for the work from the onset and then set forth measures to inforce nonpayment on the scheduled last day of completion, after the work was 99% completed.  J. Terry Construction, LLC performed work in good faith while incurring substantial financial and company property loss due to her misrepresentation. This project would have otherwise been brought to completion within budget and on schedule.

I have reviewed the response made by the business in reference to complaint ID 10365218, and have determined that this does not resolve my complaint.
[redacted] made no
misrepresentation to J. Terry Construction, (hereinafter J. Terry) at all. J.
Terry provides no information whatsoever as to the nature of this
representation, not any evidence to show that such ever existed. Ms.
Veintimilla was clear and forthwith as to what work was to be completed by J.
Terry per the terms of the contract. If any misrepresentation existed in this
matter it was on the part of J. Terry in representing that he could complete
the work detailed in the contracted by the original date of completion, when in
reality it later became clear that J. Terry was either unwilling or unable to
complete the work by this date.J. Terry's assertion that
[redacted] attempted to enforce nonpayment when the work was "99%
completed" is false on its face. The work was nowhere near this level of
completion. Numerous projects remained to be completed well after both the
initial and the modified completion date, and of the work that had been
completed a substantial portion was done unsatisfactorily and needed to be
redone. Of the original job, roughly 70% total job was completed, but of that
50% had to be redone. The details of this are as follows:- The electrical problems
persisted in the bathroom: the outsets had to be moved, the lights over had to
be moved because of interference from the waterline, and the vent improperly
installed because no heat was coming out.- The
plumbing for the washer had been installed incorrectly because it was flowing
in the wrong direction. The water lines had to be completely removed and
reinstalled.- J. Terry removed breakers
from the breaker box creating a hazard by leaving electrical currents exposed
and thus requiring [redacted] had to hire an electrician to rectify the
issue.- The washer and drier was
never installed. J. Terry installed an improper outlet for the direr that was
not up to code, which also required attention from an electrician.Rather than attempting to
complete the work in good faith, J. Terry Construction, LLC continuously delayed
the completion date of the contract. [redacted] has documentation to prove
that she was forced to hire new electricians and plumbers to redo the work left
behind by J. Terry. Also, J. Terry stole from [redacted] her water heater
that she had paid for, cutting her pipes and leaving her without water.
Finally, upon his final departure from the job, J. Terry left trash in the
driveway (debris from the drywall, floor, toilet), that [redacted] was
forced to remove herself and pay to take it to the landfill, when J. Terry had
been designated per the contract to handle trash removal duties.
