was going to leave to Florida with our vehicle so we told her to bring the car back as we need to discuss her application as the banks are stating it's fraudulentShe kept the vehicle for several more days avoiding returning the vehicle and then dropped the vehicle in the middle of the night and left it out with the keys in it on the streetI'm sure this was due to her paranoia of being caught on her scamWe got our vehicle back and the vehicle was returned with damage to two of the wheels the bumper had been scuffed and the vehicle needed to be bombed and detailed as the vehicle had now been smoked inIf she had returned the vehicle during business hours we would've been able to go over this with herWe used to the deposit to cover our expenses and the time we invested in this dealsince the vehicle had been returned and we had enough of a deposit to cover our expenses we decided to just let it goShe then starting calling and harrassing my staff to return her the moneyI told her that if she could prove that her employment was real and provide us with legitimate pay stubs we could continue with transaction as we have spent a lot of time on this deal and would prefer to keep it togetherHowever she has been unable to prove her application is true and we have proof that it is notThe vehicle was returned with damage to two of the wheels the bumper had been scuffed and the vehicle needed to be bombed an detailed as the vehicle had now been smoked inIf she had returned the vehicle during business hours we would've been able to go over this with herShe is requesting her check to be mailed or to let another family member pick it up be cause she knows what she did is illegal and is afraid to show her faceThis is abuse of process and I would like this complaint removed from profile. Revdex.com: This matter has been resolved threw the attorney generals office. In the end Mr. Brian [redacted] did make things right by doing the right thing resulting in a satisfactorial outcome for both parties.

The vehicle was priced at $34999 and she came in after having the vehicle for 2 days and she offered $33000 which is $300 over wholesale book and after hours of negotiating we agreed. I am rejecting this response because:
Mr. [redacted] has made many false statements in his response.I will address the most severe problem which will more so clarify the problem. This vehicle is at Mercedes Audi servicing for repairs after the last break down/issue with this car. The vehicle has now been out of commission/working order for 55 days out of the 70 days I've owned it. I'm making payments on a vehicle I am not or can't use. And now after an engine tear down conducted by Audi servicing and my warranty company I find out these problems/break downs are caused by pre-existing/ongoing problems the vehicle was having. The vehicle was serviced at Audi by previous owners where this is a documeted. With that documentation along with warranty inspectors findings my warranty is not covering the repairs or any other expenses. Mr. [redacted] keeps stating all this is taking care of by the warranty which is not so. The car was a lemon with multiple issues and problems prior to the sale. Had integrity done an inspection this would have been prevented. Mr. [redacted] states they advised an inspection was not done and warned audis are notoriously unreliable, this is not so. That would have been a red flag from the start and in fact the 1st time the car broke during the argument [redacted] had with integrity reps she brought up she in fact thought there was no inspection since the car was having multiple problems and they stated to her one was done and they had document of it, she was demanding copies and was denied them stating no matter what the car was our problem from the day we left the lot with it. Like I stated there was multiple false statements in Mr. [redacted]s response but the bottom line of it all is I was sold a car that had pre-existing problems, the vehicle is a total loss repairs are more then vehicle value. Being that the damages were due to pre-existing problems my warranty or insurance will not repair. I find it obserd that Mr. [redacted] thinks this is good business conduct refusing to take the vehicle back or exchange. He is trying to pay a megar couple hundred to settle out a problem that is costly in the thousands which does not sound reasonable to me in the least! Integrity needs to take ownership on their faults here. It is their responsablity not to sell lemon cars, to inspect prior to sale and if they wrong a customer to make things right.

