J.DAY’S APPLIANCE7th StreetLoveland, CO [redacted] Dear Revdex.com, This letter is in response to case id # [redacted] This customer did call on Saturday 03/19/and informed us that his refrigerator was not cooling well and wanted a technician out that day, I informed him that we do not have service technicians available on weekends and at that point the earliest availability was Tuesday the 22ndAt that point the customer insisted we bring a loaner which again he was informed that we did not have any install/delivery techs on SaturdaysHe was informed that I did not believe we had a loaner available but if we did the charge to Estes Park was $per trip not both waysI was not going to charge for labor or the loaner but only for the tripI suggested to the customer to try to find a local repair company and he said he would tryPlease note that there was no mention of or request that J.Day's was to call him Monday since the call ended with him trying to find a local servicerAlso there was no mention of an extended warranty Most people in Estes Park realize the time an effort to get To Estes and understand the extra charges and warranty company's generally will not pay for pickup and deliveryI mention the pickup and delivery because from what I understand the customer did not want the repair done on his property due to it being a compressor, which we could not do anyways due to the fact that we have been under rate negotiation with [redacted] since the new year and have informed them that we will not be doing sealed system repair (Compressor) until we reach an agreement which has not come to fruit at this timeKathy's explanation was accurate and was merely making a statement about a loaner, we have many times bent over backwards and given a loaner locally in Loveland for no charge as a courtesy We cannot do that in Estes due to it taking to times as longAlthough we are not doing sealed system repair for [redacted] at the moment, Kathy did offer to do the repair so as long as the customer was willing to at least pay the trip charges and it could have possibly been done by now but the customer refused.Bottom line is [redacted] is responsible for desired settlement as per contract and I agree that it needs to be taken care of but we have no control over ***Normally [redacted] is pretty good at getting the customer handled and I am not sure what the issue is in this situation and I will not point a finger at one or the other. Please feel free to contact me Personally if neededThank You Jim Day

Complaint: [redacted] I am rejecting this response because: I have recorded all conversations with the Appliance people, so IF there is any doubt as to what is or has been said we will play the recording# I made NO demands on day one the 19th MrDay assured me that it was the week end, they had NO Loners and his shop would be unable to do ANYTHING Until Tuesday the 22nd Mr Day made no suggestions about finding a local repairman In fact later the following week when I told Kathy that we had hired a Recommended [redacted] repairman she was less then convinced that he ( [redacted] ) was qualified to do repairs on [redacted] s As far as refusing any type of service none has been offered When Kathy Day suggested that a new compresser would be installed in our kitchen (Which they don't do anyway) I said Not in our kitchen Our kitchen is not a Machine Shop It would be OK with me if the Days were to do the repairs in their kitchen , bedroom, or living room Kathy Day was the Agent for [redacted] when she sold us the Warranty at a cost of $ Nothing was said about our living in the Town of Estes Park , or that Estes Park people "Think they are Special." J.DAY’S APPLIANCE132 7th StreetLoveland, CO 80537[redacted]
Dear Revdex.com,
This letter is in response to case id # [redacted]. This customer did call on Saturday 03/19/2016 and informed us that his refrigerator was not cooling well and wanted a technician out that day, I...

