Review: In [redacted] I bought a futon red, black flare for $170 + $40 for delivery. I called 2 weeks later and spoke to [redacted] about the horrible condition of the futon having major defects in materials or workmanship. It has wide gaps, springs and pieces of wood poking out making almost impossible to find a comfortable spot to seat. HE agreed to pick up the futon to bring it to the warehouse adding a charge of $30 which I agreed as long as they fix the futon. Also I requested a receipt and a copy of the warranty. A receipt was not a problem according to him but the warranty was only for him as the dealer and he was the only one authorize to bring the futon to the warehouse to repair the defects and he assured me it will be fix and return in 24 hours.Last time I got a sms from [redacted] was [redacted] saying that his next available time was [redacted] in the afternoon and considering it was [redacted] I didn't want to lose track of the futon for 5 days so he did not pick up the futon. Now after the holidays I'm still hoping for him to pick up the futon, fix the futon so I'm able to use it. I still don't have a place to seat in my living room, I don't have a receipt for the purchase except for the credit card slip and I'm still waiting to get a copy of the warranty that covers manufacturer defects.This futon has serious issues that according to the seller are covered under the warranty and I can't go directly to the manufacturer due to the lack of information.I called J. & J Furniture 2 weeks after I bought the futon and I have not been enjoying since I got it and the company always agree on fixing the problems. I live with [redacted] and we are not overweight (I weight [redacted] and my son [redacted])and we are not home most of the time.Desired Settlement: I need the seller to bring the futon to the appropriate place where they can fix all the defects and if they can't be fix it to get me a replacement. The futon is not usable

Besides filling this complaint with the Revdex.com I filled a report with the FTC Bureau of Consumer Protection since I did not receive a receipt for this purchase. He never mentioned or said that my purchase was "AS IS" therefore I need to have a receipt in order to request from the manufacturer to honor the warranty. According to the seller he is the only one that can request repairs due to the fact that he was the one that bought it leaving me "the final customer" with no warranty. I also file a dispute with my credit card company since at this point I'm requesting a refund.
