Dear Bearly June I received a phone call from *** *** regarding some work he needed on his propertyI met with him on site, walked the site and gave him a rough estimate of how long it would take to do the projectI estimated days, and told him our hourly rateI explained we would
charge by the hour for the job- this was not a fixed bid, nor was there a contractThe job entailed more than anticipated- the depth of the pile to be removed was actually much deeper than Mr*** had estimated to be- he stated the manure pile was 6” and it was twice thatAdditionally, Mr*** added the removal of two large dead trees to the project which added timeOur estimate entailed moving the pile within the same horse corral, however Mr*** required some piles to be moved off site via dump truck, which added additional hours to the jobOur employees work long days in the summer to complete jobs as quickly as possible- in the height of summer, they will often work 10-hour days, which our clients generally prefer in order to complete projects in a timely mannerWe followed this same schedule of 10-hour days while on Mr***’s property.The total invoice for the project amounted to $12,$of this is for the additional hauling of gravel in that he requested after the estimate was given and is broken into our dump truck time plus his cost of materials.Regarding the final billing cost, Mr*** provided us with inaccurate information on what was to be removed and where it was to be moved to when we created our estimateThe inaccuracies, coupled with the additional jobs he requested of us led to the project costing more than our rough estimateHowever, since we bill in time and materials, our bill is completely accurateAt no time was Mr*** charged for lunch breaks or machine break downs as he statedMr***’s assumptions of what a work day is for our company were incorrect and not relevant- the job took many hours to complete- by working longer days, we were able to complete it more quickly for himWe did not charge for overtime, so our long days of work are simply not a factor and need to be excludedIn regard to the fire extinguishers- we are more than happy to replace them for Mr***. Note that that Mr*** personally called to request the services of JD Thinning for the project- there was no conversation regarding any corporation hiring our company, nor was there a contract or a set bid for this projectWe will not remove the lien until we are paid in full for our time on the project.Sincerely,James D***Owner, JD Thinning, Inc
