Review: RE: SEEKING RELEASE FROM A ONE YEAR LEASE

BASED ON FAILURE OF INTERMOUNTAIN PROPERTY MANAGEMENT TO MAKE TIMELY REPAIRS NEEDED FOR REASONABLE EXPECTATIONS OF A SAFE LIVING ENVIRONMENT.

FOUNDATION INFORMATION:

[redacted], my husband, took a job with [redacted] in Livingston, MT and was scheduled to report for the first day on the job July 15th, 2013.

In June I began the search on the internet after calling several real estate agencies, we were only able to find a place for him to live with Intermountain Property Management.

I contacted [redacted], she did have a rental, I explained our urgency and the many phone calls already made trying to find a place for [redacted] since he was scheduled to begin work the 15th. I told her I had to travel over 750 miles to even be able to see a property, so needed to know I could rely on her as an agent also. After several phone calls she told me that I could see a property in Livingston, the following week; but I needed to call on Monday the 8th of July, to set up the showing date and time. I asked if I could see it Monday or Tuesday since I had to travel so far, "no" she said it would be later in the week maybe Wednesday or Thursday. I called on Monday at 11 a.m. South Dakota time to learn that my showing was set up for Tuesday the 9th at 10:30 a.m.. I said how can you expect me to be there on Tuesday it is at least a 13 hour drive from South Dakota to Livingston and I have to deal with lupus.

Her answer, "it was the way it was, was I going to be there or not it was a set 10:30 a.m. showing", I drove until late Monday

night, to Sheridan, WY . I left Sheridan early and made it to Livingston by 9 a.m. My phone rang at a little past 9 a.m. it was Wendy, the lady representative for Intermountain, she was in Livingston and could show the house right now.

I was totally exhausted, and totally by chance made the showing time they had moved forward by one hour.

We met at the property, did a quick walk through, and I pointed out some problems and ask about putting up a fence for our dog. The agent showed me where the property line was that we could put the fence up on and I thought since we had done the walk through together, the problems I had pointed out would be fixed. Eg., the nails sticking /> inch out of the door stops on two of the door frames, the floor vent cover missing in the utility room, and the wall plates missing in the master bed rooms bathroom. Later I discovered there is something wrong with the thermostat and the fan will not even come on to circulate air.

I was told how this place was professionally cleaned and commented the owner was getting ripped off then since the light fixture in the kitchen was filthy and light bulbs were missing and the floor in the bathroom was all stained from water getting on the floor because the shower door didn't have a seal.

On July 9th, I paid for a half months rent, $630.00 dollars, a security deposit of $850.00 dollars, a pet deposit of $300.00 dollars and the August rent of $850.00 dollars, then was informed if I was one day late on rent it was an automatic $25.00 dollars plus $5.00 dollars for each day after that.

The agent also took both garage door openers when she left. After I called for the third time, one was brought back by a man working for Intermountain Properties.

RESULT:

I did not send in the Statement of Conditions Checklist within three days, as defined on pg 3, paragraph 2,in the handbook, because my husband was not here so that both of us went through the house to make notes. [redacted] arrived from South Dakota on the 11th of July. It is my understanding:

PROPERTY MANAGERS ARE RESPONSIBLE FOR: the physical management of the property, including regular maintenance and emergency repairs.

• Maintenance- they are in charge of performing preventative property maintenance to keep the property functioning in top condition. For example, they are personally in charge of, or must hire someone to, exterminate, check for leaks, landscape, shovel snow and remove trash. This maintenance aims to keep current tenants happy and attract new tenants.

• Repairs-when there is an issue, the property manager must attend to it themselves or must hire someone to attend to it. They often have a large network of reliable plumbers, electricians, carpenters and other contractors.

EXISTING CONDITIONS LIST INCLUDING REPAIRS RECEIPTS:

[redacted] sent them a list of the existing conditions on August 7, 2013

This list was put into our file and no effort made to correct the obvious repairs needed to bring this up to meet with safety standards.

