Please be advised that our office represents JB Custom Parts. We have been asked by our client to reply to [redacted]'s complaint and to attempt resolution of this matter. Please be advised that all information contained in this correspondence is furnished pursuant to Rule 408 of the Indiana Rule...

of Evidence.1) I believe that it is important to note several factors in this matter before discussing the merits of [redacted]'s complaint. JB Custom Parts is a custom motorcycle shop and specializes in customizing motorcycles and the restoration and customization of older motorcycles. JB Custom Parts is not a standard motorcycle "repair" shop, but is a customization and restoration shop.2[redacted] brought in a 24-year-old (1992 Harley Davidson) motorcycle that was inoperable to be restored by JB Custom Parts.3)The terms of the restoration were discussed with [redacted] when the motorcycle was delivered to JB Custom Parts ($75.00 per hour plus parts).4. [redacted]'s motorcycle had multiple issues with the electrical system, the fuel system. the transmission, the manifold, the steering and numerous other miscellaneous repairs. [redacted] understood the condition of his motorcycle.We are enclosing a log of our client's time spent repairing [redacted]'s motorcycle, a log of the phone calls and meetings between the parties and a log of the work done to [redacted]'s motorcycle by date.Since this was a very old motorcycle that was inoperable there was no flat price or maximum repair price agreed upon between the parties. [redacted] certainly agreed to the time and materials arrangement for restoration of the motorcycle. Due to the unique nature of his services, my client has many clients who are willing to invest more money into a motorcycle than the resulting worth of the motorcycle. My client simply wants to get paid for the work that [redacted] requested. While we reserve the right to request full reimbursement of the invoice in the event that [redacted] decides to litigate this matter, my client would agree to a one-time compromise of his invoice in this matter. My client is willing to accept the sum of Ten Thousand Dollars ($10,000.00) for the repairs and restoration services to [redacted]'s 1992 Harley Davidson only as final settlement. This settlement includes no further repairs or costs and [redacted] can take the used parts that were removed during the restoration of the motorcycle.
