ILE Global llc is an ocean freight forwarder and NVOCCWe have been contacted by ** *** and were requested to quote a door to port rate for a 40' container of refrigeration units going to Senegal.We were told that refrigerators will be shipped (no dims given) and were to be picked up from his
suppliers warehouseWe gave a quote for a total of $for this move with the understanding that we will position the container and his warehouse will be loading the container.His warehouse loaded the container and were able to fit only unitsThey also failed to secure the cargoOur trucker refused to move the cargo unsecured and we also can not ship the freight unsecuredWe contacted *** *** and advised him of the situation and he signed a waiver that we can move the container as is to another location to brace and secure for proper transportationWe also advised him that additional charges will applyWe billed for the job $- that's $additional for the extra stop for bracing and securing the freightWe told him from the beginning that payment is due before any freight release will be given for the freightHe is claiming that we are holding his freight hostage and that the units are in a warehouse and wouldn't ship for weeks when in fact the container left on schedule and has been at Maersk TerminalIt was scheduled to leave on a vessel on Oct *** and was not loaded due to an error in the terminalWe have a le tter from the steamship explaining the delayIt will be sailing Friday *** of Oct but until we are paid we will not release the documents or the freightThis was the terms of payment from the start. He is blaming us for not loading units in to a 40' container when the loading was NOT our responsibility and units can not physically fit.We pride our selves on the service we offer and never had any complaints or issuesWe can send you photos of the units loaded that show how much space was leftWe can also send you correspondence that took place.Please let me know if you require additional information from us.Respectfully,*** ***

In response to letter received 10/**/161- amount charges is exactly per Quote sent by Sven on 09/**/16$+ chassis fee for days at $per day + $to make an additional stop to block and brace the cargo per regulations.2-Cargo can not move loss and this was explained to him several times over the phoneWe had to finish work his warehouse did not want to do and we charged minimum charge for it.3- we have a letter from Maersk stating that they held the shipment at the port and not us., further more he was advised of the delay prior to making the transferHe asked me how much it will be to pull the containers back, bring to a warehouse, off load, pick up the rest of the refrigerators and load correctlyI advised him that it is too late to do (on the *** of Oct when the vessel sailed on the ***) and that even if we could do I dont believe they will all fit and it will be very costly for himHe hung up with me and sent you another complaint

[- Please see attached the original amount that we agreed on which is different from what they mentioned- I was never told that there will be additional charges for the bracing and I never directed them to brace it as shown on the second attachment- On my the original complaint I mentioned that they wanted to ship on the *** instead of the *** and I found out yesterday when I called them that it hasn't ship yet and will ship on the ***I have a 3rd attachment in which they tell me that it has shipped.Now I have already made the wire transfer, they waited all this time to tell me yesterday, when I called them, that the refrigerators have not shippedagain, they could have told me that a long time ago so we could pull it and load it the right way but noIf I haven't called I would have never known that the refrigerators are still in the USILE Global / International Logistics Express will not take any responsibility for the lack of communication that generated so much failure at so many levels of this transactionI called yesterday to try to find a solution to this issue and today I read this message where they once again reject all responsibility I'm losing money and businessAt this point I have no leverageI paid them all the money (even the charges I didn't agree to pay, see attachment 4) so I can get my paperwork and find out that they haven't even shipped itOnly they know where the container is and when it will ship or arrive if it ever doesDuring that time I'm paying the loan I took for this transaction paying interest and losing business because the buyers will pretty soon not be interested anymore.]

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
- I clearly asked your guys before I agreed to do business with you if the cost they showed was inclusive of all the cost and they confirmed- There is nothing I can do about it at this point but you are claiming that you had to secure it so if any of the refrigerators is damaged I will expect you to fully reimburse me since you are charging me for additional service not identified before agreement and not agreed to- I was never advised of any delays and if I hadn't started the conversation I would have probably still not know about it
Like I said previously I was being held hostage of the situationI would like to be refunded half of the cost since only half of the load was shipped and I would like to get indemnified for all the consequential damages associated with the delayed shipment resulting in lost businessI didn't have a agreement with Maersk but with ILE GlobalThe letter doesn't mean anything to me

his suppliers warehouse. We gave a quote for a total of $3825.00 for this move with the understanding that we will position the container and his warehouse will be loading the container.His warehouse loaded the container and were able to fit only 22 units. They also failed to secure the cargo. Our trucker refused to move the cargo unsecured and we also can not ship the freight unsecured. We contacted [redacted] and advised him of the situation and he signed a waiver that we can move the container as is to another location to brace and secure for proper transportation. We also advised him that additional charges will apply. We billed for the job $4200.00 - that's $375 additional for the extra stop for bracing and securing the freight. We told him from the beginning that payment is due before any freight release will be given for the freight. He is claiming that we are holding his freight hostage and that the units are in a warehouse and wouldn't ship for 3 weeks when in fact the container left on schedule and has been at Maersk Terminal. It was scheduled to leave on a vessel on Oct [redacted] and was not loaded due to an error in the terminal. We have a le tter from the steamship explaining the delay. It will be sailing Friday [redacted] of Oct but until we are paid we will not release the documents or the freight. This was the terms of payment from the start. He is blaming us for not loading 41 units in to a 40' container when the loading was NOT our responsibility and 41 units can not physically fit.We pride our selves on the service we offer and never had any complaints or issues. We can send you photos of the units loaded that show how much space was left.
