I hereby rebuff the so-called arguments by the BUSINESS on the following grounds:The Jaguar XJwas really purchased on 02/15/but between 6:15PM and 6:PM after just a fifteen-minute drive with an unknown employee of the BUSINESS at wheelUntil completion of the deal I did not have a chance to drive the car I agreed to this because the dealership employee assured me that the car had had no evident defects, making its AS IS condition different from the one caused by the car’s age and mileage It is not unusual that people buy cars AS IS, but only on condition that they either get a chance to examine the vehicle bringing in a certified mechanic or can rely on the words of BUSINESS representatives The mentioned decrease of the price by the BUSINESS could not be explained in any other terms but as a fraudulent trick with a view to have a space for maneuvering with fixing two not so expensive failures claiming it “the pure Courtesy of InTrend Auto Sales” and leaving it for the client to pay for the rest My having purchasing the vehicle was a result of providing me as a customer with information on what was AS IS in that particular case The defect of the car’s cooling system drew my attention even while the test-drive, but BUSSINESS representative assured me that it was a result of that type of a car specific of presenting information on its systems functioning Unfortunately, I could not resume driving of the car earlier than on 02/18/ I made the only trip to my mechanic who concluded that the vehicle had had failures of its cooling system and the right front shock absorberSo, I drove the car to InTrend Auto Sales Without any objections they took it for inspection and fixing serious problems They did not issue any document proving the fact of taking the car back, failed to specify their obligation concerning the scale of the repair and the time period of their working on the car I have never received from them the mentioned offer to cover the labor in replacing the right front shock absorber In the light of this the BUSSINESS claim for storage fee is absolutely groundless because there has been no agreement between me and the BUSSINESS for keeping my car in their territory for any other purpose than the repair work Even from their response it is clear that they failed to do the service for which they had taken the car back It's a shame that the dealership that calls themselves BUSINESS acts just like street car sellers ignoring necessary paperwork based on Used Car Rule requirements In my case they have intentionally committed fraud and then facing disclosure of the fact that the car prepared by them for sale even with a warranty had had serious problems started the maneuverings to settle the case to their benefit I am seeking that the Contract of 02/15/should be annulled and all my damages reimbursed in line with acting Regulations

Review: On February 15, 2016 at 6:15PM (after the dealership business hours), I bought from InTrend Auto Sales located at 5877 Power Inn Rd., Sacramento, CA 95824 a car of Jaguar XJ8 make of 2004 (odometer reading at the moment of purchase was 159.919). A sales person from the company took me for about a ten-minute test ride with him at wheel and assured me that the car was functioning great. During the test drive I noticed that there were appearing red signals of the engine temperature meter, but the sales person explained that it was just a warning signal that occasionally would come and go. He asked me about the final price acceptable for me and eagerly agreed to my offering a sum of $6.000 flat including all paperwork.

Now it appeared clear to me that in line with the dealership’s policies I was deprived of an opportunity to assess the car’s real value through comparing its genuine condition with the price I was supposed to pay.

I finished the trip to my house (6.5 miles) with an arrow of the engine temperature meter in red sector. Unfortunately, due to my medical problems I need help with moving around and I had to postpone my driving the car for two days when my helper could come to support me.

On Thursday of February 18, 2016, I found out that the cooling system of the car was completely dry and on filling it with Coolant I drove to Costco (3.5 mile trip) to fill the tank that was nearly empty and then to my mechanic Mr. [redacted] at [redacted] Auto Service, located at [redacted] (6.5 mile trip). He diagnosed the complete cooling system malfunctioning and failure of the right front shock absorber. Both defects could not be a result of my covering the distance above but they had not been timely disclosed by the seller.

On getting that conclusion by a certified specialist I immediately delivered the car to the dealer-ship (10.8 mile trip) at about 4:00PM of February 18, 2016. The car is still in their territory.Desired Settlement: The dealership should refund the money paid at execution of the agreement and all expenses caused by their delay with resolving the dispute in line with acting ordinance.

Response:

This 2004 Jaguar XJ8 was purchased on 02/15/16. Original price of the vehicle was $6499 and came with a 30 Day Warranty. Customer negotiated the price to $5,199.54 which we agreed upon but notified him that we would not be able to provide warranty at that price. He decided to purchase the vehicle AS IS with no warranty for the negotiated price after doing a test drive. A Cool Off Period was offered at $150 for 2 Days or 250 Miles to test the vehicle. With this option, he could return the vehicle and get a refund. Customer declined the Cool Off Period. The Vehicle was Sold AS IS, with no written or oral warranty implied. He picked up the vehicle on 02/15/16. Customer called and complained that vehicle was having issues on 02/18/16. We offered to inspect the vehicle, free of charge. After inspecting the Jaguar, we determined that it would need a new Thermostat and Water Pump. We Replaced the Thermostat and Water Pump, FREE OF CHARGE. Once again, this vehicle was AS IS, so this was done as pure Courtesy of InTrend Auto Sales. Customer Demanded that we also change the front strut, which we would not be able to do for Free. We offered a solution that we would cover the Labor in changing this part. He declined and left the Vehicle in our possession. Vehicle drove fine with no issues. We are forced to store the Jaguar in our indoor facility since it was ready to be picked up on 02/23/16. We contacted Customer multiple times to pick up his Vehicle. His decision was to to leave it at our facility. Storage Fees started on 02/25/16 at $50 per day since the vehicle Drives fine and there is no reason for him to not pick it up. After all negotiations and Free repairs that we were not required to do, the customer is not responding. Current Storage Fee is $4550 and this vehicle will be going up for a Lien Sale in the near Future to cover the Storage that we are forced to provide. It's a shame that Customers do not value when Businesses go out of there way to help and work with them in resolving issues. We were confident in this Vehicle, as we drove the Car 122 Miles prior to even listing the vehicle up for sale. Unfortunately we can not predict what will happen to a 12 Year old car, but were still willing to resolve the issue, even when the issue came up after the sale of the car.

