our response to this complaint.We take complaints of this nature very seriously and have taken the following steps to investigate this matter. Upon receipt of the complaint, we talked with our self storage manager, Calvert B[redacted], who manages the self storage location.Mr. B[redacted] indicated that he spoke with the customer on at least three occasions and offered to look at the unit with the customer. Mr. B[redacted] also sent a copy of the signed contract to the customer when they requested it. If a copy of the signed contract is still needed, I would be happy to provide a copy.Regarding the statement in the complaint about the back wall of the unit being black, this discoloration is an inherent characteristic of unpainted steel panels and would have been on the panels when they were originally installed during construction. Again, this is a discoloration of the panels and is not mold and was not caused by water or moisture in the unit. Mr. B[redacted] specifically recalls inspecting the unit with the customer before they rented the unit and at that time pointed out this discoloration and told the customer that the discoloration was part of the steel panels. The customer initialed the rental agreement indicating that they were afforded the opportunity to inspect the unit and acknowledged that the unit was satisfactory for occupant’s purposes Mr. B[redacted] indicated that the rental agreement was reviewed with this customer as it is his practice to specifically point out paragraphs 9 (Non-liability of Owner for Damages; Insurance Obligation of Occupant), 10 (Release of Liability) and 19 (Lock Cutting Devices) to customers.After receiving this complaint, this unit was personally inspected by myself and our Vice President. The day we inspected this unit it was an extremely wet day and was raining quite hard at the time we inspected the unit. This unit was completely dry. There was no evidence whatsoever of any water coming into the unit or any mold.  We also inspected the walls and confirmed that the black discoloration was an inherent characteristic of the unpainted metal panels. The website of Interstate Self Storage reads “Good condition guaranteed” and “clean, dry and secure storage." From our inspection, we are confident that this unit was in good condition and provided clean, dry and secure storage. Dear Ms. [redacted]:We are in receipt of your letter dated March 4, 2016 to Interstate Self Storage.  We have reviewed your letter and are submitting our response.A copy of the lease signed by the occupant is attached per your request.An owner of a self storage facility such as Interstate Self Storage has responsibility to provide clean, dry and secure storage. As I stated previously, there is no water coming into the unit or any mold. The area surrounding the storage units has drainage consistent with its gravel base which is not characteristic of allowing stagnant water to form and we are unaware of any such stagnant water. Interstate provided clean, dry and secure storage to this occupant.An occupant of self storage unit has responsibility for the items that are placed into the storage unit. The owner of the storage facility does not know the type and condition of items that an occupant places in a unit and does not enter the unit during the rental period to check an occupant’s property. The items placed in storage are the responsibility of the occupant. The lease signed by this occupant specifically states that items are stored at the sole risk of the occupant and that the owner is not responsible for damage to an occupant’s property including damage from mold and mildew. Again, these paragraphs were specifically pointed out to the occupant by our manager.This occupant knowingly chose to store furniture in an unheated, unventilated, unlighted, non-climate controlled storage unit with concrete floors. This unit was never represented to be climate controlled. This unit was never represented to have humidity control. This unit, like all of our units and other unheated, non-climate controlled buildings in general, are, of course, subject to temperature extremes based on weather. Every occupant is subject to these same atmospheric conditions. This does not constitute a defect in our storage unit and it does not indicate that Interstate “failed to perform the conditions of this lease.”Kitty litter, charcoal, etc. are commonly used as desiccant materials to help absorb humidity that might form in the atmosphere. Our site manager’s suggestion of using this type of material was merely a courtesy to inform the occupant of this common practice.We have again reviewed this claim and are not able to offer any kind of reimbursement to the occupant including any testing for mold/mildew, which if done, would be at the occupant’s own peril and expense.Thank you.Sincerely,Lauri L. It is true that I, or my husband have spoken to Mr. B[redacted] three times before making a complaint. However since 1/27/16, I have had no contact with him. The signed lease agreement was never sent to me after my initial request on 1/27/16 as stated it was in their response. I left another message on 2/10/16 requesting it again be sent to me. No response. I to this date have not received the requested copy of the lease. I sent him pictures at His request via text message on 1/18/16, but when I called to follow up, he didn't answer. He did conform via text that the pictures were received. I even asked him if I could bring the chairs and table to show him or for him to come to our house to see them, again no response. I also asked to speak with the owner after he told me "I must have put my chairs in there wet." I have never received a call back. That call was placed on 1/20/16.It is true that my husband signed the lease in the end of July 2015, however, it is my position that the landlord failed to perform the conditions of this lease. My items were not in good condition, or even usable upon taking them out of the unit as stated on his website.The unit may have been inspected on a wet day, as stated in their letter, but the amount and intensity of the black mold/mildew on much more than just my dining chairs and table had to be caused by dampness in or around the unit. I have pictures as to their condition when I placed them in the unit. At the entrance of the unit there is a huge area of stagnant water that sits there and makes it difficult to enter the said unit. Mr. B[redacted] at the time of the lease agreement being signed, even suggested to us that "we place a bag or two of charcoal in the unit to absorb dampness," which we did. That recommendation alone, suggests prior knowledge of dampness and moisture in the unit. The black substance on the rear of the unit was never discussed with us, because it was not present or is was not as predominant as it was when we removed our items. I have pictures to show that also.The more I unpack my things, the more black mold/mildew I find on my bins and containers, even my box springs. I would like to find an independent company to do a test on the mold/mildew to find out what it consists of and if it poses any danger to myself or my family.I merely want to make sure the mold/mildew doesn't pose a health risk, and to be made whole for the wood and chair coverings, as well as the foam under the upholstery on the dining room set that are covered with the black mold/mildew.If you have any other questions or concerns, please feel free to contact me. Review: We stored our furniture and personal belongings in a 10X25 storage unit at Interstate Storage for 16 months while we were in the process of relocating. The ad on the internet read "Good condition guaranteed; clean dry and secure storage. We felt confident that our furniture and belongings would be in the same excellent condition when we retrieved them as when we placed them in the unit. However, this was not the case. Our Pennsylvania House Pine dining set has black, mold/mildew like fungus on the legs of the table and six chairs. The upholstered seat cushions are ruined by the black mold/mildew that covers the cushions. The other wood pieces and box springs also have this same type of blackness to them. We have phoned the office with our concern on three-four occasions asking for them to look at the chairs, but they are not returning any of our calls. I have requested a copy of our signed lease , but they have not honored that either. I do have pictures of before and after of the dining set. Lastly, they is black all over the back wall of the unit that they said was always there, we DO NOT recall it being there when we stored our belongings.Desired Settlement: We would like to have the wood pieces cleaned and the dining chairs recovered by a professional to restore them back to the original way when they were stored.
