Initial Business Response /* (1000, 8, 2015/05/20) */
On November 11, 2014 the average Denver temperature went from 67 degrees to negative 13 degrees in close to a 24 hour period. The 80 degree temperature drop was the largest drop ever recorded in Denver in that short of a time period. Many...

plant species were affected, some experienced frost burn, and others died completely. Most of these plants were zoned correctly for our area as was the case with the Boxwoods installed at Mr. [redacted] house. The shrub installation was performed on May 15, 2014. Ironwood received no complaints about the installed plant material until April 21, 2015. Customer has accused poor plant material or poor installation; poor installation would have been evident within the first 90 days in the form of singular dead branches. All plant material installed by Ironwood Earthcare is purchased from [redacted] Wholesale Nursery, a reputable wholesale nursery in Denver. Mr. [redacted] plant warranty was exclusive of acts of God, which Ironwood Earthcare is charging as cause of death of the plant. Ironwood Earthcare extended some credit to the account for replacement as an act of good faith. Mr. [redacted] rejected the offer although his plants were not covered by warranty. Plant warranty is designed to cover aspects of plant installation and establishment that can be controlled or modified by Ironwood Earthcare, i.e. insect, disease, water or lack of. An 80 degree temperature change is considered to be an act of God, and is not under Ironwood Earthcares control. Ironwood Earthcare is still willing to offer a $76.00 credit to Mr. [redacted] account toward plant replacement which would cover one of the three plants.

Initial Consumer Rebuttal /* (3000, 10, 2015/05/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The business has failed to address why all three boxwoods planted by them died, while 3 boxwood plants planted by me a month later are still thriving. The explanation provided simply does not make sense... If the plants in question died based on the temperature drop as implied by the business, why weren't the other plants impacted at all? At this time, the only acceptable resolution would be full refund of the cost of the three plants in question.
