On 10/7/2019 Iron Mountain Towing was dispatched by *** service order #52223. My 2009 Chevrolet *** was towed to ***. I was present during time when my vehicle was picked up from my home onto a flat bed tow truck. Camera footage from my home and cell phone video available to provide proof of the perfect condition of my vehicle before towing. On arrival to *** my vehicle was unloaded and backed into a tree damaging the bumper, rear light and rear driver pannel. The tow truck driver acknowledged hitting my vehicle bumper against a tree and said "I didn't even see that tree I'm sorry". As I took photos my 11 year old son stated the driver looked dissatisfied with my actions. His tow truck was still positioned in front of my vehicle and I expected he would pull my vehicle forward and off the tree. I drove to my home approximately 10 minutes away and returned to *** with my husband. On return iron mountain Towing was gone and our vehicle was left backed into the tree. No effort was made to try and right the wrong that was done. In addition, my vehicle was left unlocked and unsecured in an open ungated parking lot. Additional photographs were taken at this time. On 10/8/19 my husband arrived at *** at 730 am and spoke with Manager Steve who reported the driver from Iton Mountain towing failed to report the damage done to the vehicle. Steve also reported the driver from Iron Mountain towing reported my vehicle was " good to go" as he turned over my vehicle keys. Steve manager at *** stated he was "shocked" that my vehicle was left unlocked. *** contacted on 10/7/19 immediately after damage occurred. Report made at 620pm. Photographs provided via email. Follow up with *** on 10/8/19 - per *** they will contact me within 24 hours but it was suggested that I contact Iron mountain towing regarding the damage. I contacted the company at 1042am on 10/8/19. I was put in touch with Mike who identified himself as the manager. I explained the situation and provided the service order # as per *** representative's instructions to which Mike replied "are you done". I was accused of not being able to converse with people and I was told that I was speaking "200 miles an hour". I clarified multiple times that I was stating facts and information pertaining to the incident and Mike manager at iron towing stated " yeah those are your facts and I need to see what notes my driver entered". I questioned Mike regarding the likelihood of his driver entering damage into his notes if he failed to report the damage to Excel towing and also left my vehicle unlocked. Mike the manager reported " *** doesn't require that we lock or secure vehicles so that not a thing". Mike continued in an accusatory fashion stating that if his driver acknowledged running into the tree and causing the damage why didn't I get his name. I explained to mike iron mountain towing that I immediately contacted ***. He continued on in an extremely dismissive and accusatory fashion . I finally responded look I didn't ask to have my vehicle damaged it was picked up from my home no problem no damage and gets dropped off and is backed into a tree I'm following up as I was instructed to by *** and if your vehicle had the *** damaged out of it I'm sure you would be upset and want direction on what's next. Mike manager at Iron Mountain towing hung up on me at 1044 am.

I have had a very unsatisfactory experience with Iron Mountain Towing and seriously doubt their honesty and business ethics.
Many of the problems have been sorted out through my insurance agency. However, one remains. A towing accident occurred in my garage on June 14, 2019, in which the tow truck winch broke and my car rolled back into the garage, damaging shelves, personal property and my car. First of all, Iron Mountain claimed that most of the damage to my car was pre-existing. Not True!
The subject at hand involves a check reimbursing me for 2 out of 5 shelving units .I have not received the check despite calling Mike at Iron Mountain and emailing him twice to suggest how the transaction might be accomplished; i.e. he could mail me the waiver of liability form, I would sign it, return it, and he could then send me the check. Obviously, I was giving him the benefit of the doubt (again) that he would keep his word and send me the check. So far, he has not returned my messages or made an attempt
to negotiate the matter. This is par for the course in my dealing with this business.

Dear Mr.,

You asked for the mirror to be painted which we did. Your insurance company was satisfied with this and closed the claim. When we sent a driver to your home for you to sign the letter and give you the check you refused. We have tried several times to settle this with you. Then you call our office at early morning hours and yelling at our employee because you want a check. We will be happy to meet with you to have you sign the letter and give you the check.

I am this response because:

I was not home whenever a driver was sent again for me to sign the form allowing me to receive the check. I have suggested that the form be mailed to me. I would sign and return it and Iron Mountain could mail me the check. I see no reason for me to be responsible for driving to Windsor to pick up the check. If you could designate a specific day and time, I will make every attempt to be here to make the transaction.

Yes, you painted the mirror. Thanks for that. I told you that I would forgive all of the personal property losses if you would paint the mirror. Otherwise, I settled with my insurance company with the unfortunate consequence of the damaged vehicle parts unavailable. I did not sign the paper originally because none of the obvious damage to the front bumper and hood was dealt with by your body shop. Painting the mirror was only part of the deal. You said you would repair the body damages. The impact has also effected my alignment, which is just one of the resulting damages that I have been paying out of my own pocket.

At this point I am only asking for you to reimburse me for two shelving units.

I do apologize for yelling and using foul language to one of your employees. It is very uncharacteristic. I just love my 1996 Lincoln Town Car and was very disappointed and frustrated

to have the car returned to me in a unsatisfactory condition when none of it was my fault.

We can come to you if that is more convenient, we never said you had to come to us. How about Tuesday July 2, 2019 @ 10 am. We can come to you or you can come to us. Just let us know if this date and time works and where you would like to meet, we come to you or you come to us.

I would also like to state that the complaint you have is with Iron Mountain Towing and Recovery not Iron Mountain.

I was told by Iron Mountain Towing that a representative would come to my home today, Tuesday, July 2, at 10:00 a.m. bringing a waiver of liability form and a check made out to me for property damages incurred when my car was the victim of a winch breaking. Iron Mountain Towing did not show up or call me to explain why. I am convinced the business is determined not to pay me because there is no signed legal document; just a gentleman’s agreement that I would be given a check to cover the cost of some of the damaged shelving units. If this is the case, I would like to know. I was hoping the issue could be resolved today. What is the next step, if any, that I can take to obtain the check?Thank you
