We are in receipt of the consumer complaint filed by Mr [redacted] in connection with Intelius’ Premier Membership Intelius provides clear disclosures within the report purchase process of the Premier membership offer Below, I have outlined the process and various places in which Intelius notified Mr [redacted] of the membership offer and details On December 23, 2016, Mr [redacted] purchased a 50% discounted Premier membership in the amount of $Mr [redacted] was notified of this offer when he selected his report and again on the payment information pageAdditionally, he was required to manually select a checkbox on the payment information page before he could complete his report purchase that specifically notified him of the offer and the membership terms, including that his credit or debit card would be charged $each monthMr [redacted] was presented with language in the same checkbox that by clicking the button to purchase, he agreed to the Terms of Service and Privacy Policy (with hyperlinks to each)A copy of the initial offer page and the purchase page is attached for your review The “Automatic Renewal Program” section located under the “Paid Services” portion of the Terms of Service states: “Upon your acceptance of an offer for the purchase of any subscription-based Paid Services, you will be enrolled in our automatic renewal program to help ensure that there is no interruption in your access to such Paid ServicesUnder this program, you authorize us to automatically renew your subscription at the end of the term of the subscription you purchased, and each subsequent term, for the same term length of the subscription you initially purchased (unless otherwise stated in the offer you accepted)Unless you change your renewal status as described below, at the time of each such renewal you authorize us to charge your designated Payment Method at the then-current, non-promotional price (unless otherwise stated in the offer you accepted) for the renewal of your subscriptionIf you no longer want to be enrolled in our automatic renewal program, you can change your renewal status at any time by completing the following steps: · Intelius.com – cancelling your membership on the My Account portion of the Intelius.com Website or by calling (888) 445- Please note that completing these steps will only stop future automatic renewals of your subscription and will not impact any automatic renewals that occurred prior to the date that you completed these steps.” Shortly after his report purchase, Mr [redacted] would have received a receipt confirmation email sent to the email address associated with his Intelius accountThis email contained the amount Mr [redacted] paid for his report and the Intelius Premier membership terms and conditions and instructions on how to cancel his membership According to our records, Mr [redacted] contacted us February 11, regarding his membershipHowever, the email address he provided, [redacted] @gmail.com, is associated to an account that hasn’t been active since August 6, After reviewing, the full correspondence, I was able to locate a secondary account using the ID transaction Mr [redacted] provided in a later correspondence This account is located under the email address [redacted] @yahoo.com Per the Terms of Service, Intelius has a no refund policyHowever, as a matter of customer courtesy, I have provided Mr [redacted] with a refund of his last four month’s membership fees in the total amount of $(x $19.95) on March 28, and removed him from the Premier Membership programMr [redacted] should note these refunds on his account within the next days depending on his financial institution’s billing cycle and internal refund policyWe are unable to provide Mr [redacted] with any additional refunds This information should successfully resolve Mr***'s complaintShould your office or Mr [redacted] have any questions or need additional information, please feel free to contact me at [email protected] Sincerely, Tara M [redacted] SrIP & Marketing Compliance Manager www.intelius.com

Intelius customers are presented with a two tier pricing structure when purchasing reports on the Intelius website.? Each offer includes a discounted report price plus a one-week trial of the Intelius Premier Plus membership which includes one background check voucher per month.? If the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first days and they will only be charged $for the Premier Plus trial membership ? Based upon a search of our database using the email address Ms [redacted] supplied in her complaint, she conducted a telephone number search report in which, when prompted prior to receiving her search results, she purchased the Premiere Plus membershipOnce she purchased this membership, she used her membership monthly voucher to conduct an individual background report search ? As stated in the Terms of Service, which Ms [redacted] agreed to prior to completing her purchase, Intelius has a no refund policy.? However, as a matter of customer courtesy, I have provided her a refund of $on October 25, Additionally, a customer service agent removed her from the Intelius Premier Plus membership program and she will not receive any future charges in connection with this membership ? Intelius customers are presented with a two tier pricing structure when purchasing reports on the Intelius website.? They have the option of paying the full price, or a discounted promotional price which includes a 7-Day Pass of the Intelius Premier Plus Membership.? When a customer selects the promotional price, they are presented the benefits of the membership and the terms and conditions of the offer, including billing.? By choosing to proceed with the purchase at the promotional price, the customer agrees to the terms and conditions of the promotional offer.Intelius does not currently offer a free trial for the Intelius Premier Plus Membership.? In this case, the promotional offer was accepted and the Intelius Premier Plus 7-Day Pass was activated.? When the Background Report search credit which was provided with the Intelius Premier Plus 7-Day Pass was consumed, the membership immediately charged the monthly cost for the membership.? Before the search credit was consumed, Ms [redacted] would have received a prompt confirming the use of the search credit and the charge which she would receiveThe Intelius Premier Plus Membership was canceled on 2/14/2016.? The charge of $was refunded on 3/8/2016.? This refund will appear on Ms [redacted] statement in one of the next two billing cycles, depending on the closing date.? Intelius’s policy is to use all applicable means to deliver the information service to our customers The information we provide is gathered from selected public records and other sources Local, state, and federal agencies make updates to public records The information can come from sources such as: marketing surveys, land deeds, catalog purchases, voter registrations, lawsuit filings, court records, magazine subscriptions, and address changes This data is compiled into a comprehensive public record search that Intelius maintains with active updates from its sources.We want Mr [redacted] to be fully satisfied with his purchase from Intelius Since he was not completely satisfied with the Phone Report, we have processed a refund of $to his account on 8/21/ Additionally, we have also refunded $for the Online Voucher for Phone Report This refund ($& $2.48) will appear on his statement in one of the next two billing cycles depending on the closing Again, all charges have been refunded.We sincerely appreciate your cooperation in resolving this matter and apologize for any inconvenience