After nearly two weeks, when we had not heard back from the property management team I called to learn we don't do anything unless this is put onto a work order, I responded with anyone in their right mind knows nails sticking out of the door casings knows that is a safety issue, or the floor vent missing where a person could break an ankle, or switch plates missing where in the night a person could get a finger against a live wire, or the dryer so full of lint that we could not use it until [redacted] cleaned it out to discover the dryer vent had a big hole in it and needed to be replaced.

REPAIRS NECESSARY FOR SAFETY:

We sent along the receipts for the necessary repairs to be told by Intermountain "we will not reimburse you for these receipts because they were not authorized by us" I said, and How long does it take you to come down here and get these things repaired? The repair man, Leroy called to say he would be down on the 6th of September for repairs, and I asked him to reschedule because we had company here. He said he would be down Thursday the morning of the 12th, would that work? [redacted] stayed home on the morning of Thursday so Leroy could come in for repairs but Leroy never called and did not show up on the property for repairs by 12 O'clock so [redacted] went to work.

REMEDY:

We are asking to be released from this one year lease to allow us the necessary freedom to purchase a home of our own.

We are willing to rent by the month and will grant a 30 day notice in writing prior to leaving the property.

Response:

Tenant wants to get out of their lease to purchase a home. We have given them the option to find a renter to take over their existing lease. Once an approved renter signs a lease they will no longer be responsible for the lease and they will be entitled to their full security deposit refund bearing any damages, cleaning, rent or utilities owing.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Per our phone conversation this morning when I advised you that I had not one but two letters from the Revdex.com and I quoted you the dates written as 10/30/2013 and the second dated Monday, November 04, 2013 at which time you said you had not heard back from me.

First I only today have seen the response letter from Intermountain Property Management via your email sent 11-14-2013 so basically you have not given me the appropriate 7 day window in which to respond. I am wondering where the communications have broken down. Intermountain Property Management has since July shown a continued pattern for Failure To Perform in any sort of timely fashion, the repairs necessary on this property for health and safety, They have further failed to reimburse me costs put into this property for repairs to a window screen, switch plates to match the existing décor of the property.

I further wait for the listed repairs that were to be completed after [redacted]s walkthrough those include the burner pan on the range, the range hood filter, the front door’s screen door window. Waverly being the repair man was on site here the 21st of October and did complete the repairs for the bottom of the shower door, did fix the dryer door, did lube the doorknobs on both outside doors so they work, said he ordered the filter for the range hood, said he did order the range drip pan for this particular stove, said he did order the bottom seals for both exterior doors and would be back. I checked with the B&B Appliances where he ordered the kitchen range parts to discover the last time he ordered anything through them was in August and he stood in my dining area and talked to someone on the phone and told me he had ordered the parts. I want it in writing that I may vacate these premises due to the fact that this company has failed to perform. I want to implement my notice to vacate after I have it in writing that the year lease is ceased. I require a length of time to find and purchase a property and do not wish to live on the streets because of some missed clause. Every repair I have requested for this property has been necessary for health and safety. Now due to this being my first day of notice of response I fully expect a resolution.

Intermountain Property Management will still be holding yjr tenant to the lease terms. Again, if she would like to get out of her lease to purchase a home before the end of her lease term we can help her find someone to take over the lease. It is a fairly easy process.

The three maintenance items listed in this complaint were ordered and are on our maintenance techs schedule to take care of next week. The tenant will be given a call to schedule.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is semi- satisfactory to me. time still being my point of concern.

I asked for Wendy to definately find , as soon as possible another leasee, give me a 60 day window, to allow for proper cleaning and removal of my property from this premises and that should work out. I do need an advance notice for showing to insure all is in order to best represent this housing unit. Beds made, etc. I have sent pictures of the conditions of the property to the Revdex.com with the first letter so find that a redundant request to re-send those photos as they should be part of an existing file.
