Complaint16 year old daughter put a dress on layaway on 2/21/14. Was told she could use the money put down on another dress if she changed her mind. NOT done.This business allowed a 16 year old to put a $1600.00 dress which they sold her for $800.00 on layaway in February 2014. At what point is a 16 year old allowed to sign a legal contract? A copy of this paperwork was not given to my daughter. Daughter was told by [redacted] if she changed her mind she could switch to another dress and use her deposit. Due to circumstances beyond our control she is unable to get this dress. Employee stated it was a final sale and she could not use the money she already put down totaling 150.00. This wasn't the original deal when the item was put on layaway. After being treated rude and unprofessional I wish no further dealings with this business. I want a refund. I feel my daughter was discriminated against and taken advantage of due to her age. I feel this business engages in predatory behavior and bait and switch practices. I also feel this business takes advantage of military service members, her father is an active duty marine and operates under this behavior in a military town. Desired Settlement$150.00 refund, not a store credit. Business Response /[redacted]/On February 22, 2014 a dress was placed on layaway after the customer was given authorization by her mother to charge a $100 down payment to her credit card. We do offer layaway as a courtesy to all customers at no additional charge. Due to the nature of our business we require all layaway customers to sign our layaway policy after it is explained to them stating that they understand and agree to our layaway terms. They are then given the carbon copy to retain for their records after they sign, no matter their age. Due to the type of merchandise we sell and the fact that we charge no fee and have no time limit on our layaway in an effort to help all customers with their special occasion purchases, we do have policies in place to protect the business. A copy of the signed layaway form can be provided at any time that states the following company policies. -all layaway sales are final- no refund or store credit on layaway a-a minimum payment of $100 is required to place any item on layaway-a minimum payment of $100 is due every 30 days. -as a courtesy we ask for a credit or debit card to be placed on file. If a payment is not received within 30 days the minimum payment of $100 will be charged to the card on file on he 30th day.-if a payment is not received by the 30th day or the card on file is declined, the layaway will be cancelled, the items returned to the sales floor, and all monies paid will be forfeited. After the 30 days have passed we will not reinstate the layaway, refund any monies paid, or issue a store credit.-no layaway scan be altered in any way. All items must be paid in full to receive the layaway. We will not remove items off the layaway or credit the account once the items have been placed on layaway. Refusal to pay for the items will result in the cancellation of the layaway and any monies paid will be forfeited. A blank copy of this policy is also available at any time. The customer returned to the store on March 18, 2014 and told both the owner and the store manager that her mother had lost her job and was unable to pay the minimum payment at that time. In an effort to help her during this difficult time we accepted a payment of only $50 with a verbal promise that her mother could make another payment April 1, 2014. At no time was the customer promised that she could trade dresses or take the money she had already paid and put that toward another gown, in fact the owner told the customer she would waive the alteration fee that would have ranged anywhere from $75-150 because of her mother's loss of income. On April 1, 2014 we received a call from the mother who said they could not afford the dress that was put on layaway, although she did say she had authorized her daughter to use her credit card and when she was told she could not put the money paid towards another dress because of our store policy she began yelling, cursing, and verbally attacking Liz, the store manager who took the call, causing her to hang up the phone because of the way she was being treated. There was no other communication concerning this account.I will also address the comment made that we take advantage of the military as it is being disgracefully used to attack the integrity of our store because this woman did not get what she wanted. Everyone in this store is involved with the military in some way. The owner, [redacted], had a son that served in the Navy and her father served in the Army during WWII. Our store manager, [redacted] served in the Army, including two tours to Iraq. Her husband is currently deployed while serving in the USMC. Our sales associate, [redacted] husband is also deployed while serving in the USMC. In addition to being personally invested in our military community we give to many different military groups to aid in fundraising. Our largest donation in the history of the company was just this past October when we donated over $10,000.00 in ball gowns to the USO of Jacksonville so that military spouses would may have not had the resources to purchase a dress for the Marine Corps Birthday Ball would be provided with one at no charge. We do not do these things for recognition but rather because we believe in investing not only in other military members but also our local community. That comment was unnecessary and very offensive to us, especially our store manager who has personally served and was verbally attacked by this woman. Consumer Response /[redacted] 2014/04/15) */This issue is far from settled or closed. I do not agree with this businesses practices nor were we informed. However it's our word against theirs. This is how this business continues to operate in an inappropriate manor. As for their offense to the military, we too are a military family, I know how it works as well. The store operates in a military town, there are 2 formal stores in that town. The next available is a 2 hour drive. The military members are also required to attended The Marine Corps Ball every November. Perfect situation for a business to behave in this way. I too have been a business owner, I know about the tax write off advantage for making a donation. I also know the items that are usually donated are the items that do not sell in the store. Again this matter is not settled. However I will be addressing this issue with base legal department. Thank you, [redacted]Final Business Response /[redacted]/Our company policies are in place to help protect us from situations such as this. The fact that Mrs. [redacted] agrees or not is irrelevant, she authorized her daughter to make the initial down payment on the gown, at which point Miss [redacted] was given copies of all receipts and paperwork. This continued attack on our business suggests this to be instead an internal family issue. By allowing her daughter to place the down payment on the dress alone, as many do during prom season, suggests she trusts her daughters judgement and decision making on large purchases alone. Perhaps Mrs. [redacted] should accompany her daughter on shopping trips in the future so she may receive all information first hand, instead of relying on her daughter to provide her with critical information. We still have never received a request for copies of signed paperwork which can be provided to any party, legal office, or court officials. Final Consumer Response /[redacted]/As was stated in the beginning of the complaint my daughter was given permission to put the dress on layaway because she was told she could change her mind in which dress she wanted to purchase. The ONLY paperwork she was given was a small credit card reciept. No contract was ever given to her. This is why were we surprised to learn this was a final sale. I find it in poor taste this merchant chooses to discredit my parenting as well as my daughter being responsible.Again this matter isn't satisfied, nor will it be. It should remain on this site so it hers may be aware of what to look out for when dealing with this merchant.
