I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Since my admission was not complete, it seems that ACE could refund an admission fee since it was never reviewed for my admission. 
As for the background check, it would have been decent of ACE to adhere to my request as one of the exceptions they make.
Again, I feel that they became unwilling to work with me as a result of my canceling my admission.

America College of Education is responding to complaint [redacted], certification, submitted on June 13, 2016 by Mr. [redacted] We take our students’ concerns very seriously.  We hope this reply will help guide Mr. [redacted] to understanding our policy. The Texas Education Agency...

(TEA) has established standards expected of all those individuals taking the principal licensure exam (TExES). Beginning September 1, 2015, candidates were limited to four attempts to retake any educator certification examination.  TEA implemented this change to Texas Education Code §21.048 in response to HB2205, 84th Texas Legislature, 2015 (Graduate Catalog; TEA Principal Exam Information Booklet).  The TExES requires a minimum passing score of 240 on a scale of 300, or 80%.  Per ACE’s published policy,  designed in consultation with TEA,  a candidate is required to pass the practice test prior to be authorized to take the actual Texas test.  ACE must maintain consistent application of its  policies. Per FERPA rules, specific scores are not shared in this public response. Mr. [redacted] began in the Texas Educational Leadership program at American College of Education in 2010 and returned June 2014.  During the January 2016 term, he was enrolled in ELX5983, Internship Experience for Educational Leadership (TX).  Mr. [redacted] scored less than the required 80% on the practice exam. . Following policy, Mr. [redacted] enrolled in the Texas Test Preparation course, PDELTX, scoring significantly less than the required 80%. If he has documentation of a higher score, we will be glad to review it. The score requirement is not an average of practice tests attempted.  Candidates must earn a score of  80% on an exam to pass.  This is not an arbitrary or captious expectation; this is standard practice for licensure programs.  The American College of Education Texas Educational Leadership program is approved by the state of Texas with this information reported through our compliance audits and action plans with TEA approval and actually based upon their recommendation.  If it requires multiple attempts on practice exams in order to successfully pass, the likelihood of success on the actual exam is diminished.
