Thank youCustomer’s Statement of the Problem: on 10/23/I received a phone call from midtown stating I had an outstanding balance of due to me forgetting to update my credit card info in their system when I
switched banksMr*** credit card on file for the electronic funds transfer (EFT) of his monthly dues had rejected for two consecutive monthsPrior to this courtesy phone call, he was sent two letters, via U.Smail, notifying him that his card had rejected payment.therefore I gave my credit card info over the phone for midtown to charge to that balance which cleared the following day 10/24/15, the remaining balance of was to be pulled on Friday 10/30/but it did not occur instead midtown rolled the balance together with a late fee and Novembers membership of 119.00, to a total of and charged that to my card on 11/4/This is accurateWe manually entered the $payment on 10/We included the remaining past due balance in with the automatic payment of November’s membership dues which are due the first of each monthMr*** had been a member since March and was well aware that his dues payment charged to his credit card at the beginning of each month, which is our standard business billing cycle for all members. when I called midtown to dispute this charge as I never authorized it, they stated that giving my credit card number was authorization and they had the right to act as they did in the contractWhen Mr*** joined he purchased a one year membership to Midtown and agreed to pay for it on a monthly basis, by EFTWhen he gave us the new credit card number, we understood that this was the replacement for the old card which had rejectedHe is required by our contract to have a credit or debit card, or account number from a checking account for EFT payment of his duesHe never said, “use this card for the balance I owe you but not for future dues payment”I looked over the contract nowhere does it stated that they have the right to charge a card a different amount then the one they where authorized by me on the phone, when I still have yet to come in and fill out the paperwork to update the card in their systemBy signing the agreement, Mr*** agreed to have his monthly dues charged to his credit card each month. Furthermore, each month, to credit cards reject payment75% of the credit card updates (sometimes just a credit card expiration date) are completed over the phone without filling out a formThe form is only one method of getting new credit card information from a memberThe card number I gave was only for outstanding balancesWhat midtown is standing by is that they can infer that any card number given can be used as a viable source of paymentOur club POLICIES, RULES AND PROCEDURES state, “Initiation fees and usage fees may be paid in cash, with a check, Visa, MasterCard, American Express or Discover credit card. An automatic payment source on file with our business office is required for membership dues and incidental charges.” By our membership agreement Mr*** agreed “…to abide by all rules, policies and procedures of the Club…” I have tried to reach an solution with midtown with no successOur club manager, Bob ***, offered Mr*** two complimentary months of membership and return of the $return feeHe did not accept, and stated that he wanted the two months taken from his one year obligation which we were unwilling to dothey are holding to the contract which holds no grounds for their argumentand an email from an former employee of midtown"October please update ***'s CC# *** *** *** *** exp **/** Charge today and the balance of next Friday 10/30/please waive the return fee" Those two charges are all I authorized I never said to update my card in there system Once again, Mr*** never instructed us to only use this card for the outstanding balance and not to use it for future dues paymentThe desired outcome I am seeking is this the return of the that was wrongfully taken from my accounts, I am also seeking my remaining contract with midtown void as midtown acted outside the contract to achieve their financial goalsWe are very confident we acted within the terms of the agreement and suggested to Mr*** that he consult an attorney to validate thatAs mentioned above, Mr*** signed a membership agreement which obligates him for one yearUnfortunately Mr*** has not used the club and we believe this complaint is only filed because he wants to terminate his membership before his obligation is metThe desired outcome that we wish is that he starts using the club, thereby honoring his agreement, and we will give him two complimentary months at the end of the agreement, a current value of $
