Complaint: [redacted] I am rejecting this response because:I read the attached letter from IID and if the final inspection was competed then it was completedI just want to note that no one went inside the house to check for smoke detectors, etcor in the garage to check where the panels monitor is located I did notify the representative from zing solar and showed him the day he came to my housezing solar is using the same outlet that is used for my sprinkler system and cable system to also connect the monitor for panels and I believe it may be too much for one outletThe zing solar representative said he would speak to his manager to get it fix, hopefully the issue is fixed soon so everything is ready when panels are turned on Sincerely, [redacted] ***

Ion Solar (formerly Vision Solar and Zing Solar) has previously attempted to work with [redacted] on the inquiries brought up by himIon Solar does use solar industry standard software equipment from satellite imagery to identify various factors, such as azimuth, shading, climate, coordinates, etc to give a proposed estimate of the approximate production that the system would produceAll proposals that are presented are estimates, and explicitly state they are approximations based on estimates and are subject to change based on various factors such as future electrical usage, future utility price fluctuation, weather, varied shading, and other uncontrollable factorsIon Solar does not have a guarantee of production, nor do any documents support a 49% offset guaranteeProduction and bill offsets are presented to give customers a gauge of approximate savings and production coverage, but are obviously susceptible to change on a daily basis due to customers’ power usage habits and lifestyle changes, thus a guarantee of offset wouldn’t be feasibleIn regard to the delay of installation and inspection, solar installation is at the mercy of local county and city inspectors and design review that varies not only per city, but per personIn this particular incident the county had changed their stipulations and requirements and began enforcing different thingsThis included additional engineering companies to be contracted out to complete out the designs Ion Solar has identified the discrepancy with the amount of production that the system is now producing compared to original anticipationThe solar system is functioning at approximately 75% of estimated productionWhile Ion Solar does not have a production guarantee, and while usually it takes roughly one year minimum to determine production, Ion Solar would like to compensate based on the production that is not accruing, and not offset percentages that wouldn’t be possible to identify with changing usageIon Solar will be reaching out to the customer to come to an agreement on the production of the system, and also gather information on the current bill and usage to identify how the customer’s bill is not changing more than anticipated

Hello, Ion Solar bases proposal estimates on the utility usage provided by the customer at the time of sale. A review was conducted on the customer's proposal, and determined that all calculations and estimates were appropriate with the information we were provided with at the time. The...

customer's sales proposal estimated that the system designed would offset the previous year's electric usage by 85%. The presentation of these numbers are stated to be estimates, not guaranteed production amounts, and Ion Solar believes no deception took place in this matter.  Ion Solar does not guarantee production or utility offset, as those can vastly fluctuate depending on the customer's usage habits, weather, etc. Our Customer Installation Agreement, separate from our non-binding proposal presentation, does however guarantee the following: "Contractor warrants that Customer's PV System will be designed, engineered, and constructed to meet the requirements of this Agreement and is capable of operating free of major defects and in accordance with all PV manufacturer specifications."We have documentation showing the 5.13 kW (18 panel) system has been installed, and we believe it to be operating without defect. To date, the system has been projected to produce within 80% of 2270 kWh, and has produced 1830 kWh (83%). As weather improves with the approaching spring and summer months, we are confident system production will increase to the higher end of that threshold. The customer also signed a Net Metering Agreement with his local utility company that stated the following regarding delivery charges:"[Customer Name] shall pay the Customer Charge component set forth in the then current Residential Service tariff, without discount or credit for customer generation equipment.""[Customer Name] shall pay the Delivery Charge component set forth in the then current Residential Service tariff for all kWh consumed regardless of the source generation."Ion Solar believes that all terms of the contract have been communicated and fulfilled. The customer's system is functioning without defect, and has been provided with all warranties and workmanship guarantees in place. As a solar company, we generate production estimates that the solar system will produce based on third party computer software that accounts for satellite shading imagery, climate, equipment, location, and a vast amount of other factors. We request a utility bill from each potential customer to...

understand what amount of power they were using prior to solar and what amount of power they will use with solar. With the estimates, the computer software generates an estimated proposal that creates an approximation of what percentage of the previous utility bill will be offset. On the proposal, there is specific language indicating that the numbers are an approximation and based on previous utility history and are subject to change. As a company, we received a utility bill that showed approximately 7-8 months of utility history and was calculated out to be approximately 9800kW annual usage. The solar system that was proposed was estimated to produce 6284kW annual usage. The utility bill dollar amount as an offset is not a number that can be used to guide the production of the solar system. A utility bill dollar amount offset fluctuates day to day, as the consumer of the power may have increased their power consumption dramatically month to month and therefore the projected utility offset based on past history is different each day. Ion Solar bases the performance of the system on the power it produces and not on how much of the utility bill dollar amount is offset. Despite Ion Solar having no production guarantee in its contract or any materials, Ion Solar would like to attempt to make sure the system is producing close to what it had originally projected. Most monitoring services state that at least a year of production should be given to view what the system is producing. After about 10 months of production, the system is estimated to produce roughly 6400kW annually, or above what Ion Solar has on record that the system should produce.    The proposal given is also an estimate, as it states, because utility companies may, depending on their own regulations, change the pricing they charge customers for power or solar. In this circumstance, we have heard that Berkeley has inflated their solar fee as of December 2016 charging customers more, which potentially could result in the customer paying, more than anticipated for solar. This was not to our knowledge and did not occur until after the system and contract were completed and functioning for half of a year. This also is speculation on Ion Solar’s part as to a potential higher bill. Ion Solar will reach out to the customer by phone or email to touch base with the customer and see what concerns they have and go over the original estimates and explain any issues that have arisen due to the utility company potentially changing their rates for what they charge for power.
