In response to complaint # [redacted] made by [redacted] *He called me requesting prices for a duck mountI informed him that I would have to see his duck prior to quoting him a price, due to his preferences as to pose, base, etcThere is also a required non refundable deposit of two thirds of the total pricePaid at time of acceptance of his duck in my posessionI am Federally required to keep records on migratory waterfowl in my posessionFor him to see examples of my bird work and other mounts I have done he could view them on my Facebook pageThis was the end of that call He later arrived alone with his duck to discuss his ideas to offer items instead of a money depositLooking at the things he brought for trade I could only concider one itemThe others were questionable as to legal posessionI explained to him I have to cover expenses once I receive his specimen but in order to have a customer satisfied, I was flexible and did accept one of his used items valued at his opinion of worthAllowing $off of the $deposit he agreed to put down on the duck at that time The very next day MrWcalls wanting to bring over a duck he would rather have mounted insteadWhen he arrives he is not sure if he wants one or both mountedWhich would require additional depositHe calls me again wanting to add to his mounts display then I have to tell him that would add to the costHe also called offering several water fowl which would be a Federal violation for me to accept for compensationI am not going to violate ANY law to satisfy this guys whimsI really wonder what is he up to and how much patience a business man needs to deal with a customer like this! He contacts me again with another duck now I have three of these ducks and a guy who can't make up his mindAt a local expo for hunters I had some examples of my work displayedMeet and great possible customersBeing a master taxidermist over years experience with customers world wide, in all of my work with unquestionable attention to detailMrWdidn't want to believe what I had explained to him about the sale of waterfowl being a violation of Federal regulationsHe again was offering me snow geese, went over to WI DNR I believe questioning the Officer and gesturing toward my booth about trading or selling his waterfowl He called me a day or so after that show, he wanted to stop overWhen he arrived he was accompanied by his daughterHe proceeded to tell me his daughter didn't like my bird work and wanted to have some other novice taxidermist mount the birdsI went and got the three ducks and handed them overMrWalso requested his used item which I also returned to himThis was the conclusion of my contractual obligation to him About a month later while shopping at WalmartMrWapproached me in a threatening manner demanding I skin and tan a fox for him or give him back his non refundable depositI had already given him the self valued $item, which had brought the deposit amount down, below the two thirds requiredI told him our contract was completed when he got his ducks and item, the deposit as he knew was nonrefundableHe said, if I didn't give him the $back, he'd tell everybody I ripped him off and I'd see what kind of business I'd getI reported this to a manager who told me MrWwas in the wrong and this should have been handled outside of the work placeHe will be talked to about this When I first read the complaint I was confused as to how some one could lie and fabricate a story to try to distort facts, this is not a complaint as much as it is slander and defamation of character! MrWhas made several and unproven statementsEven going so far as to think my wife owes him because of her full time employmentOnce again proof of how unstable he isWanting my sole proprietorship to allocate funds from a separate sourceWould that be a type of miss appropriation of funds? RevDex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. I have attached the receipt I received from Mr. Frisella at the time I dropped off the ducks and paid the deposit. It shows the total anticipated price of $220, my cash deposit of $130, the knife I offered in trade with a value of $70, leaving a balance due of $20. I did receive the knife back from Mr. Frisella. At no time did Mr. Frisella say anything about my cash deposit being non-refundable. The receipt does not indicate anywhere that the deposit is non-refundable. I did not find anywhere in online or printed business information that indicates deposits are non-refundable. If the mount had been completed, or even partially completed, I would understand that some money would be due. Mr. Frisella did absolutely no work on the duck. He simply stored it in his freezer for those few days. It was returned to me as a complete frozen carcass, exactly as I had delivered it to him. He incurred no expense in the transaction, and has no right to keep the $130. The reason he does not want to return my deposit is, as he stated to me verbally, that he already spent the money. That is not my fault. As a businessman, he should be financially prepared for this and similar situations. My 16-year-old daughter became distraught when she saw Mr. Frisella's work and did not want her duck mount to look like that. I'm sorry that she hurt Mr. Frisella's feelings by telling him she did not like what work of his she viewed at the Hunting Expo show. The duck is important to her and it is important that she have a mount done that she is going to be happy with. It is something she is going to have on display for many years to come. Despite Mr. Frisellas years of experience, his work is not of a quality that she could accept. It should not cost $130 for her to withdraw her work order due to not liking the quality of his work. I maintain that the business owner does not deserve $130 for putting a bird in a freezer. His work my daughter observed at the hunting show after dropping off her duck was substandard. She withdrew her order due to the quality of his work. At no time were we told the deposit was non-refundable. A reputable business owner might charge a small cancellation fee of $5 or $10 dollars, but certainly not 60% of the cost of a completed mount. [To assist us in bringing this matter to a close, we would like to know your view on the matter.]
