Dear Sir or Madam:This is in response to the above reference complaint filed against Ivy K Realty,LLC on January 5, 2015.The tenant has been advised from the beginning of the term of the lease that any
repair cost caused by the tenant doing, would be the responsibility of
the tenant for
the cost of the repair.If the item is broken or needs repair due to wear and tear than it would be the owner's would be responsible for the repair.According to our records, the tenant notified us once that the washer/dryer wasn't workingWe contacted our repair vendor who attempted to contact the tenant to set up an appointment; vendor was unsuccessful in making appointment.The agreement with the tenant and owner was for the tenant to make on time payment still the end of the year and he could stay if he complies with the termsHe was
late in making his paymentand was given extra time to come in and pay for the bounce check which he was instructed not to pay by check but
with money order or cashiers check He was given a letter to vacate the unit at the
end of the month of December due to not complying with the agreement In addition, the letter stated he must pay for the pastdue and possibly be faced with legal ramifications if the owner took him to court for failureto pay his rent obligationsHe left in the middle of the month but did not comply with the Rental Agreement in providing receipts for professionally cleaning the unit, carpets and de-roaching the unit He
had an unauthorized third party who was not on the lease wiling to help him out with complying with the end of lease terms,
since he was not here to complete the check out requirements The third party was in touch with me in wantingto make sure he was paid up till the end of the month to
be able to complete the check outitems without rushing since she was helpinghim outShe also stated she was staying
in the unit for convenience to work since she workedat the school nearby the unit.During this time, he told her not to do anythingbut have our office take the cleaning and deroachingfee out of the securitydepositNo paid receipts were given to me as evidence the tenant compliedwith the check out termsThe third party attempted to pay for the remaining days but the tenant told her and our office receptionist when she came down to the office to not pay for the remaining days.Upon check out with the third party who performed the walk through with me on December 31", the unsatisfactory items were noted on the checkout form, which was signed by the third party person who was given permission to conduct the walk through with me in place of him not being here.The carpet was totally unsalvageable with stainsthroughout the entire unit Among other items, were broken screen d oars, oven handle, missingcabinet door and window screenframe distortedNo mention of a broken ceiling fan or broken washer was mentionedto the tenant at check outA letter stating the estimate for repair was sent to the tenant, which was over the amount of the security depositThe tenant was informed of this
on the day via phone by the third party and did receive a copy of the estimate along with the check out inspection form stating the u nsatisfactory conditions.This unit has received repeated letters of violations from the association
pertaining to not complying with the house rules from build p of oil in the parking stall,many different people going in and out of the unit during the nightNeighbors and the Resident Manager have complained about the tenant during the duration of his lease.Most of the communication was done by text to the tenant and the third party which all is documented with evidence of the conversationAt no time was thereany refusal to do a repair
and the tenant has been in violation of his Rental Agreement with an unauthorized guest staying in the unit who is not listed on the Rental Agreement.Sincerely,Denise A
