First off thank you for your time regarding this matter in the current state of the nation.
I am formally filing a complaint regarding J & R Rutherford Service located in Rutherford New Jersey regarding NJAC Section 13:45A-26C.2 - Deceptive practices; automotive repairs; you can't commence any work for compensation without prior written authorization or oral authorization if the car was delivered to the dealer during non business hours.
Below I have provided a full history of the interaction with the business.
4/28/2020:
9:30am I dropped my car off at J & R auto service with a request to look at the air conditioning unit as it was not functioning properly and mentioned I would like to fix it.
At 3:14pm, I received a call from the business stating that the repair would cost $1,200 and I mentioned I would need the rest of the day to decide if I would go through with repair. I was notified the business would only accept cash and maybe a check was acceptable.
4/29/2020:
At 9:12am I called and stated that I will not be going through with the repair at the cost of $1,200 and that I would like to pick my car up.
At 2:59pm I received a call back after the labor/diagnosis was complete. I never authorized any cost of this throughout but was notified after that labor/diagnosis bill was $740. I called back and said this is unreasonable and against NJAC Section 13:45A-26C.2 and said I would call back in AM.
4/30/2020:
At 12:24pm I called and said I never authorized the services at $740 and that I would not pay it. I was told I could not pick up the car until paid. The business eventually accepted $300 in payment but only cash. Although I was still not comfortable paying this, I ended up doing so to release my car from the shop. I was provided with a receipt but only by requesting.
Later on realized the condenser was missing on 5/2/2020. According to NJAC Section 13:45A-26C.2, I shouldn't have owed anything regarding the matter due to lack of any authorization.
