Im a Independent Roofing contracter, who finianced insurance thru BidLake Agency inc.they took my money without ever proving me documentation of a certifacate of insurance or any documentation for that matter.IT has caused me to lose work with local contracters, and home owners because I could not provide a certifacate of insurance

Review: [redacted] and I had an agreement to complete work in my attic. This agreement was a packaged price deal. Mr. [redacted] only completed a small portion of the agreement. While doing this he damaged my ceiling in multiple places as well as collapsing in an area. He said he would have someone fix that, but he never did. I told him before I hired him that I will be checking work as I have with a past contractor. I went into the attic to view his work. I then contacted him as some top caps were not filled in, duct added is to short and falling off the T, and the T's are not insulated (T's are where the ducts branch off from a main. I have a few of these.). I was informed all duct work needs to be insulated and new duct work is insulated better than the old stuff. But what good is it if you have T's that have no insulation around them, thus compromising the system. His reply was that he was done and I would have to fix the drywall he damaged and he would not be back to complete insulating the duct work, fixing the short duct, capping the walls, and blowing in insulation. He feels it will only cost $200 to fix the drywall, but that alone will be hundreds more. He took $1,500 from me and only performed a very small amount of work. I will now need to hire someone to do the work he was supposed to do and hire someone to fix his damage.Desired Settlement: I have contacted him to repair but his refusal to complete the work requested is unsatisfactory. That was my ultimate request. I have contacted him twice after he said I would have to complete this myself, but no response. However, since he will not complete the work and fix his damage, I would like a refund of my money so I can contract with another contractor.

Response:

Customer was given an estimate listing all of the concerns based on a 3rd party independent energy audit. As an Energy Efficiency BPI Contractor for 5 years, my business is focused on educating the client on each issue found in their home and how the repair will fix the problem. Every line item has a cost and the client can decide on all measures or the areas most important to them. Nothing is so cut & dry as to provide any kind of “package deal”. The final line items decided from the scope of work was based on what he could afford.

This customer had several big issues going on in his attic which most was related to HVAC. His air handler was built into a cove by the builder that was to small and still housed the original 20 year old unit. The plenum for the supply undersized and non-existent for the return side. Every part of the duct work was extremely undersized with each duct branching off several times and each boot covering two rooms instead of one. The ductwork is poorly insulated to an R4.5 with black plastic covering to attract more heat. Ductwork was compressed, twisted, bent 90 degrees contributing to poor air flow.

My original proposal based on the 3rd party auditors suggestion was to enlarge the ducts to the two bedrooms that seem to always get little air and are hot in summer and cold in winter. After looking at all the issues noted above I suggested to the customer that he might be better off to wait on the two bedrooms and have all of the ductwork replaced when he gets a new air conditioner because I couldn’t make the ducts much larger based on the small size of the trunk and plenum.

One of my guys cracked the ceiling by stepping on the attic ceiling instead of one of the rafters while working on a kneewall. Once all work was completed except for the blown-in insulation I gave the customer a partial invoice for $2006.13. Customer explained that he was going to hold back $506.13 until drywall repair was done. I contacted my drywaller who was supposed to make the repair on Saturday to accommodate the customers schedule. The drywaller’s son was in a deadly car accident late Friday night so Saturday the drywaller called the customer and myself from the hospital ICU to explain.

Sunday I got several text and emails from the customer saying that he didn’t think some of my work was done right in the attic. I explained that the duct he says was to short was the original duct and was never replaced or cut. The “T” he says was not insulated I told him would be covered by the blown-in cellulose but is also just used to connect the ductwork or split ductwork runs therefore would not have batting insulation. All voids were sealed with ductboard, top plate openings were sealed with foam and any place the customer thought were open had 2x4 just running lower with some insulation pulled out while other open voids that extend down to the floor which would heat the walls were capped off.

Drywaller is on-site today repairing the drywall damage. As I stated above, all work was completed, balance due $2006.13, customer paid $1500 leaving a balance due of $506.13. Why does he think he should get money back for work completed that was never fully paid?

We have done nearly 1000 homes over the past 5 years and have never had a single complaint. Eighty percent of our business comes from referrals. Our goal is to make the customers home more comfortable and healthy with an added bonus of lowering their utility bills by at least 30 percent.

I have received probably 40 emails, text, and phone messages from this one client extending before I even meet with him on the proposal. After he left me 5 more text, two emails, and three voice messages on a Sunday telling me, after his first time in an attic, what I’m doing wrong, that was the last straw. It’s the first time in history that I have ever walked away from a payment and helping a customer but I felt it was in the best interest of the customer and me. I wish anyone that would like to work with this customer, “the best of luck”.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

As the contractor stated, he walked away from the job. It took me calling him once a week for a month to finally get a drywaller out here that I did pay for. In regards to the $2,003 owed, I am going to attach a copy of his invoice where it showed $1,930.67 of which I did pay $1,500. (Please note the blown in insulation was not done, thus he subtracted the cost of $1,404.80 until that was done.)

All I've asked from this contractor was to come back out and make the small repairs needed. Would take no more than a few hours of his time from start to finish, but he won't even discuss with me. In regards to the duct being too short and at a tight 90 degree angle, he told me he removed that and took it out of the attic. Now he's saying he never removed it. I'd like it replaced with a longer one and then resealed with mastic. Also the T where he said blown in insulation would cover it, it's on the edge of the vaulted ceiling and any amount of insulation would fall off of it onto the lower ceiling, thus putting some batting insulation around them would suffice.

In regards to all top plates being capped off, that's what I wanted to discuss as I found a few that don't appear to be.

In regards to stating he told me to not worry about enlarging the vents until I got a new AC unit, he sent me a text after he quit the job stating that. He never once told me that before hand as I wouldn't have paid him for it if he couldn't have done it. See invoice where he states Replacement of ducts to west and sw bedrooms for $728. Just replacing the larger R-8 ductwork alone probably isn't that much.

Also I remember him telling me that he didn't find any plumbing, etc... holes that needed to be sealed in my attic, yet he never removed or reduced the $375 charge at the top of the invoice.

He also told me he would take some money off the bill to get my clothes cleaned on where his worker busted through the attic hatch in the master closet and drywall and insulation filled the closet and covered my clothes. They removed the large amount of drywall and insulation but I still had to finish vacuuming and washing all my clothes but never received a credit. I also had to vacuum the house as there was no cleanup done at all. However, I'm not complaining about that, I just want the work completed.

By the way he quit the job on Monday May 20th after I called him one time about the issues and sent him two picture texts of what I was talking about (This was the first time I went into the attic to see his work). After he sent me a text that he quit, I did call him twice after that asking that we discuss this, but no reply.

What's sad is I saved him a lot of extra work, as at one point he was getting ready to cut a bigger hole in the south bedroom ceiling when I walked by down the hallway and asked him what he was doing. He told me what he was going to do, at which point I explained he was in the wrong room. That's the same room where he said he removed the duct and already threw it out of the attic. He never did pull that piece back up, but there is now another piece connected to it that's stretched to the max and at a sharp 90 degree angle in which as I stated above, I want replaced. I didn't get so much as a thank you, but an excuse on how he got all turned around from being up there.

Regards,

Business