I am rejecting this response because:
I do not wish to do any further business with integrity automotive. Yes at the time of purchase my credit was not the best but since then I have built my credit with a wells Fargo secured card bringing me up to a 686 score & I have a great job, within the last few days I purchased a brand new Lexus from Lexus of Albuquerque with no down payment and lower interest rate so I have no need for another vehicle or trade in value to use at integrity as Mr. [redacted] offered. What I would like is the Audi loan with Wells fargo paid off in full since I am still making monthly payments & insurance payments on a vehicle I am not able to use, the bill at Mercedes audi covered, my $1000.00 down payment back as well as my monthly payments, tow expenses, rental car expenses and my deductibales all paid back to me. I do understand this is going to cost Mr.[redacted] money but this has costed me thousands as an individual with a single house hold income trying to support my wife, our five month old baby and our other two children as well. This has not only took a financial toal on my family we have had to make many sacrifices and go without alot of things we were accustome to. There was days I had to miss work or ride the bus or depend on other for rides when we couldn't afford a rental car. All this money came out of my pocket so I wouldn't lose my job or ruin the little bit of credit I did have. I even got a new credit card just to keep my family afloat with these bills, this car has put me in debt. I feel asking for all this money I paid back is responsible. I've literally had to go threw hell and back with this car and have lost and put so much into it, I personally feel my agony in this whole situation is worth alot more then just what I'm asking for. I will not take a loss on money due to a lack of information on integritys part when they received the car as a trade in. I literally drove the car for 14 days and it's been immobile for 60+ days, that unexceptable.. what ive asked for is what I'm seeking as a solution if it can be done great we can do that and leave it at that, if it can't be done I am not willing to take anything less so let me know where we stand.

[redacted],    In response to the complaint from [redacted] and [redacted]. They came to our dealership having prior credit troubles stating that the had applied several other places and were unable to get approved. We pulled credit in order to see what we could do for them...

and showed them a Honda civic that we told them was one of the only cars that would work for their credit situation. [redacted] stated the he wanted something more luxurious. We tried to tell him that the only luxury cars that would work for his situation would have to be a higher mile unit in order to fit his approval and budget which would be a lot less reliable. [redacted] also agreed with us and told him that the Honda would be more reliable. Despite all of our efforts [redacted] insisted on the higher mile Audi we just took in on trade. The vehicle was priced at $15999.00 we told him that it had not gone through all the inspections yet as it was just traded in the deal had just cleared and due to it’s mileage was more than likely going to the auction as we typically don’t sell higher mile Audi’s as they are notoriously unreliable. [redacted] stated this to be true based on her previous experience with an Audi that the engine blew up on her and she thinks they are unreliable also. We told him that if in the event we could get him approved on the Audi it would need it’s inspections and we would only sell it with an extended warranty in case something happened we wouldn’t be held liable past the 15 days or 500 miles required by the state of New Mexico. He agreed and asked us to see what we could do. After hours of working multiple different lenders we could only get [redacted] and [redacted] approved for $12600.00 out the door. [redacted] was unable to come up with the money down (he could only come up with $1000.00). We lowered the price to accommodate them (down from $15999 to $12999) however we told him we wouldn’t sell it without an extended warranty,  so we again lowered the price even more to compensate for the cost of the warranty so that they would be covered in case anything went wrong with the vehicle. We gave them a 2yr 50k mile extended warranty at no charge as we lowered the price to offset the cost. We then performed a safety inspection before delivering the vehicle. We also checked fluids and the carfax for previous service records the vehicle had just been serviced at Mercedes/Audi of Albuquerque on 5/28/2015 with 113710 miles so it wasn’t due for another service and no issues were found at this time. Our customer who traded this vehicle bought the vehicle from Mercedes/Audi of Albquerque and had it serviced there. [redacted] test drove the vehicle also and there were no issues brought to our attention by him, or [redacted] at the time of sale either. We let them know we would need to schedule a body shop inspection to make sure it does not have frame damage as it did have prior paint work, and an accident on carfax. This was also documented on a damage disclosure, and the we-owe and signed by [redacted] as we could not get it done at time of purchase. We