With regards to *** ***’s title situation unfortunately it was something only time could take care ofHer issue has been resolved, she has her plates and her vehicle is titled the way we contractedWe had to work with a 3rd party title firm to navigate the State of *** ***
DMV/Title department to resolve her issue as that was the state in which the *** she purchased from us was originally titledThey erroneously marked this unit as a fraud case, and we had to go through a mess of red tape to clear it up Best Regards, ***

I was advised by David B[redacted] that he would be willing to work with me on a trade of my car and then suddenly after he talked to BMW NA I was told that that option was not available and stopped the talks. This is consistent with the treatment I have received from all groups at BMW. I am advised that a certain solution is an option and then shortly after I am advised that the solution has been denied and that it is no longer an option. Who does business like this? I am the customer here. I have a legitimate issue with service items that can not be resolved by service. I have brought my car in at least 3 times for the door locking issue alone. I pushed for a specialist to be brought in on the last visit and they were unable to resolve the issue. The definition of insanity to keep doing the same thing over again and expecting a different result. The service suggestion is now considered insane. It s clear that service can not resolve my issue and I will not continue to waste my time with bringing the car in only to be given zero resolution. When I buy any given product and it can not be serviced I expect the business to take that item back and give me a credit so I may buy a functional product. That is all I am asking here. BMW NA offered me two months of car payments (over $1000) to make this go away for them- they know this car is a lemon. I rejected that offer because that does not fix my issue. I can not resell this car with broken items on it! What is so difficult to understand about that? I am in a nightmare with this! I have also reported the door lock issue to the [redacted] as the door locking issue poses a threat to my safety and possibly to the safety of other drivers.I am calling on Advantage BMW Midtown as the seller of this car to please step up and resolve this issue for me through a buyback at 33k (purchase price). Advantage BMW Midtown sold me this lemon of a car- they need to be the one to make this right. Do not transfer responsibility to BMW NA as you are the ones to have taken my money for this car. And just as an FYI- I am looking at transferring my loan on the BMW books so you guys don't make another penny off of me. I have just paid down another 2Kon the car today and I'm looking at transferring the 18K left off to another entity. Step up and do the right thing!

I have been contacted directly by David B[redacted] of Advantage BMW Houston and was advised that I needed to work with BMW NA (corporate BMW) instead of with him as the dealer. BMW NA has not been interested in resolving my issues as they have advised that I need to continue to go in for service even though I have been in multiple times and with a specialist involved the last time. They even referred me back to Advantage BMW at one point. So each group is pointing to the other group for resolution and I as the customer am not getting any resolution to my issues. Service has not been able to resolve my concerns and I will not continue to waste my time trying to go down that road. A replacement car has been suggested by BMW NA and Advantage BMW (and denied for a reason I can not comprehend other than just pure disregard for their customer). Advantage BMW sold me this car and I am calling on them as the seller to step up here and accept this car back at the full purchase price of 33K and to allow me to use that credit to negotiate for a replacement car that is similar. I have been in service constantly during the ~6 months I've owned this car and I want for this lemon to be replaced. I never had a functional product in my possession.

To whom it may concern, Most dealerships purchase vehicles through auctions, trade-ins or other licensed dealers. In cases where auctions or other dealers are involved, the licensed seller provides a letter of guarantee or a negotiable title. In the case of a trade in most sellers confer ownership to the dealer with a power of attorney due to the fact that most trades are encumbered. It is standard practice, under Texas dealer law that vehicles are sellable with properly executed paperwork through licensed dealers while titles are cleared and forwarded.The situation with **. [redacted]'s title that led to the State of [redacted] sequestering her title and dealaying the transfer was completely unprecedented and unpredictable. [redacted] transfers and/or sells 3000+ vehicles per year and has never encountered this situatuion. We scrupulously deal with only reputable dealers and auctions and would never knowingly engage in business practices that would delay title transfer.[redacted] did a very poor job of communicating with **. [redacted] throughout the delay and for this we apologize. The title has been processed as expediently as possible by [redacted], given the delay in [redacted], and **. [redacted] has been apologized to. The dealer would like to know what else the dealer can do to settle this complaint given that the client recieved what she asked for all along, albeit it very late. [redacted]

The main item in here is what are you doing as a business ( [redacted]) not to sale another car in this condition, the title suppose to be available at the time of sale, and no one was communicating to me or my [redacted] about anything. 5 plus months to get a title, plates, and a second copy for the car, it is an over statement of what Customer Service is for a [redacted] dollar [redacted].

