To honor contract dated Sept 16,2013 (Refund advance fee paid of $125.00 and lawn repair ) and cancel and refund Contract dated Oct.10. Total $625.00 On 09-16-2013 I entered a contract with J & K General Contractors ( [redacted] owner/operator) to complete the following: (1) Cut and remove 16 trees and debris from our property(2) Grind a total of 18 Stumps(3) Repair any damage to the lawn with sod and topsoil(4) Provide the labor, equipment and material to complete the JobThe original contract amount was $2000.00, payable $1000.00 up front with the balance due on completion. As it progressed we added more trees including stump grinding. He requested additional money up front to pay for labor and equipment. I paid a total of $2990.00 ( $2910.00 by check and an additional $80.00 cash ) for this final package which included $250.00 to power wash the back porches and remove stump grinding debris. A separate contract was entered on 10/10/2013 to provide topsoil and sod to the back yard and remove some roots. The contract was for $500.00 which I paid up front because he said it was needed to purchase the topsoil and sod including labor. On Friday 10/25/2013 the Stump grinder arrived to do the stumps in the backyard. Unfortunately, the Stump Grinder said he was not paid enough by J & K Contracting to remove all the stumps I contracted to have removed so if I wanted to have the stumps removed I would have to pay him an additional $125.00. To avoid a delay even further, for the placement of top soil and sod in the back yard, I advanced him the money on behalf of J & K Contracting so we could at least complete that part of the job. I expect reimbursement for the $125.00.A few days later, one of the workers from J & K Contracting took the debris from the stump grinding and dumped it in the wooded area behind our home. Nothing meaningful has been done since that date. Throughout all of this, since September 16th, weather has not been a factor. On the contrary, it has been extremely pleasant. I called [redacted] of J & K General Contractors on Monday 10/28/2013, indicating I want to have this completed by Thursday 10/31. He countered with Friday 11/1. He has not contacted me since then. As of this morning, Tuesday11/05/2013, no topsoil or sod has arrived nor has the damage to the lawn due to tree removal been repaired. In addition, the wooden fence that was taken down for easy access to the backyard is still waiting to be reinstalled. My attempts to get this completed has been frustrating and futile, receiving promises and little to no action. My calls today to [redacted] have gone unanswered. I want to cancel my contract of October 10, 2013 and receive an immediate refund of $500.00 plus $125.00 for the advance payment on his behalf to the stump grinder. Seeking refund of $100.00 for load of topsoil as agreed to in contract. Load of top soil was not needed after job was completed.Had contract to remove 1 tree, remove all debrie, grind stump, remove debrie and replace with load of top soil. Contract dated 10/09/14. He did remove tree and debrie, did grind stump. Have not received load of top soil as of 01/23/15. Have had many phone conversations with Mr.[redacted] with promises to pay refund on load of topsoil but to no avail. I have considered small claims court but for the $100.00 dollars for load of top soil court cost would be more than money owed to me. I would have to continue to deal with this man whom I hope to never come in contact with again. He is such a liar. Buyer beware. I intend to tell all friends and relatives never do business with him.
