I am writing in response to the complaint made by our valued resident, [redacted] made on 4/4/16. I find it unfortunate that this is her interpretation of the recent events regarding her tenancy. Ms. [redacted] moved into our property in June of 2015. At that time, she filled out a check in/check...

out condition report out in which she marked the widows specifically in every room as acceptable and signed it. We also provided her with a preexisting conditions form as she described. This is to mark anything in the unit that was there prior to the tenancy to ensure the current tenant doesn’t get charged for damage they did not cause upon move out. The windows in said unit are not “broken” as verified by multiple independent staff and contractors after inspection. However, we did put a work order in for a vendor to replace necessary hardware on her windows but again due to the age the vendor is have having trouble finding the correct parts. We have also received multiple bids from other window companies for replacement.  We are taking this matter seriously and we at corporate asked the on site manager to go and check her windows and show her how to use the windows property being she did not communicate with him at all about the issue she was having. This is similar to other complaints she has made. The manager seems to be intentionally avoided by this tenant and he is there to oversee the property and take care of issues immediately. An example is the insect issue. No one has been made aware of the issue until now. We have a contract with a pest company to spray to prevent on a monthly basis and to include any unit needing serviced. It would be easy to schedule an additional treatment of the specific unit had we been told. Since this complaint was made she has called and emailed multiple times daily about additional complaints and not once has the insects or windows been brought up. That been said every complaint we have been notified of has been addressed and/or remedied almost immediately. This tenant is the only one that has complained about the window issue. They are not able to be repaired to move easier and the entire building’s windows would have to be replaced. We have gotten a couple of estimates for them (again, addressing the tenant’s complaints) but it’s ultimately an extreme cost to the owner and not our decision. During the winter months we send out letters to every tenant at every property SUGGESTING they use their heat during the extreme cold to avoid mildew and pipe breaks. We have had these issues in the past and it’s a simple way to avoid a costly headache and damage to the owner’s property as well as the tenant’s belongings. As for the increase in rent it’s unfortunate that our market increase is the way it is. I assure you the increase in cost is felt by everyone. Our rent increases stay with the market. What the owner’s get hit with is the rapidly rising costs in maintenance, property taxes and utilities. Unfortunately, rental costs mirror this. They have to or rental wouldn’t be in existence because no owners could pay out of pocket to keep them afloat. The cost of living is rising at a truly rapid pace but I assure you it’s felt by owners and tenants alike and not a decision out of “greed.” To call this unit uninhabitable is quite an overstatement. Especially being everything was acceptable to the tenant 10 months ago. These claims are slanderous and we have been extremely active in resolving her concerns. We hope soon we can all find a reasonable resolution to these multiple issues.

First of all, you did not contact me via phone. However, you did call the co-signer on my lease. That person does not live here and I know you have my actual house phone number because I've left it on multiple phone messages. Secondly, the landlord you speak of did not knock on my door and so that is a blatant lie. However, we spoke on Monday and arranged a day that I am available to install screens on my windows and back door. Thirdly, if you read the responses you have submitted to this claim you stated that I did not report my broken windows on my move-in list. It seems that you are trying to backtrack what you have previously stated when there is proof otherwise. There is no miscommunication. You are obviously not as on top of the situation as you would like people to think you are. You are correct, however, when stating that I am not happy. Having windows (especially one on the lower level) makes the unit unsafe and allows insects into my home. All I see is a corporation trying to get over on the people who pay to live in a safe and habital home. In my humble opinion, the cost is not my problem. I am not the one who rented units with the knowledge that those units needed windows fixed. This is a problem, not just for me but all the other tenants who also are suffering because of this issue. Stop making excuses and do what the law states you are responsible for.

It was stated that I didn't report window issues when I moved in. I did. On the same report they stated (move in paperwork) I listed not only the fact that I needed a shower curtain rod that worked, but I also stated on that same form that my windows do not work correctly IE they are broken. I ask, how did you know I needed a shower curtain rod? You knew because I wrote it on my move in paperwork, the same form that I stated that my windows need to be fixed (and trust me when I say, fixed Windows would have been more appreciated than a shower curtain rod). I will agree that I never reported an insect problem until now, but then again this year's bug problem (reported by many) is a bigger problem this year. A problem that I wouldn't have to worry about if my windows were fixed in a timely matter. Also, this company stating that no one else has broken windows is a lie. I was told by the manager that they hired, that I wasn't the only one with the problem. In fact, the manager's apartment also has the same issues as mine. Too many lies spew from this company's fingertips, all for a good rating with the Revdex.com. I still am unhappy. 
To their response about raising rent, it is now illegal for them to raise it per HB 4143, so I will continue paying the lower rent until I've been here for a year.
I still need my windows fixed, per the paperwork I turned in a week after move in (and if they don't have the paperwork, then it was illegally disposed of). I also expect reimbursement for my bills (the paperwork given during the cold months did not say anything about suggestion, it was written as a must do). Interwest Properties are trying to save their butts, and I am not the one to let them. I have  had problems since move in & those problems have been ignored. Perhaps they should hire more trustworthy people.

Complaint: [redacted]I am rejecting this response because:
Interwest Properties should not have trimmed the trees because a neighbor requested it.  We (the owners) should have been told about it.  A lot more of the tree was trimmed then just what was growing on the sidewalk and the tenant said he does not like that it was trimmed.  If Interest had ANY ethics they would refund the money.

We managed [redacted]’s property for just over 5 years, beginning May 2010. We performed a routine curbside evaluation of the property in January of this year and identified cedar shrubs overtaking the yard and growing into the pedestrian space of a sidewalk and up into the utility lines. We determined...

the need for trimming to take place in the Spring. In May, our Grounds Maintenance Technician completed the job poorly. We responded and correctly removed hazards of remaining branches, trash & debris. The neighbor approach and complained of pedestrians tossing cigarettes into the undergrowth, and was pleased it was trimmed back to prevent a fire. The employee was disciplined and resigned shortly after. [redacted] was not satisfied with our recommendation to trim the other shrubs at the property, and was not pleased with our performance with regard to evaluations and therefore terminated our services. While we regret her needs were not met to her level of expectation, the property was well maintained and in good condition before, during and until management was terminated with the exception of a damaged piece of siding, on the detached garage, the owner asked us not to bill the tenant for their negligence. We will not refund our services as they were performed in good faith, in accordance with our management services agreement, and cleaned up at our cost.

I am very sorry to hear that the tenant is still so unhappy. I believe there was a misunderstanding as it was never stated that she didn't report the window issue when she moved in. What I had said is that she had marked the windows as acceptable on her move in paperwork and noted it as a pre existing condition. This is a very large expense to the owner that we have to have permission for and though it may be an irritation to the tenant it in no way makes the unit uninhabitable.  Multiple people in our organization have listened and tried to speak with this tenant and make her happy with no success. The vice president has personally called her and asked for a call back to discuss her concerns and she will not return his call. Everyday brings a new complaint and we cannot seem to make her happy. In the meantime the manager has gone out and purchased hardware to try to install it to repair the window to her satisfaction. He is still awaiting the tenant to answer the door and allow him entry to remedy this issue. We will continue to do our part to abide by our responsibility to the rental agreement with our tenant and remedy any issues they have as we do for every tenant who allows us to.
