Here is our history on this drivewayIn we installed a new asphalt driveway, stamped and colored it(The stamping and coloring process is called StreetPrintIt is recommended that the color be
reapplied every - years.) This was a new driveway at a newly constructed homeIn the driveway was recoatedIn 2012, we gave Delores ***, Scott's mother I believe, an estimate to recoat the drivewayIt was never doneWe had been contacted by phone in subsequent years regarding the estimate, but no work was ever completedOn April 6, 2015, Scott contacted us and requested a price to recoat his drivewayRandy met with him on April 14, and gave him a price to fill the major cracks, saw cut the edges of the driveway and re-coat the entire drivewayScott signed the contract August 3rd and we received on August 5th
When we came out to do the work, the trimming of the driveway was inadvertently omitted from the job sheet that is given to the crewWe did saw cut the edges at a later time as specified on their contractRegarding the color, all of our records indicate that the color of the border at the original application and at the recoat was GraniteThat is what was mixed and started to be appliedAdmittedly, it does look quite a bit darker than what we were recoatingWe questioned the manufacturer, Ennis Flint, if there has been a formula change to Granite, and they told me that it is the same as it has always beenThat being said, the only reason I can explain the color difference is that the color on the driveway had faded in the years since it was last appliedWe attempted to blend a lighter color with the granite to lighten itWe don't have to do this very often, but there has been an occasion or two that we have successfully altered a color that is a shade too dark for the owner's likingPlease see the attached photosThe photo titled 9-3-Granite Border shows the difference between the light border color they had to the Granite color we appliedThe photo title 9-19-shows the borders colored with the altered Granite color
There is a balance of $4,remaining on Mr***'s contractThe contract is completeAccording to our contract, final payment is due upon completionThe major cracks have been repaired with Vulkem crack fillerThe areas that Scott refers to as "breakdown" is where the asphalt has eroded over time due to water running across the surfaceWe cannot put more asphalt in those areas, and that was explained to him by Randy and my crew supervisorThe re-application of coatings in those areas will slow down or prevent further eroding of the asphalt by it cannot replace the asphalt and the asphalt fines that are goneThat is why Randy said it would not look like new
Our desired resolution: Payment from the homeowner in the amount of $3,by November 30, If the homeowner would like to meet next spring to select an accent color that he feels will better match the grey border he had, we would be willing to recolor the bordersWe will need a check for the remaining $1,available for the crew supervisor before we start the workThere will be no further crack/breakdown repairs madeOr the homeowner can elect to keep the $1,as a discount and we will consider the contract paid in full upon payment of $3,and will not do further work on their drivewayIn either case, payment must be received by November 30,

Approximately 10% of the cracks and repairs that were discussed at the original meeting to be filled, were covered with a valcum caulking, not filledI was advised by the job supervisor that the remaining 90% of the cracked areas would be filled in with the Street Bond coatingWhich it did not fill in anything, just coated the surfaceThis is all in our original complaint
Now for the colorAttached photo starting shows original color and wrong color acknowledged by DD and production was stoppedThe other two photos are of the driveway completed per DDColor is not much different than the color DD stopped production forIt is as dark and more purple and still no where near original trim color
Our offer at this point is final payment of $2,Please send us a final invoice for this amount

We sent the customer a statement on or about February 1, accepting their offer of a reduced paymentWe issued a credit memo for $2,leaving an unpaid balance of $2,which they agreed to payTo date we have not received the final paymentI've attached a copy of that statement for the file
