Review: On Sunday June 24, 2012 at 1:08 pm, I was the 4th vehicle in line stopped by the flagman on the east side of the Provo River Bridge on HWY 113; heading west to Midway, UT. A large, uncovered, asphalt truck going east was traveling at a rapid enough speed to be spilling chunks of asphalt as he went. My car was splattered as he went by leaving chunks of asphalt on the driver's side front fender, side rearview mirror as well as on the roof of the car and all the way back to the end of the car on the passenger's side. A large chunk also hit my windshield and immediately cracked it. Since I was in the line stopped by the flagman, and on a HWY where there is a double yellow line, I was unable to immediately follow the truck to get his license plate number. By the time the line was released and I was able to turn around, the truck was gone.The project supervisor told me to contact [redacted]. He had me contact [redacted] who sent me an incident report. I returned the completed report and on July 16 a phone interview was conducted by [redacted]. On July 21, I received a letter from [redacted] - SR Claims Rep, CM denying the claim because I could not give a positive ID on the truck or trailer. How was I supposed to obtain this information? I was in a line stopped by the flagman on the job, on a two lane HWY with a double yellow line while the truck employed by Staker and Parson to haul asphalt splattered asphalt on my car as it went by. This loop hole in coverage needs to be changed!Desired Settlement: The windshield of my car, that was cracked by the asphalt splattered by the truck that Staker and Parson hired for their paving job, to be replaced.

As response to the complaint that was submitted to you on 7/24/12
#9141238, I would like to let you know that the claim was denied based
on the information that in speaking with the individuals working with
this project, Staker Parson Companies was working out there, however
there have been multiple trucking companies within this project.
Without positive identification of the said vehicle it is hard to ensure
that the vehicle belonged to Staker Parson Companies. All leased trucks
are required to carry their own liability insurance. Our insurance
company, [redacted], completed a statement with the claimant and was
unable to get additional information about the truck that caused the
damage (colors, etc.).
This project has been a clean project with sweepers out to maintain the
roadways and has not generated any other claims.