BMW NA will continue to offer service on the vehicle at the Center of the client's choice, since the car is in warranty. We are not purchasing the car back at the original purchase price since the car's value is less. He is welcome to log in to www.midtownbuyscars.com and get a value assesment.

I have now had this car about 7 months and have had constant service issues. There has not been a period of time where there have not been unresolved service issues. I believe that this car may have had some type of electrical shock or other event happen to it prior to my taking ownership. Advantage BMW sold me this car as being certified and without issues which was clearly not the case. I believe I can demonstrate that the salesperson knew about the rattle going on in the car initially before the car was even sold to me. That in itself was a breach of what was supposed to have been sold to me. There have been issues with a bad electrostatic sensor in the engine, the fuel pump, the electric door locks, the navigation system, engine roughness and the turn signal- all of which point to a possible compromised electrical system. As I have stated MANY times- I have taken my car in multiple times for the door lock issue alone that is still unresolved. My notes show it was taken in on 8/4, 8/18, 9/15 and 10/13 (4 visits) and there was no resolution. The last visit I asked for a BMW specialist to come in and they were still unable to resolve the issue. I had the lock ratcheting issue reoccur yesterday (12/16). It is not resolved! Again, the definition of insanity is trying the same thing over and over again and expecting a different result. I believe I have been more than patient and accommodating to BMW by spending my valuable time bringing this car in for service 4 times for the same issue with no resolution. Please stop suggesting that bringing it in again will resolve the issue. It is to the point that service can not fix it and I want the car swapped out. Why should I just accept this lemon of a car? Because you don't want to step up and take care of the issue? It is so extremely shameful that I am having to fight like this with you when there are such clear issues with this car. I have turned down 2 months payments from BMW NA because that does not resolve my issues. I want this car fixed and service can not do it! What does Advantage BMW not understand about that??The link that I was sent to appraise my cars value places the value at between $20,500- $23,100. I paid $33,000 for this car 7 months ago. So I am being asked to take a hit of between  $9,900- $12,500. I would then have to buy a new car (which I have certainly NOT been looking to do). I would never be able to get this same car back for this price! How can you even think to ask me after all of these issues to trade this car in for the numbers above and leave me with a large gap to even get back the EXACT same car with the same miles?? I mean are you serious?? So I pay extra money out of my pocket for the same car, you guys get even more of my money on another sale? NO. Just NO! Shameful!It is becoming very clear that Advantage BMW is not interested in bringing this issue to resolution for me. I am going to allow the [redacted] and [redacted] cases to go forward. Hopefully they will be able to force resolution with you. If I am not able to get a satisfactory resolution through these methods I will be filing a lawsuit against Advantage BMW. Please be advised that if I have to do this I will be asking for two things. 1) I want to get the full 33K credit for the car and to be allowed to use that credit to negotiate for a similar 5 series CPO car. 2) I will be asking for damages of no less than $20,000 to cover the lawyers expenses for having to bring litigation against Advantage BMW and to cover the hassle that you have put me through to get this resolved. That number will be a MINIMUM amount. Please do the right thing here. I have not yet sent a message to the BMW NA CEO but after this last message it is clear that I need to do this. I am also considering getting the Houston news media involved and possibly have this case broadcast out to the city. I think this is a clear cut case where you guys are just trying to railroad me with this lemon you have sold me and I will not be run over like this. I have worked too hard to the money that I have handed you for this car to accept a broken vehicle and no way to fix it. And I certainly will not accept the completely ridiculous suggestion that I should trade it in and have to pay thousands of dollars just to get the same car- the fact that you even suggested that is a major insult to me and just shows your total disregard for your customer and my satisfaction with what you have sold me. Please step up and do the right thing by accepting this car back at the full sale price. When you buy something and it does not work you either service it (clearly that can not be done) or you buy it back for the same price as what you sold it and you allow your customer to buy another one.  I will not stop pushing this- and if it has to be all the way before a judge I will 100% absolutely do it- I hope you guys are prepared to have this case in court. Stolen glasses? Damage to my car in service? 4 service trips for the same item with no resolution? A finance manager who basically attempted to steal from me? A salesperson who knew of an issue with the car before the sale and said nothing? I will bring all of this out in court. DO THE RIGHT THING!Regards,
