Initial Business Response / [redacted] (1000, 5, 2015/06/23) */ In regards to the case #XXXXXXX made by [redacted] ***,I have documentation of all paperwork that [redacted] and her husband signed, at closing, in regards to her warranty with Ivie League Homes.I also have emails to prove that we have been in contact with her for the past year and half, and every time she has called or emailed us, someone in the office has responded back to her promptlyMrs [redacted] refuses to read the contract or any other paperwork that she signed and agreed to at closingPorch was warrantied and replaced no questions asked, by our concrete contractorHairline and nonstructural shrinkage cracks are to be expected in foundation concrete, homeowners definition of "Giant Cracks" is 1/crackWe sealed the cracks, to make her happy even though they did not leakTree that was planted in their yard was required by the City of Wentzville for occupancy, tree was not included in the price of their home,nor is it warrantiedWe addressed this issue 7/31/(per email)We cannot warranty tree, because the trees life is dependent upon homeowner watering,fertilizing,and keeping animals away(Also stated in warranty) Cracks in driveway are to be expected especially in control joint areas where it is supposed to crack due to the freezing and thawing events throughout the year(Also stated in warranty) We were devoted to make this customer happy on her countertop that is why we had it replaced (times)Carpet issue was fixed, we also gave [redacted] the flooring contractor name and number, she indicated to us by email that she wanted to call them herself to have them come back out (6/5/14),never heard about carpet again, till nowTheir yard was graded and sodded one time and it is the homeowner's responsibility to maintain it from thereWe did agree to go above and beyond and fill her settling areasWe completed the areas we could; homeowner installed a sidewalk down the side of the house, so we could not get the other settling area, which was on side of house, NOT the backyardWe do provide dirt for these areas(Also stated in warranty) Homeowners definition of Giant = wheel barrow of dirtSettling is expected in newly constructed homes and this situation is clearly explained in our warranty that was provided to customer at closing and agreed toAs far as our customer service, we have done everything, that we have agreed to, in our contract and during her warranty periodPlus we have went above and beyond to try and make her happy, so I am very sorry that she feels the way she does, we have emails and all paperwork, included in this response to prove her accusations are wrong and misleading(Please read emails and documents provided) We have gone above and beyond what other builders do for their homeownersWe were devoted to her and her family and their newly constructed home for over a year, but there is no way to make her happy, we have decided to close her fileWe have never had a single complaint from her husband, only her! As for A/C unit that she now has concern about a year and a half after move in.(move in date 12/2013) We had our HVAC contractor immediately contact her about her concernsShe has never called in a service call to HVAC contractor and they also explained to her that the unit installed is manufactured by Lennox and is energy efficient as is stated in our standard features listThat's what was installed at her homeShe is comparing hers to her neighbors A/C unit which is a heat pump, which is an upgrade, which her and her husband did not upgrade tooSo the comparison of the two units is not accurateWe have met and exceeded every concern that the ***'s have brought to our attention, even after their one year has expiredEvery time that Mrs[redacted] has called, or emailed, our secretary has always emailed or called back in an appropriate time frameAs you can see in the above information, Ivie League Homes & Properties LLC, strives to take care of our clients to the best of our abilities

Mrs. [redacted] refuses to read the contract or any other paperwork that she signed and agreed to at closing. Porch was warrantied and replaced no questions asked, by our concrete contractor. Hairline and nonstructural shrinkage cracks are to be expected in foundation concrete, homeowners definition of "Giant Cracks" is 1/8 crack. We sealed the 2 cracks, to make her happy even though they did not leak. Tree that was planted in their yard was required by the City of Wentzville for occupancy, tree was not included in the price of their home,nor is it warrantied.
