Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below. At the very least, the amount that the business has agreed was paid in overage should be reimbursed without me having to sign a letter implying extortion.Regards, [redacted]

RevDex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.1. The price originally agreed upon was for $225 for the generation photo session. I paid an initial deposit of $50 plus tax, and was told my balance was $200 to be provided the day of the shoot, either in cash or via credit/bank card. The day of the shoot I paid a total of $270 - $200 for the balance I was told I owed, an additional $50 for the headshots, plus a $20 tip. I did not receive a receipt for the cash I provided.2. When I was told the images were complete in the gallery, I noticed that each image had a "purchase" option. I inquired about this and was told that there was an additional cost to download the images individually, or I could purchase the entire galley for $99. I told the business that I was not informed up front that there would be additional costs for downloading the images. The business replied that the package I purchased came with 10 images but I would be provided an additional 10 as an apology for the miscommunication. When I saw the quality of the images, and quantity (around 40 total), I was very disappointed. The business commented that over 500 photos were taken the day of the shoot. Only one headshot was included, as well as only 2 photos that included all 4 generations of family members. I inquired about why this was, and the business responded that my "hair was not headshot material" and probably due to chasing my 17 month old daughter around the studio for the beginning of the shoot. The owner stated that she had done the headshots for free, which surprised me because I paid the $50 for them. Many of the final images were of my daughter alone, and ones that I would not have printed due to her either covering her face, etc. One included in the gallery was of her without a shirt on and pinching her own nipples. I told the business I thought this was inappropriate, and I clearly would never have that printed. The business also stated that they did not count the money I provided them the afternoon of the shoot, and that it became mixed in with other money in her wallet. I found this to be incredibly casual and unprofessional. 3. The business apologized and said they would give me full access to the images to download, which I did as I wanted proof of the result/gallery compared to what I paid and was promised up front. The business also offered me a full refund, in writing, which I accepted, however this changed when the business involved their attorney.4. I confronted the business about the overcharge, and was told I would be "made whole" via a full refund. The business stated that they were not familiar with how the referral site quoted the initial job. I told the business I was not quoted on a "package" and had no idea that she thought I was purchasing a package because I was never told up front that what I'd be paying would only cover the shoot itself.5. I told the business I would be late for the shoot, and the business told me it wouldn't be an issue because her afternoon appt canceled. We were not told that she had an afternoon appt until we were preparing to leave the day of the shoot. Additionally, the business was difficult to locate, and we needed to bring many items (clothing) up two flights to the shoot location. 6. Upon seeing the quality of the work, and noting the casualness of the business in handling the way money was taken for the services, as well as acknowledging the over payment, I expressed concern that I may be taken advantage of, and commented that I would need to consider whether or not to contact the BBB. I never, in any way, stated that I would contact the BBB or make a bad review if I didn't get full refund. I feel it was within my rights as a consumer to contact the BBB, which I've never done before, regarding business practices that may seem unethical and/or unprofessional, as well as to dispute quality of work completed.7. I have not yet made any negative reviews, and in fact commented to the business that they clearly had previous good reviews and that maybe this was just an "off" session. I also offered to settle on a 50% refund. The business again told me I would receive a full refund.8. I received a letter from the business/attorney, and was asked to sign the letter in order to receive the overage I had paid. I do not agree with the contents of the letter, and it claims I was bordering on "extortion." As a matter of principle, and under advisement by my own attorney, it was suggested that I do not sign the letter. The business also requested that I no longer contact them, so I feel as if I had no choice but to contact the BBB to assist me. I was also told I could address the issue through small claims court, but felt this would be the more appropriate way to start.9. I have printed all communications between the business and me and can substantiate each and every claim/complaint I have made. I am willing to share these with the BBB if requested.10. I would still like to receive a receipt for the amount of cash I provided on the day of the shoot. The client, was 38 minutes late to the session to begin with.  I had to compensate my other client by offering her a discount.  The client downloaded all of the images from my website.  When she originally contacted me about her photos, she had already made it known that she...

downloaded the images.  If she was unhappy with the product she should not have downloaded them.  She had access and was also told that I would send her a photo release along with a CD of all images.  She then sent me an email insinuating that she would give me a bad review if I did not compensate her.  This type of email made me very nervous and I did not know what I should do.  I then contacted my attorney who instructed me on the proper handling of these type of complaints.  I had contacted the Revdex.com bureau and explained to them what she was threatening to do.  I offered her a free headshot session and sent her a letter stating that I would give her back her overage of payment that she claimed to have given me, in the amount of $100.00.  She downloaded the images from my website and also made her generational portrait her profile picture on Facebook.I have done everything in my power at this point to satisfy Ms. [redacted] and her constant harassing email and threats were disturbing to say the least.  My offer to Ms. [redacted] remains the same and that is all that I am willing to do at this point.  I will not offer her a full refund.  I stand behind my work 100%.  If the quality is not what she expected, she should not have downloaded the images via my website. Thank you, Jennifer [redacted]

The offer I made stands.  You are more than welcome to take me to small claims court.