informed him that we do not have service technicians available on weekends and at that point the earliest availability was Tuesday the 22nd. At that point the customer insisted we bring a loaner which again he was informed that we did not have any install/delivery techs on Saturdays. He was informed that I did not believe we had a loaner available but if we did the charge to Estes Park was $98.00 per trip not both ways. I was not going to charge for labor or the loaner but only for the trip. I suggested to the customer to try to find a local repair company and he said he would try. Please note that there was no mention of or request that J.Day's was to call him Monday since the call ended with him trying to find a local servicer. Also there was no mention of an extended warranty.  Most people in Estes Park realize the time an effort to get To Estes and understand the extra charges and warranty company's generally will not pay for pickup and delivery. I mention the pickup and delivery because from what I understand the customer did not want the repair done on his property due to it being a compressor, which we could not do anyways due to the fact that we have been under rate negotiation with [redacted] since the new year and have informed them that we will not be doing sealed system repair (Compressor) until we reach an agreement  which has not come to fruit at this time. Kathy's explanation was accurate and was merely making a statement about a loaner, we have many times bent over backwards and given a loaner locally in Loveland for no charge as a courtesy.  We cannot do that in Estes due to it taking 3 to 4 times as long. Although we are not doing sealed system repair for [redacted] at the moment, Kathy did offer to do the repair so as long as the customer was willing to at least pay the trip charges and it could have possibly been done by now but the customer refused.Bottom line is [redacted] is responsible for desired settlement as per contract and I agree that it needs to be taken care of but we have no control over [redacted]. Normally [redacted] is pretty good at getting the customer handled and I am not sure what the issue is in this situation and I will not point a finger at one or the other. Please feel free to contact me Personally if needed.
Thank You
Jim Day

Tell us why here...
First of all Kathy is not a Representative of [redacted] so she has no power to dictate what they do. I could continue to argue that the customers statements are inaccurate or that I doubt that the the conversations were recorded but will refrain from arguing that point. The customers effort to get us to repair his machine is futile [redacted] is the only one that can authorize the repair why the customer does not understand this and continues wasting time and energy with this when we he has to deal with [redacted] to solve this is beyond me. To make a point when a warranty is bought through a big box store you don't go to the store the get your product repaired, you contact the warranty company.
That being said again there is nothing we can do to repair this machine. I have taken the time to respond out of courtesy but this is the last time. Please be aware we have no obligation to repair this customers machine legally or otherwise and we will not due to the fact that there is a complete mistrust by both parties and there cannot be a good relationship because of it.
It saddens me that this has gotten to this point and we cannot help this customer.
Sincerely
Jim Day

Complaint: [redacted]
I am rejecting this response because:  I have recorded all conversations with the Appliance people, so IF there is any doubt as to what is or has been said we will play the recording.
#1.  I made NO demands on day one the 19th.  Mr. Day assured me that it was the week end, they had NO Loners and his shop would be unable to do ANYTHING  Until Tuesday the
22nd.  Mr Day made no suggestions about finding a local repairman.  In fact later the following week when I told Kathy that we had hired a Recommended [redacted] repairman
she was less then convinced that he ([redacted])  was qualified to do repairs on [redacted]s.    As far as refusing any type of service none has been offered.  When
Kathy Day suggested that a new compresser would be installed in our kitchen (Which they don't do anyway)  I said Not in our kitchen.  Our kitchen is not a Machine Shop .   It would
be OK with me if the Days were to do the repairs in their kitchen , bedroom, or living room.

Kathy Day was the Agent for [redacted] when she sold us the Warranty at a cost of $179.00  .   Nothing was said about our living in the Town of Estes Park , or that Estes Park people
"Think they are Special."   That Estes Park people "Need to Pay!!!"   All that is wanted or expected is what is listed in the contract in a timely manner.
Regards,

The [redacted] Protection Plus "Confirmation " page  states "Please Print this page for Your Records"  At the bottom of this page printed in blue is the following -
"If you have any questions regarding your contract purchase, please contact the dealer store where you purchased your warranty, or you may contact Customer Service
at [redacted]."
When I have an accident with my car or truck, the house burns down etc., the first person I would call is my Insurance Agent.  In this case my Agent is Kathy Day.
As requested on the Confirmation Page.   The Colorado Consumer Protection Act  states in part in para n. VII page 11 "Failure to make deliveries of the goods,
property, or SERVICES within a reasonable time or to make a refund therefore."  Seems to be a violation of the Act.  We will have to see through litigation if in
fact Kathy Day will act on my behalf as my Agent in making [redacted] under "[redacted].", License No. [redacted]
[redacted] honor the Warranty.  Right now according to correspondence from the Revdex.com Mr. Days response claims to be having problems
with [redacted] - Well, the apple don't fall far from the tree.  Right?
