Review: On 3/29/2013 I wrote $1,000 check to Integrity Landscape ([redacted]) as a retainer for landcaping contract. The contractor attested to being fully licensed (License #[redacted]), insured, and bonded. This provision was included in the contract we signed. Contractor installed a gas line and requested additional payment to continue working. I paid him $4,000, but he did not show up for work stating more funds were needed. I paid him another $5,000, but he still didn't start any more work.This raised suspicions. City of Vista reported that no permit was issued or even applied for on installation of our gas line, and no inspection was made in violation of existing law and the contract. No application for HOA permit was submitted, as well. License #[redacted] turned out to be expired as of 07/31/2012, and contractor's bond was cancelled on 09/01/2012. When confronted, on 04/25/13, contractor [redacted] (sole owner of Integrity Landscape) abandoned the worksite. He cannot be reached on the phone, and doesn't return calls and messages. The business address turned out to be location of [redacted] Nursery - an unrelated business.Desired Settlement: The contract is fraudulent as the the contractor was not licensed and bonded as he claimed and actively advertised. The settlement should be a refund of $10,000 and repair of damages to our property or compensation of the cost of such repair.

Case # [redacted] To: [redacted] On Friday March 23rd 2013, [redacted] and I entered into a contractual agreement for the installation of his back and side yard landscape. I was apprehensive about working for [redacted] because his wife/girlfriend [redacted] was very moody, indecisive and had angry outbursts during our planning meetings. We started work the following Monday clearing weeds and starting the installation of the forms for the patio. That afternoon, [redacted] came home from work and informed us that his wife [redacted] had changed her mind about the layout of the patio and barbeque and wanted us to redo some of the work we had already completed. The next day we spent almost 5 hours redoing the work to satisfy [redacted]’s request. That afternoon [redacted] came home from work and told me that [redacted] had changed her mind again about the layout but wasn’t sure about the location of the barbeque. We complied and changed the forms again. This went on everyday for four days with me complying every time. [redacted] even came out once and told me that my landscape design layout was stupid and didn’t make sense at all. We did not work on Friday as we do our lawn route on that day every week. [redacted] became very angry about us taking a day off from his project. We signed a change order to add the barbeque, seat wall, and raise the seating area, but [redacted] refused to sit down and rework the payment schedule to accommodate the add-ons. We resumed work the following week and installed the gas line, retaining wall, fire pit, patio forms, and gravel base for the flagstone patio. All work was done according to building code. [redacted] then told me that he had changed his mind about the flagstone patio and that he wanted something different even though I had spent thousands of dollars on the work so far that would have to be redone and the materials hauled off. This went on for days of him wanting to add items to the project but refusing to pay for them or add them to the signed contract. Then on April 16th he told me that he wanted me to make the barbeque larger and add a backsplash and he said he didn’t want to be charged for it. He told me that he had changed his mind again and that he was going to build the barbecue himself (breach of contract). The next day we were unable to work because [redacted] had locked us out of the property. I then cancelled the materials deliveries coming that day. [redacted] called me and told me that he wanted a complete refund of the $10,000 he had paid. I told him we were under contract and that we would be finished with the project in two weeks. He refused and kept the gated locked. He wouldn’t answer my calls and refused two certified letters requesting that he return my landscape equipment. Since his wife [redacted] had paid me with a credit card they were able to lie to the bank and get a complete refund on June 6th 2014. [redacted] has since gone on a slandering campaign online and even attacked my wife on a crafting website calling her a criminal. They posted online that I have a history of fraud which is untrue and is pure slander.She even lied to the State Contractor’s Board by claiming to this day that they never received the $9,000 refund. The Contractor’s board told me that [redacted] is crazy and that I knew better than to work for them. [redacted] and [redacted] received $5402.00 worth of work completed, $732.00 worth of materials left on jobsite and $2,611.00 worth of landscape tools and equipment that he refused to return. [redacted] and [redacted] subsequently hired another contractor to complete the work and ended up firing him as well. They then went to the Contractor’s Board and fraudulently claimed photos of his work as my work as evidence of poor workmanship on my part. I never abandoned the worksite. I was locked out. Homeowner’s landscape approval application was submitted. All work was photographically documented so that city permits could be obtained by me once the required homeowner’s approval came in. Standard practice. All work was built to local building codes. My business address at Clausen Nursery is correct and still valid. I live in the house in the back of the nursery. My Contractor’s license was valid I have been a successful landscape contractor in San Diego County for almost two decades and have no other complaints against me. [redacted] and [redacted] are opportunists and took advantage of me and got most of their landscape done for free as well as all my needed landscape tools. Please remove this false complaint from them as it is untrue.
