Thank you for the opportunity to reply to this complaint against Our store that is unfortunately the personal responsibility of our client.BMW Motorrad offers a year/mile warranty against defects of material or workmanship of the motorcycles they produceBMW Motorrad also extends a year warranty on their parts, accessories and apparel items that have been designed, tested and approved by BMW engineersWhen untested and unapproved Aftermarket items are installed resulting in damage to the motorcycle, it is not the responsibility of BMW Motorrad or the BMW Center to replace or repair the damaged items.Our client has purchased and self-installed an unapproved Aftermarket Windshields on his motorcycle that unfortunately melted portions of his Instrument ClusterThe manufacturer of this Aftermarket Windshield clearly states in the Installation Instructions and warns against the possible damage to the Instrument Cluster if left uncovered in sunlightThese are the exact words from the Windshield Manufacturer warning in the Installation Instructions,Sunlight reflected off the inside curvature of the windscreen can, at certain times of day, cause extreme heat buildup on the motorcycle's instruments and possibly even melt themExercise care in parking to avoid thisPark your motorcycle facing the Sun or place an opaque object over this area.The cause of failure of our clients instrument Panel is that the Instrument Panel has been melted by the Aftermarket Windshield that he purchased and self-installedWhen asked, our client admitted that he did not read the instructionsDuring our last discussion our client also denied the possibility of this potential damage from direct Sunlight even after reading the warningPage 2As a company that has been selling motorcycles in Orange County since we pride ourselves on customer serviceIt truly pains us to hear that any customer is not satisfied but in every case we must apply the BMW Motorrad Warranty accurately or risk fraud claims and charge backs from BMW.As an offer of pure Goodwill, we offered to sell our client a new Instrument Cluster at our cost and install it for freeThis offer was declined and within an hour of leaving our shop our client has taken to Social Media and posted inaccurate and personally abusive complaints against our store in every place that he couldThis inaccurate and spiteful posting is deliberately attempting to damage our business and online reputationIt is truly unfortunate that our business must tolerate or respond to the Online Bullying that is now the norm in our Society.In closing we will not offer to pay the disputed amount of $to our client for damage to his motorcycle from and Unapproved Aftermarket Windshield that he did not purchase from us and self-installed.I have enclosed a copy of the BMW Motorrad Warranty statement regarding damage from unapproved accessories and a copy of the Installation instructions from his Aftermarket Windshield manufacturerThe Installation Instructions clearly states the possible damage to his motorcycle when the windshield is installed.Respectfully, [redacted] General Manager Irv Seaver BMW MotorcyclesCc; Mr [redacted] , BMW Motorrad USA Customer Relations, BMW Motorrad Regional reprentative

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Companies claim is not possible because the motor cycle instrument cluster was never exposed to sunlight. Motor cycle jacket was always draped over cluster. There is an ongoing problem with these instrument clusters. information on the internet confirms this. First cluster was replaced by the company with no mention of the aftermarket windshield.
I have since traded in my motorcycle in to another dealer, lost yet another fortune on the trade in. This complaint remains UNRESOLVED, and the public has the right to know of the shady dealings of this company!!!