scheduled him the very next day July 28th, 2015 for the inspection and it came back with no frame issues just the prior repairs we previously disclosed on carfax and damage disclosure, again at this time there were no issues with the vehicle mechanically. We do not conduct emissions on all of our vehicles up front due to the fact that many of them do not require it based on type of vehicle or the address of the consumer. In this case we did need an emissions test based on [redacted]’s address so my office manager called [redacted] and told him that if he paid for it out of pocket we would reimburse him, or that if he brought the vehicle to us we would do it for him. At this time the vehicle had no issues and nothing was brought to our attention. Steven B[redacted] (salesperson) received a text from [redacted] on August 13th stating a couple lights had come on and wanted her to detail what she was owed and asked if she brought it in could we look at these things for her asap. The vehicle showed up by tow truck the next morning august 14th Friday, and [redacted] came in telling us she didn’t want the car anymore, and began yelling at my employee Paul who was simply telling her that she had a warranty that would cover the problem and that she could take it direct to Audi as we don’t do any major repairs here at our facility. We also reminded her that we would only cover it had the problem occurred under the 15 day 500 mile policy they signed. At the time the vehicle was brought to us the mileage on the Audi was at 116621 miles and at the time of purchase it had 115493 miles and the 10th would’ve been the last day for coverage without deductible. My shop manager Nick came out and asked her what was going on with the vehicle to see if he could help and she explained to him what was going on and he told [redacted] that it could just be something simple as a battery to go ahead and leave it with us and we would check a few things for her and if we couldn’t figure it out we would get it to a shop for her. She agreed but stated that they need the car back asap as they can’t be with out a vehicle. We tried switching the battery thinking it may just be a bad battery but it did not solve the problem we performed a scan and it was showing an alternator issue. We called Audi and they were not able to get it in until Monday the 31st so we called silver star and they said they could get it in sooner. We had it towed at our expense even though this was covered under the warranty we gave the customer. We asked silver star to look it over and let us know if they found anything else wrong as the customer has a warranty and we want to make sure there isn’t any other issues. The alternator was repaired by silver star under warranty and the customer picked it up august 27th. Silver was faxing us a copy of there findings so that we could address them with the customer. Before receiving the paperwork from Silver star [redacted] called screaming and yelling at me (Brian [redacted]) this being the first time I ever spoke with the customer. He stated that he got the vehicle back from Silverstar and now it’s making a new sound and he is [redacted]. I told him I understand but your screaming at me and when you bought this 115k mile Audi we warned you about the reliability of an Audi with high miles and you insisted on buying it. We even went above and beyond to make sure your vehicle came with a warranty and this new problem will covered also. On top of that I reminded [redacted] that they have 24hr roadside assistance and rental coverage they neglected to use. He claims the “warranty place was closed” but it’s 24hr 7 days a week roadside service. He also claims he towed his vehicle to us on the 11th but it was towed to us on the 14th. Either way he was well over the 500 miles given by the implied warranty. In the end [redacted] made a poor decision, to buy a 115k mile Audi and it has caused him some inconvenience and money I’m sure. However he is now regretting his decision and trying to get us to pay for it. His vehicle is being repaired under warranty and we will happily cover his deductibles for him along with all of his tow bills and rental car expense (total $375.73) event though these are covered by his warranty. We will also pay for his emissions. His future towing and rentals can be reimbursed by submitting his receipts to his warranty roadside service we provided him. We offered him a loaner vehicle when we towed his car for him we made sure he would be covered if something like this happened and we have stood behind our agreement and kept our word on everything promised. Unfortunately all cars eventually break down, and it is impossible for us to know when and where this will happen. As a dealer we took a risk selling this vehicle had these break downs occurred while under the implied warranty we would have been liable. Unfortunately for [redacted] it happened after that warranty had expired. Good news for [redacted] is we made sure he was covered and we are willing to pay for his deductibles towing etc. Asking us to eat the taxes, bank fees, insurance, payments etc. is not only unreasonable, it’s unfair as we have done nothing wrong and were very upfront with [redacted].Thank you for your assistance, Brian L[redacted] Owner Integrity Automotive
