Bad company
My wife called this week and set up a payment arrangement, and they told her that it was fine, so we planned on paying them this Wednesday and I got out tonight which is Monday, and they had my car repossessed, so now I'm screwed I have no way to work and either does my wife due to I and s auto credit telling us that we were good, and no repossession would take place. I will never do business with this company ever again in my life now nits gonna cost over 1000 dollars to get my car back and not to mention I was paying 12000 for a 01, and I had to come out of my pocket to pay for repairs to the car that they never checked about 15000

Explanation of charges: Ms [redacted] ’s balance is currently $with attorney’s fees and interest Her original balance was $5562.37, her car sold for $at auction, leaving $as the original principal balance All of this information was sent to Ms [redacted] and her cosigner in the form of an NOS (Notice of Sale - before the car is sold) and an AOS (Affidavit of Sale - after the car is sold) Explanation of why car was repossessed: J&S Auto Credit tried repeatedly to arrange payments with both [redacted] and ***, to no avail The car was finally located at an impound lot in Ravena, NY and we redeemed the vehicle and brought it to our location to avoid further charges beyond the $owed to the impound lot at the time On September 13, [redacted] advised the repossession department that she did not want the car, and had signed the title over to *** At the time a cosigner is added to a contract, all parties are informed that the addition of a cosigner does not relieve the original signer from responsibility of repayment There is a very definitive period of time for consumers to redeem their vehicle, and Ms [redacted] and her cosigner failed to do so To discuss repayment: Please call our attorneys at [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below When they called me to explain they got a "tip" That my device was tampered, because I work for a Buy Here Pay Here she accused my mechanics of doing it Also, when I brought the car there and they inspected the device she wouldn't let me leave with my vehicle because the payment was weeks past due I explained I did get paid the following morning and that she could take it directly out She didnt accept this arrangement No where in my contract does it state they can hold my car other then it being a repossession When I explained this to her, she stated if your not willing to leave your car here until you make the payment, then consider this a repossession This is totally unprofessional and there are laws in place for NYS that require collections to be handled in certain ways She also told me that she would talk to me however she wanted to When I requested a manager she said there was no one else I could speak toI told her she handled this very unprofessional and she replied with That was fine and that the conversation was recorded Now their reply is I can not listen to it? It is only for training purposes? The way they are conducting business is extremely dirty They treat people horrible and speak to them howveer they wabt without taking NYS law into considerationI had no problem bringing my car in for an inspection She got this tip and automatically assumed it was true and made awful accusations When I arrived the next day for my inspection I told her how I went thru a separation and brought a pile of police reports to show her what him and his family have been doing it me to make my life hard That is why they called the "tip" in I also told her that I could give her the police reports showing that I had to get police assistance times to try and retrieve my vehicle from him He was driving my car while we were together because he didnt have a car and I would take cars from work So when we separated, he tried to keep my car knowing that was his only form of transportation This company needs to follow NYS laws just like everyone else when it comes to collections Let alone their own company standards and treating customers with respect They can not make up their own rules as they go Holding my car until I made the payment or threatening that if I didn't agree I could consider it a repo is bribery The lady did not like me and wanted to show that I had to walk back to work and I never protested brining my car in, I always answer their calls, I update my information This needs to be addressedRegards, [redacted]

J&S Auto Credit received a credible tip that Ms [redacted] had the mechanics at the dealership where she works disable the payment device in her vehicle As her account was two weeks past due, and the payment device should have disabled the vehicle, we called her to ask her to bring the car in for an inspection of the device We apologize if Ms [redacted] felt she was treated unfairly Taped phone calls are used for training purposes only

I am sorry that Ms*** feels this wayThere is a set process our company adheres to for all reposessions, and adhered to in this case as wellThe time line is established by NYS guidelines, not by the Finance CompanyAdding a secondary party to a loan does not absolve the original debtor of their responsibility in maintaining current payments on the account or knowing where the vehicle is locatedBoth Ms*** and her cosignor were EQUALLY responsible for all aspects of adhering to the contract requirements. Certainly Ms*** had an obligation to keep aware of the location of car, the payments and also in requesting the title back from the person SHE chose as her cosignor. At this point in time we believe no further action is necessary on our part, other than to again advise the debtor to contact our attorney for repayment arrangementsThank you

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. This statement is full of lies.  The dealership claimed to not know where [redacted] lived and was unable to contact her therefore, I was contacted by the dealership and told where the car was at an impound in NJ and how much it would cost to bring the account current. Then they claim to have tried to set up payments with her and I and sent us information regarding the sale of the vehicle and other paperwork. The dealership stated they gave me enough time to redeem the vehicle but I stated I did not want the vehicle. This is a complete falsely, I clearly wanted the vehicle, I brought the account current and traveled to NJ to get the car and paid the impound fee. I was pulled over in Ravena for not having a registration and immediately called the dealership for help on getting a new title to register the vehicle. This is how they were made aware of where the vehicle was, because I called them. The dealership told me they could not help me with the title, I would have to find [redacted] and have her sign the title back to me but at the time the dealership AND I had no idea how  to contact [redacted]. If the dealership knew how to locate her then why would they not help facilitate getting the title? Because they did NOT know where she was and did NOT contact her to set up payment arrangements. Otherwise, they could've gave me an address or phone number to reach her to correct the title. I was told by the dealership (after bringing the account current and going to NJ) that technically the car was not mine but the loan was and I was liable to make the payments. So what am I supposed to do with a car impounded that I can't register and put on the road? If I were to continue making payments on the car, who gets it out of impound and what do I do with the car after the loan is paid off?  If the dealership would have helped me obtain the title this all could have been rectified as seen clearly by my actions I wanted the vehicle and made strides to get/keep it. Where is the dealerships responsibility in this matter when a customer was actively trying to do the right thing?  Regards, [redacted]
