We believe there is a basic misunderstanding of how the swivelCard technology works.  We (intelliPaper) have no advertising outside of what is posted on our websites (intelliPaper.info and swivelCard.info).  We have many different tutorials that instruct how to register and operate the...

cards correctly.  Our cards are always used in connection with the Cloud.  Even "loading files" on our cards is done by placing those files in the Cloud and linking them to the card as described in this tutorial.  swivelCard always requires a working Internet connection for proper function.  There are no files previously loaded onto the cards except for a read only "click-me" file used to launch the user experience.  This customer was apparently trying to use swivelCard in ways for which it was not designed, notwithstanding the documentation clearly available on our website and communicated again during the corse of our staff's interaction with the customer.  The customer's attempt to alter the code built into our product is not supported per the Terms and Conditions which the customer agreed to prior to finalizing their purchase of the product. Here is the relevant section:  "You will only use intelliPaper in accordance with our directions for use (see help section on swivelCard.info for example). intelliPaper will not be held liable for any loss or damages resulting from any use of our product that deviates from our directions for use. In addition, intelliPaper will not be held liable for any loss or damage caused by any alterations or changes you or a third-party make to our product."   We have sold thousand of these cards and have had no issues like this with any other customer.  Based on the fact that the cards purchased were tested and known good when they left our facility, and the information we were to gather from our interaction with the customer, there appears to be no defect with the product, just a simple misunderstanding of product functionality.By agreeing to  the Terms and Conditions this customer also stated that they were fully aware that the product they were ordering was a custom product and that there were/are no refunds once the cards have been customized. Here again is the relevant section: "Because we individualize each and every order to meet your specifications, we are unable to resell our product to another customer once production begins on your order. For this reason, all payments become non-refundable once production starts. Furthermore there are no returns or refunds of the final product. If you experience any problems with your order, please contact us at [email protected] or (509) 343-9410, and we will be happy to work with you to find a solution"  Regrettably,  not everyone that had occasion to communicate with this customer was fully informed with respect to our standard Terms and Conditions.  We have however, remedied this and have made repeated attempts to work with the customer and help them understand the product and use it as designed.  We remain willing to do so and to replace any product that does not work as documented on our website because of a manufacturing defect.  We are a small company and any delays in communication, in this case, have to do with schedules of individuals, vacations, and holidays, and was not purposeful.
