Review: On Sunday June 09, 2013 I attended a Jewelry Auction at the Embassy Suites Hotel in Temecula California. I went to this auction with my friend, a volunteer police offer of Temecula Police Department Mr. [redacted]. He received a newspaper advertising which indicated this auction was to be a SEIZED ASSETS FROM VIOLATORS OF THE LAW auction. See Attached exhibit (A). Newspaper Advertisement.

Item I purchase was auctioned as a certified rare, natural, Burmese, unheated, untreated ruby. The written description indicated as lot 236 14 carat gold ring with natural Burmese Ruby 4.61 carat in weight. 60 Round Brilliant Diamonds 0.93 carat in weight 8.84 grams. See attached exhibit (B) Item description given at the auction.

The auctioneer and the owner Mr. [redacted] also indicated that the Burmese government has banned exporting of ruby stones which made this a rare find and the steal of the day. The auctioneer said this item had an appraisal value of $60,000.00.

After returning home and looking at the certificate and the item looked suspicious. The certificate and the valuation on indicated as a natural ruby and not a rare natural Burmese ruby. No authentication was done in the certificate. See Attached exhibit (C). Appraisal certificate.

I immediately called Mr. [redacted] on his cellular number ###-###-####. He did not pick up and did not identify this as his phone number. I left a voice message. I again called him the next day Monday June 10, 2013. He assured that this was a natural unheated, untreated Burmese Ruby.

Unsatisfied I requested him to take the item back and return my money. He offered to issue store credit or return with a restore fee. I refused this resolution as I strongly feel this was a fraud or at least dishonest business transaction.

I attempted to resolve this dispute peacefully. I sent him several emails requesting a full refund. See attached exhibit(s) (D). Email communications.

I have contacted couple of gemologists who indicated that the claim of natural Burmese ruby can only be done by a gemological laboratory. I contacted Gemological Institute of America at ###-###-#### who indicated the same.

I have since gotten a second opinion from a highly reputable and Graduate Gemologist from Gemological Institute of America. Who indicated that the item is definitely not what was described at the time of the sale. The Gemologist(second opinion) indicated that the title used by the seller's appraiser is not known in the industry and appears to be none credible.

I hereby dispute this charge completely and expect International Jewelry Group return 100% of the money paid for the item. I am not willing to settle for anything less at all.

To Whom it may concern:

The following are documents that stand by our policies and how the customer is in the wrong.

Exhibit E a copy of the conditions of sale that is part of the catalog.

Our Advert is very clear, in it says that the majority of our merchandise comes form consignments and says "auction

not affiliated with us customer any government agency .All items subject to prior sale.error or omission" Exhibit F.

Exhibit F a copy of the advert clearly stating "other consignments which constitute the majority of other inventory from

private or commercial interests"

Exhibit B is a copy of the registration card in which the customer signed. It clearly states that ALL SALES ARE

FINAL NO EXCHANGES,NO RETURNS,NO REFUNDS,NO TRADE-INS. By signing the front of the card the buyer

acknowledges the conditions on the reverse side including but not limited to ,

#10 "AS IS" and #11 "CLAIMS". The auctioneer reiterates this information before the auction begins.

A copy of the terms is also on the back of the bidding card # and in the catalog.

Exhibit C is a copy of the credit card receipt .Exhibit Dis the sales invoice. The buyer signed again stating · I agree

that I have purchased these hems. Merchandise bought at auction all sales final no exchanges, no refunds or returns.

All merchandise sold as is ,where is ." Please note the bottom the invoice Exhibit Dis a breakdown of how we

charged the customer in us Dollars .

According to the Jewelers Vigilance Committee, if a customer agreed to the conspicuously placed term "as is" on the

receipt, which effectively disclaims any implied warranty of merchantability pursuant to 2·316(6)(a) of the. uniform

commercial code (UCC)

On 06/09/2013 , [redacted] came to our Auction held in Temecula , Ca . He entered and signed in filling out a

card with name address and signed that he agrees to !he terms of sale. He told me that he was in the Jewelry

Business and has a resale . Clearly now we know he was not on the Jewelry business and did not have a resale.He

wanted to return the ring only after we said he could not use someone else's resale number to avoid paying the sales

tax. There was an hour preview to view all pieces and view the appraisals.

Tho amount the customer is showing includes our 15% buyers premium that all auction houses charge and the local

sales tax.

Our ad clearly says the majority of our items come from consignments and all sales are final.

[redacted] bid against another customer for this item and when he came to pay he did not have a resale so we said we

could not give him less the tax without a valid resale. The next day when we spoke to him he said i1s not his tax

resale is a family friend thats In the jewelry business and we told him it has to be in his name to use the resale and

then he did not want the ring . We told him all sales are final and cannot be refunded as he was bidding against

Categorical rejection of the response of Internal Jewelry Group dated July 26, 2013

This message is a with regard to the response received from International Jewelry Group dated July 26, 2013. In the

response International Jewelry group attempt to paint a picture as if this is an innocent sale transaction. This in fact is

nothing short of an attempt to defraud me as an unsuspecting buyer.

As a person who never attended a jewelry auction, I was drawn to the apparent great value International Jewelry Group

offered for jewelry. I was drawn to their "Sized Assets from Violators of The Law" advertisement in the local paper, and

items listed with impressive estimated values supplemented by official-appearing documentation by supposed Certified

Gemologist, suggestive of an authentic appraisal. The auctioneer rationalized that I had obtained great value as the item

I won well below its estimated value.

That was until took a closer look at the merchandise the certificate. It was immediately clear that I had been scammed.

Then I called the owner and the appraiser. Owners delayed response and none response from the appraiser validated

my suspicions.

When I question about the item and the validity of the appraisal the owner was attempting only to secure his

transaction by putting emphasis on the legality of the invoice I signed instead of taking responsibility as a business

owner.

I filed a dispute with my credit card company, and provided them with requested documents. I also provided them with

an appraisal report from a reputable jewelry appraiser as a second opinion. (See Attached as exhibit 1) After

investigations they determined that the International Jewelry Group was at fault and returned my money.

I returned the item back to the seller but was returned as rejected. With the advice of the owner of International

Jewelry Group I once again put the item back in the shipping couple of days ago.

I also made a criminal complaint with the Temecula Police Department.

I categorically reject the response of the seller and expect a full refund and the re-imbursement of fees paid for the

second opinion and shipping.

Rejection of the response of Internal Jewelry Group dated August 21, 2013 This is my response to the message received from International Jewelry Group LLC today. Again, the owner of International Jewelry Group is attempting to secure his transaction by pointing out how he has created a system to protect himself. This only means that he is trying to scam people by getting them into a legal contract thereby the law would permit him to continue his venture.

I think the law will catch up to him quicker than he thinks. I just am not the one who would allow him to take advantage of me. I suggest that before he sells his jewelry he get the appraisals from reputable institution such as GIA. Not after he is he sells the jewelry utilizing official-appearing documentation deceit the unsuspecting buyers.I have returned the item to him and now he owes me money for the second opinion appraisal and shipping costs.

In response to to the letter , we have explained the situation and there was no fraud this customer is just having buyers remorse , we have told the customer that we would take the ring to GIA for another appraisal . He returned the ring and we have taken it in to GIA the appraisal can take 4-6 weeks. As soon as we have the Appraisal back we will contact the customer on the outcome . The customer is being very unreasonable and when he entered our auction and signed the registration card it said very clearly "all sales are final , no returns, no exchanges" We have tried to work with the customer but he is not willing to work with us .The customer will be contacted as soon as we have the ring back from GIA .
