them is for each of us to finalize this project I'm asking at this stage a written agreement with what I will be doing to finalize and their payment to be placed in an escrow account Leisure Pools Corporate has agreed to have Howard Guidry the plant manager to oversee quality as he has been the manufactures plant manager for years I also have consulted with the *** representative *** *** and he will as well provide inspections for decking quality
This customer has ran a gas line that has nothing to do with my contract and yet she has threatened me with future lawsuits if there is an explosion I sold them a *** fire ring without any gas lines included The customer paid and found their own installer of the gas line
I have consulted with Leisure Pools Corporate directly with *** *** the owner and his suggestion is to agree on my scope of work per my contract and have the funds placed in escrow I have asked the ***'s to put things in writing with me and state payment at the end but they do not agree
The ***s have added additional items above the original scope of work I suggested to the ***'s that we use mediation which they agreed to in our contract together to move forward
I am preparing a certified letter stating my position and willingness to conclude the contract duties and discussions over the final monies to be placed in escrow
I am very willing to work with the Revdex.com in this case and I also am willing to use a mediator to put this behind me I am not willing to remove the pool and refund the money as extensive cost have went into this project and it has minor adjustments to perfect the installation I hope you can help *** *** ###-###-####

I am rejecting this response because: Attached you will see the contract where [redacted], the representative for the company guaranteed the extra 214 sq. ft. of additional concrete. We did not receive this and paid for it out of our own pockets at a price, also documented above, at 2,000 dollars. The bank because the contract was voided and never completed had to pay us the 2,000 back in order to fund Leisure pools. I do have all the documentation for that information as well. You will notice a picture of just one of the incorrect pools that came to my home, four pools came out to the site or my home, this one was so junk it ripped nearly in half, and completely in half upon removal of the pool. The pool amendment that was signed in order to move forward and correct the long and large amount of issues, we had a total of 3 amendments and none were ever completed. In each contract it clearly says that they will leave the area in a neat nice manner as it was found. My yard was destroyed. However, I was willing to let that go if they provide the correct pool, equipment and so on. They finally came out to our house with the correct size pool in the wrong color. We accepted the pool as it was not "DISCOUNTED", it is a factory second. This means that it is in structural working order, however it voids the exterior gel coat. As you I can provide in my documentation, it shows no warranty on the gel coat because it is in fact a factory second meaning it had a large white spot at the bottom of the pool. I challenge Leisure's that if it is true that it was simply discounted then provide me with the warranty in full and include the entry of the gel coat along with the lifetime structural warranty. Facts are facts,
1. not one contract was ever honored in full
2. Lyon Financial had to pay us back the 2K in spite of Leisure's failure to honor our contract.
3. 4 pools where delivered to my home that where incorrect and had to be replaced.
4. We got a factory second as agreed, not a discounted pool, hint no gel discount
5. yard destroyed
This is just a few things that went wrong, the time line went well over what we where guaranteed. We were told that we would have a pool in about 4-8 weeks. That came from the Salesman [redacted]. The owner of the company constantly hounded us for money throughout the process. He told us his full life story of how bad life was being to him. We where paying for a service that had agreed upon a loan and payment upon completion. We went out of our way to see the project done so we paid 9K upfront in order to get our project done efficiently. This did not happen. I cannot say how unpleased and unhappy I am with this company. If I could turn back time, I would for sure never use this company. This complaint is valid, and others Consumers deserve to be warned about how awful this experience was. At one point we got a Lawyer and talked with him. He said there where two other people who were in worst conditions than us. Also when I went to the Revdex.com for help the first time, he called me and cursed me out about him not providing me with service. He said his only two workers where sick.
In the end this is what happened
1. Lyon financial our loan company, were provided all legal documentation for the loan and it could not be funded! They did not honor the contract. Lyon financial paid us back our 2K in concrete clearly in the contract, we had to go back to Leisure Pools and ask for another contract that was closer to correct so that it would fun and we could pay them for there work. As unhappy as I am with there work, they still have to get paid according to my Lawyer.
2. Lyons reached out to us the real owner, [redacted] and said that he was sorry and assured me he would correct this on his end as much as he could.
3. We paid over 1800 to repair the damages in our yard left by Leisure pools
4. I had to higher a pool company to come in and do an inspection, they did plumbing repairs, and masonry repairs for me, that was a little over 700.
with everything mentioned, I can and will provide documentation of each and ever event. I have pictures and documentation throughout the process, all my contracts and amendments, Lyons financial statements, and much more documentation to prove everything stated above as a fact.

The [redacted]'s purchased and signed a contract for a 34' pool sold by the sales [redacted].  The pool was sold at a sizable discount to reflect its poor condition.  Once it was time to deliver the pool the decision was made that the pool could possibly leak in the future by Leisure Pools USA...

I spoke with Mr. [redacted] and he wanted the original 34' length.  I spoke with corporate and was able to get them in a 34' pool of a different color.  In order to do that it cost me several thousand dollars.  
The [redacted]'s were given not a 30' pool but the original 34' once again but in much better shape.  I will be happy to send photo's of the pool they signed the contract for and what they received.  Never once were they to receive additional decking with the 34' pool.
They elected on their own to hire my subcontractor [redacted] to to additional work.  They paid it on their own and [redacted] cashed their check.  I paid [redacted] exactly what they signed the contract for myself.  
The [redacted]'s have a much better pool project now and I provided them a much nicer more expensive pool that cost me over $10,000.00 more and I can show receipts to prove that.  The original 34' pool they purchased cost me $2000.00.  
The [redacted]'s signed a completion certificate with Lyon's Financial and my business is done with them.  I received payment.
