The contract signed notes a 30 day notice is needed to cancel the contract. I submitted my notice in May 2016. Payment continues to be taken out of my account as of July 25, 2016. When I submitted the notice Master ** was not happy about us leaving and almost insisted we stay. Today when I called to inform him that the fee was withdrawn from my account today he said that the 30 day notice applies after the end of the contract if we are not renewing and I have to pay out the contract. Not true. I see the client is stating that all they need is a written notice of 30 days prior to end of the signed agreement. The client has stated that this is all that is needed in order to cancel said agreement. That is not true. I have the contract and under Section 2 at the bottom it states that this agreement is set up for automatic renewal in which the client must give a 30 days written notice before expiration date of said agreement. If not than we have the right to renew the service for another 12 months with an increase of 3% . It is stated in Section 3 paragraph 5 " Member understands that it is his/her responsibility to attend instruction sessions. Member understands that the entire course fee stated on front is due and payable according to the terms of this agreement whether or not the member choose to attend instructional sessions provided by the center. In consideration for the Center's Promises to instruct and provide instruction facilities, Member agrees and promises to pay the course fee shown on front." Again under Section 4 paragraph 5 "Member shall not be relieved of obligations to make any payments of the membership fee herein agreed to, and no deduction or allowance from any of said payments shall be made, by reason of the absence or withdrawal of Member from the Martial Arts Program, or by reason of Member's failure to attend or use the Martial Arts Program."This is what the client agreed to July 2013. We are sorry that the client does not want to continue and we always insist on all students to complete and follow what they agree to. We have a copy of the documentation of said agreement if needed.Consumer Response As a consumer I am not pleased with this response. I question why Master * did not say that face to face when I hand delivered the letter to cancel. I recommend that clients are explained this PRIOR to signing otherwise it appears as though J Tiger is all about the money. Please respond to: 1) Is the document clear how many years this contract is for? 2) When does the contract expire? And with any contract the business can make exceptions if they so choose. J Tiger can make an exception since 3) Miles has clearly expressed he is no longer interested and since May (when the letter to cancel was given to J Tiger, he has not attended a class). Thank you, Mrs. [redacted]Final Business Response To the first statement, we explain to everyone what is required PRIOR to the agreement and the terms of how the agreement can be cancelled via moving away from the school or the unfortunate injuries that not allow for continuation of their desired practice. Also a side note *randmaster [redacted] name is not spelled with the letter *.Yes the document is very clear how many years the contract on the front page directly under the information you filled out. Your contract expires August 21st, 2016. I am sorry that your son did not want to complete what he promised he would.
