Review: ITEK Construction ("ITEK") is developing a new residential property directly behind my property. ITEK demolished a preexisting home and is constructing a new home on the lot. Part of that construction involves building a free-standing garage which is approximately 2 feet from my fence line. The workers who constructed the garage and completing the roofing dropped construction debris over my fence and onto my property, including loose roofing nails, roofing nails in cartridges, individual shingles, a carpenter's pencil, and plastic packaging. Additionally, my wife observed one construction worker enter my property to retrieve an unseen item which fell onto the property. One of these items, or perhaps some other item which was likewise collected, struck and cracked a small solar panel affixed to my fence, and severed the accompanying low-voltage electrical wire which powered an LED light affixed to my shed. This light, which I purchased and installed around the time I moved into my new home in June 2014, is no longer operational.

I contacted the owner of ITEK, Mr. Osman Y[redacted], on September 15 using a telephone number he had provided to my neighbor prior to commencing construction. Mr. Y[redacted] told me he was busy and to text him my telephone number and address and he would return my call. Having not received a response, I send Mr. Y[redacted] another text message on September 23. Mr. Y[redacted] texted by "Call me pls" and I returned his call on the evening of September 23. Mr. Y[redacted] was immediately confrontational, and without ever hearing my story or seeing any evidence, told me I was making a "ridiculous" claim and stated it was a "[redacted] impossible" happenstance. Mr. Y[redacted] lectured me on electric code, saying that my out-of-the-box, do-it-yourself light violated code and that I, in fact, was responsible for having such a product on my property (Mr. Y[redacted], eventually hearing me say that it was a solar powered light, seemed concede that this point was without merit). After saying that he needed to calm down, Mr. Y[redacted] agreed to come to my home the following morning, September 24, to view the damage. He said that if he was "satisfied" he would write me a check on the spot for the $50 I spent on the solar powered light. We agreed that he would meet me at 7 AM.

At 7:25 AM, having not seen or heard from Mr. Y[redacted], I sent him a text message saying that we would need to reschedule because I had to depart for work. I sent Mr. Y[redacted] two photographs of the damaged light, to which he responded "Forget about it." He then said, "This not broken by us" and "Shingle does not break it." I reminded Mr. Y[redacted] that "as I did not witness the impact, I can't say what broke it," but that "I have found shingles, roofing nails, and other debris in my yard." Mr. Y[redacted] did not respond.

Having failed to meet me or discuss the matter in person, and refusing to personally examine the damage or take responsibility, I am left with no choice but to make this complaint in hopes that Mr. Y[redacted] might treat the Revdex.com with more respect than he treats his neighbor. I welcome the new construction and was excited to see the dilapidated old home demolished in favor or ITEK's new home. But I am discouraged by the callousness with which Mr. Y[redacted] treated me and his baffling refusal to accept responsibility for the damaged his workers caused to my property; the damage speaks for itself.Desired Settlement: I purchased the light from [redacted] in May or June 2014 for approximately $50, inclusive of tax. I installed in around the time I moved into my new home on June 1, 2014. It is now completely inoperable and irreparable. I would like the cost of the replacement light so that I may purchase and self-install the same light as I had it.
