I would like to address this, first of all this job was not under our contract, it was an Americans Choice construction and we were sub contractors for itWhen the company, America's Choice construction, went out of business we kept with the job so it would get doneBut then it was under priced and we were way over budgetWe have pictures of the job showing that the work is good and well done

I received a complaint letter regarding the above mentioned ID #My sales rep [redacted] had gone to see the ***'s and had signed a contract for us to do the staircase work they wanted to have doneHowever, after seeing what they needed, I realized that we would not be able to do the handrail and secure itI asked [redacted] to tell the customers that we were sorry but we would not be able to do their job since it was something that was more than we were capable of and not sure how to make the handrail system work and be stableOn Sept25th he sent an email to the customer stating what I just said and that we were going to refund their down payment (See Attached)I know that [redacted] was called and he did not respond to them after the email because he felt he had let them down and was embarrassed to talk to themYes we had put their down payment check in the bank just like we do on every jobI instructed [redacted] to contact the customers and set up a time to stop by and give them their down payment backWhen I checked our bank I was told that the customer had put a stop payment on the check, which we were charged $for, so it was not necessary for us to return their money since they cancelled the check I felt bad that we could not do the job for them but honestly, we are not experts in that particular field and I did not want to do a job that we could not be 100% sure of that we could do correctlyIt was in all best interest to not have us do the job and return the money back to them

I am rejecting this response because:
I paid your company with checks, signed and cashed. This job is not completed and is not completed well. I have an estimate to fix and complete everything but the shower that is $3700.00. The tile and the shower is not completed. You've abandoned this job, have not contacted me, and left me with an unfinished project. I have documented communications with you stating you would be here to complete the work, but you never showed up. You have not been here since Nov 25. You may have went over budget, but that's your issue.  Like I said, the money was received by you. I have proof of that via my bank. You agreed to complete the work, thus you are responsible. When I checked our bank I was told that the customer had put a stop payment on the check, which we were charged $30.00 for, so it was not necessary for us to return their money since they cancelled the check.  I felt bad that we could not do the job for them but honestly, we are not experts in that particular field and I did not want to do a job that we could not be 100% sure of that we could do correctly. It was in all best interest to not have us do the job and return the money back to them.