Response:

I am rejecting this response because:I hereby rebuff the so-called arguments by the BUSINESS on the following grounds:1. The 2004 Jaguar XJ8 was really purchased on 02/15/2016 but between 6:15PM and 6:30 PM after just a fifteen-minute drive with an unknown employee of the BUSINESS at wheel. Until completion of the deal I did not have a chance to drive the car. I agreed to this because the dealership employee assured me that the car had had no evident defects, making its AS IS condition different from the one caused by the car’s age and mileage. It is not unusual that people buy cars AS IS, but only on condition that they either get a chance to examine the vehicle bringing in a certified mechanic or can rely on the words of BUSINESS representatives. The mentioned decrease of the price by the BUSINESS could not be explained in any other terms but as a fraudulent trick with a view to have a space for maneuvering with fixing two not so expensive failures claiming it “the pure Courtesy of InTrend Auto Sales” and leaving it for the client to pay for the rest. My having purchasing the vehicle was a result of providing me as a customer with false information on what was AS IS in that particular case. 2. The defect of the car’s cooling system drew my attention even while the test-drive, but BUSSINESS representative assured me that it was a result of that type of a car specific of presenting information on its systems functioning. Unfortunately, I could not resume driving of the car earlier than on 02/18/16. I made the only trip to my mechanic who concluded that the vehicle had had failures of its cooling system and the right front shock absorber.3. So, I drove the car to InTrend Auto Sales. Without any objections they took it for inspection and fixing serious problems. They did not issue any document proving the fact of taking the car back, failed to specify their obligation concerning the scale of the repair and the time period of their working on the car. I have never received from them the mentioned offer to cover the labor in replacing the right front shock absorber. In the light of this the BUSSINESS claim for storage fee is absolutely groundless because there has been no agreement between me and the BUSSINESS for keeping my car in their territory for any other purpose than the repair work. Even from their response it is clear that they failed to do the service for which they had taken the car back. 4. It's a shame that the dealership that calls themselves BUSINESS acts just like street car sellers ignoring necessary paperwork based on Used Car Rule requirements. In my case they have intentionally committed fraud and then facing disclosure of the fact that the car prepared by them for sale even with a warranty had had serious problems started the maneuverings to settle the case to their benefit. 5. I am seeking that the Contract of 02/15/2016 should be annulled and all my damages reimbursed in line with acting Regulations.

Review: On Saturday, February 13, 2016 I purchased a used vehicle from this dealership. One condition worried me enough to note it during the test drive, I did, and it was included in contract that they would fix it. I purchased car, and on drive home engine light came on and car started making ticks, clicks and clunks. I pulled over and called dealership. They would not take car back and told me they would "inspect it" when I brought it down for the original issue in contract. I continued home and took the vehicle to our local 30 year BMW specialist, who told me in his 30 years in the business this car was in the worst condition he'd ever seen a vehicle in. They did not believe I even bought it from a dealership. I called and confronted the dealership with the list of safety issues found by this specialist and told them I wanted to return the vehicle. This car was sold to me as "mechanically safe" and is anything but. It has thousands of dollars of breaks/repairs needing to be done and I believe prior accident undisclosed to me due to some of repairs noted by mechanic that should never have been made. I was told by the dealership, after this phone call, that the only thing they could do for me was I could bring the car down (3+ hour drive in a vehicle I have been told is unsafe to drive and recommended I don't!) for original AC/Heater unit repair, they will look at it and fix what they can. I will have to leave it for an "unknown period of time" at my own expense for a rental car since I will have no other transportation. This is unacceptable. This vehicle was advertised with about half the description being broken/not working/falling apart/misleading information. I took screen shots of everything before they took their pages down and some of what they listed as being "inspected" are listed by our local specialist as being broken/defective/unsafe. I am scared, broke, and want to return this mess of a car that should never have been sold in anywhere near this condition in the first place!Desired Settlement: I would like to take the vehicle back (either drive it or tow it depending on the ability to drive it at the time a resolution is reached) to the dealership and get my money back. This vehicle is unsafe, I am a single mother of two and this was all my money paid out for my only transportation. I believe I was taken advantage of, sold a misrepresented vehicle in what should be salvage condition, and this is fraudulent. I want a full refund, I want rid of this vehicle, and I want to be done. ASAP.
