has advised me to not issue a refund . They said for me to wait until he files for a charge back. In there opinion  it sounds like fraud due to the fact he wanted me to send him payment and he will keep the item until he receives  payment. He violated the terms and conditions of the Auction sight and I have the emails stating that also if you would need them.
