Review: I had this company inspect a home for me. the service was inadequate. the report was incomplete and flawed. I contacted the inspector who performed the services and got no response. when I contacted [redacted] the owner of the business via e-mail he apologized for his employee and explained that this person has some family health issues and that he would be refunding me $250. this did not happen. I contacted [redacted] again approximately 2 weeks later asking for an update as I had not received any refund. his response was that he was willing to now give me a full refund if I sign a waiver and take down my negative internet reviews. I agreed. unfortunately since by now he has proved himself untrustworthy I insisted on an in person cash refund. this is unacceptable to him as he will only refund my money by check through the mail.Desired Settlement: I want my money back. I paid for a service that was not performed in a satisfactory or workmanlike manner and the service provider agrees. he offered me refunds already but will not honor them.

We did perform an inspection on June 6,2013. The inspection exceeded the ASHI Standards, and included over 25 color photos. It was completed the next day. It was performed by an ASHI Certified Member, with over ten years of home inspection experience.

Our inspector did not return one phone call as is our usual policy, but as I explained to the customer the inspector’s wife was just admitted to the hospital.

We have a satisfaction guarantee on our website, which outlines our money back guarantee policy. The guidelines on our website were not followed by the customer. Our website is [redacted]

As a courtesy, I did offer a generous $250.00 refund, however that refund was declined. Here is the quote from an email I received from the customer.

“While I do appreciate that you are willing to make a consideration of $250,1 do not feel that it makes up for a bad home inspection”

I later offered to send a full refund and I am still willing to, provided the release is signed, notarized and returned by August 15,2013 and ail abusive negative and derogatory content is removed from the internet.

There will be no refunds after that date. I will only send a check. I will not give personal cash refund.

I am rejecting this response because it does not resolve my issue. I accepted the $250 refund. here is the full dialogue of the email from which the business 'quoted' an excerpt, in their response

" While I do appreciate that you are willing to make a

consideration of $250, I do not feel that it makes up for a bad

home inspection. neither the inspection itself nor the report

generated were done in a "workmanlike or professional" manner.

I will not change my reviews to say that they were. again, i

thank you for your generous refund, but I consider $250 a small

gift when compared to the price of my new home. in which I do

not have the confidence that a thorough and comprehensive

inspection should have given me."

I did not decline his refund. I specifically thanked him for it.

the full refund and the signing of a release was not mentioned until two weeks later when I sent him an email inquiring about my refund which is when he told me that I had declined his refund. [redacted] then offered me a total refund if I sign the release. his attempts to bribe me into taking down my negative reviews will not succeed. I continue to demand the refund I was offered.

Our inspection Agreement, which was signed by the client before the inspection spells out how a dispute will be handled. “Any matter concerning the interpretation of this Agreement, or the Inspection Report, or any claim based upon either of them shall be subject to binding arbitration.”

I have no further comments, and consider this matter closed.

I am rejecting this response because: it was not possible to conform to the requirements for a refund. one requirement is to make your complaint at the inspection. I did not have any significant complaints until 36 hours later when the report was generated and revealed a number of defects in the house that were not brought to my attention during the inspection, nor was there photographic evidence. at which point the inspector did not return any of my phone calls regarding these undisclosed defects so I could not lodge my complaint. I was offered a partial refund -with no conditions- because of this. I have proof of this and that I was then offered a full refund as well. I have saved every email between us. I have the documents to prove my claims and I do not think that binding arbitration is the direction that you want to go but this is my final attempt to settle this matter before I initiate arbitration.

I am willing to go to binding arbitration to settle this claim as we agreed in writing at the inspection.

It should be noted that the small (less than 500 dollar) inspection refund claim is far less than the substantial defamation law suit I plan to file.

I have no further comments, and consider this matter closed.
