We are rejecting this response because: Joe is not telling the truth. We have a signed contract from Joe that states "WE HEREBY PROPOSE TO FURNISH THE MATERIALS AND PERFORM THE LABOR NECCESSARY FOR THE COMPLETION OF; INSTALL A CURVED KEYSTONE WALL IN BACKYARD WITH TWO SETS OF CONCRETE STEPS. See attached photo of contract.Joe did the curved wall and I did tell him it was nice work. Here is where the truth is not told. While doing the curved wall joe had ordered to much "gravel" and told me he was sorry he did order to much gravel. I said do not worry about it as I will use it to fill in other areas. I said we paid for it we will use it don't worry about it. Now this gravel was for filling in the curved wall and NOT intended for the concrete work at all. I know this because Joe told me he ordered to much gravel and another time when we discussed finishing the steps/ramp he told me he was going to "wait" and do that area when we had a larger concrete slab poured for the gazebo. I told Joe that is not going to happen until next year and I needed him to get the work done that was paid for in full. That is when the "arguing" started. That is when Joe tried to blame us for using our over ordered paid in full, gravel. That is also when Joe told me "you will not get anyone to do this concrete work for $150.00 dollars". I had to show Joe his old text where he did indeed charge us $550.00 for the concrete work, and was already paid in full. He told us he did not want to pour the concrete in the cold and asked if he could do it when it warmed up outside. We agreed to allow that knowing it was paid in full, we trusted Joe. He remembered after he saw the old text. Joe left and we did not hear from him for 10-12 days.  On or about March 20th joe was over to look at the job again and measure up for another gravel project. March 23rd he finally text me again. Joe came over and formed up the stairs and yes we discussed our added concrete landing at the top of the stairs and yes, he said it would be an extra $100.00 dollars. I paid him on the spot in cash and he said ok I'll get it done. In the meantime I was moving our gravel to the designated spot my wife wanted it. On the 25th of March when I was at a doctors appointment Joe texted he was heading over to do our concrete work. I said fine I will be home when I am done. That is when Joe arrived and stated we used "his" gravel for the concrete and now he cannot do the work. The very gravel that he told me he over estimated and ordered to much, and I told him face to face, don't worry about it I will use it in other areas of the yard. Now Joe did another $4,000.00 gravel project in our yard and that was paid in cash and paid in full when he finished the work. It is always 1/2 the cost down and the rest when finished. Joe is always paid in cash. Never paid late. We still have not got the contract for this work even after asking for it several times. He stated he would drop it off and never has. Joe also under ordered one type of gravel we wanted, and Joe over ordered the other gravel that was needed for this project. When the truck came to deliver the first load Joe told me [redacted], I need $150 dollars for delivery charge or they will not drop the gravel. I am not sure why that was not paid for when we paid him $2,000.00 down to start this project. Anyway, I gave him that money in cash so the truck would not leave. I never once asked for this money back, yet I should or it should have been deducted from our proposal as a credit. Joe called me outside and told me he was sorry but under ordered one type of gravel to fill in on the East side of our home. He asked if it would be ok to use the other colored "over ordered" gravel in the area on the East side of the house. He was not sure if he had enough of the over ordered gravel to fill in that area, but wanted to know if he could use what he had. My wife did not want that color over there. I told Joe go ahead and use that over ordered gravel on the East side of the house and I will deal with my wife. So I did Joe a favor by paying an already paid for delivery charge again, or the truck was going to leave. I did Joe a favor by using another over ordered gavel, once again, when he did not have enough of the original gravel to use on the East side of our home. We have been very accommodating to help Joe out of his OVER/UNDER orders of gravel, and have done so several times, while being double charged for materials/Fees. Again, these funds just like the added landing above the stairs were paid in cash on the spot. I had another gravel project (3rd one) for Joe to lay rock five feet out from the curved keystone wall he built. He gave an estimate of around $3,100.00 that is when the wife said no more money until all the work we paid for already is completed. That would be the stairs, ramp and landing. I told Joe he needed to finish the work paid for before any other work will be done. Now we are here trying to resolve this matter. Joe told me to "sue him" before I suggested going to the Revdex.com. I told Joe we had no hard feelings and that the signed contract we have is all we needed to win in court. I said I will file a complaint with the Revdex.com first with the hopes of resolving this matter and court would be another option if needed. Joe's response was OK. Since this is now holding up our large projects I decided to measure up the 3rd gravel project myself. I went to [redacted] (Joes gravel supplier) and showed them my measurements. They told me how much rock I needed and the cost. I asked them to deliver it and they added that cost as well ($30.00). I added a roll of weed barrier ($100.00) and the total bill for all materials came to under $500.00 dollars. I had the rock delivered and did that project myself in 5 hours. The same job that was going to be over $3,000.00 I did for under $500.00. That now makes us feel Joe is not on a level playing field and may be why we cannot get our other contract and material receipts that Joe said he would drop off several times. He has been asked several times after he said he would drop them off, we still do not have them to date. With all that said, we feel now what needs to be done to resolve this is Joe needs to allow us to hire another third party contractor to watch him complete the steps and ramp. This would be a neutral person who knows the trade, since we do not, and a person of our choosing or the recommendation of the Revdex.com. Joe would have to pay half of the cost for this person to be present as the concrete work is being done. We require a one year warranty on the concrete work from the day it is poured. We require our other contract for the work Joe did already, and we would like to have a copy of any permits that were pulled along with a copy of Joes required New Mexico contractors license that allows him to do this work in the state of New Mexico. Once all these items have been obtained in our possession, Joe can start the concrete work that has been paid in full for several months already. Otherwise a refund of $1,000.00 cash and Joe walks away. Here is how Arrive at this price. $550.00 for the steps and ramp in proposal. Paid in full. Could have been in the bank collecting interest $100.00 cash paid for the landing at top of steps, which Joe agreed to in this complaint and has been paid for in full since last month$150.00 delivery fee to allow Joe to keep working our project or the truck would not drop the gravel that has been paid in full$200.00 for the delay of our large project by Joe not completing his obligations per the signed contract on time as agreed toSee attached signed contract.

I am rejecting this response because: I will agree to this as long as the work is done within two weeks (may 6, 2016 or sooner) and we get a one year warranty in writing on the concrete work. The complaint needs to remain open until the work is completed

April 20, I get a text from [redacted] asking me if I was planning on getting the steps and ramp done. I responded saying I will get them done when you write to the Revdex.com and tell them you will drop all complains about me and you will apologise for that and wave anything against me. I offer [redacted] to get the steps and ramp done as planned under the condition that when they are complete we will do no more business or have any contact and part ways. I do what I say I'm going to do on my estimates. I will forget about gravel and purchase more to complete this job so we can move forward.

Complaint: [redacted]
I am rejecting this response because: Joe failed to address the very poor workmanship that he did as you can see in the detailed photos that I sent in. I was looking up caselaw and found that I can take Joe to court and get all my money back (full projects Refunds) from all the work he did on my property since Joe did all this work as an unlicensed contractor in the state of New Mexico. I will now start that process. I would like to thank the Revdex.com for all your efforts in trying to resolve this matter, so thank you.Joe, I am sorry. I provided you ample opportunities to make this right and move on. You chose not to do that. I will see you in court where I will pursue a total full refund of all the unlicensed work you did on our property along with court cost and several days of my lost wages during these projects.
