I am in receipt of your correspondence dated January 3, concerning a complaintraised by [redacted] Please be advised that we are currently considering legal actionagainst Ms [redacted] for breach of contract and the financial damage caused to our businessas a result of this breach.Our refund policy is clearly posted and Ms [redacted] was well aware that she was entering into a legally binding agreement to purchase the vehicle in question when she signed the purchase agreementMoreover, Ms [redacted] represented that she had the necessary funds to complete the purchase and never mentioned a financing contingency prior to entering into said agreement, nor was any such contingency included in the purchase agreement.We have always been fair and reasonable with all of our customers, however we also have to protect our interests when a customer fails to honor a legally binding agreement.If we were to act contrary to our own policy by simply refunding a deposit after acustomer breaches an agreement there would be no point in accepting deposits.Moreover, when we accept a deposit and enter into a purchase agreement the vehicle is no longer available for sale and any interested customers are advised that the vehicle is sold, we also bear the cost of redeeming title of the vehicle from floorplan when a purchase agreement is completedWhen a customer breaches the agreement we suffer financial damage and lose other customers that are interested in purchasing it in the process.We have already gone above and beyond by extending Ms [redacted] a courtesy by offering to refund her deposit after the vehicle is purchased by another customer and we are incredibly disappointed that she has further damaged our business by making this unfounded complaint.RegardsMark ***General Manager
