Sequence of Events

On November 19, 2015, John W. picked up goods from my Mother's home in North Little Rock, AR to be sold on consignment. A contract was signed with an attached list of items. There were 20 items with an estimated value of $2,280. (This was John's estimate.) According to the contract that John W. provided and signed, the proceeds from the sale less commission would be paid within five days of the sale.

The estate sale was held in Benton, AR on December 3 - December 6. After that sale, I had a difficult time in making contact with John and I subsequently found out that his Mother had died. I had left multiple verbal and text messages which he never returned. I sent him a certified letter on January 3, 2016, requesting payment of the net proceeds. I received a check from him at the end of January with a list of five items that had been sold.

On March 1, 2016, I called John inquiring about the remaining items. He told me that he had had an estate sale the previous week in North Little Rock, AR, and that he had sold some additional items. Again, I have left verbal and text messages with him and he has not returned any of them as of this date - May 10, 2016.

I am at the point that I would like to pick up all unsold items and give them to Goodwill. This has been a very frustrating experience. I am not so much concerned about the money as to his lack of responsibility. If there is anything you can do about this situation, I would appreciate it.
