Further to a notice received on December 6, regarding complaint from [redacted] re lawn installation – the following response is offered Full lawn installation was completed as per discussions with homeowner – topsoil and sodding work completed After lawn installation the home owner did not redirect his downspout and after heavy rain due to the run off being directly on the lawn there was a trench created It is the home owners responsibility to maintain and be responsible for property after installation and if you leave a downspout directly on the lawn after heavy torrential rain it will wash away the soil We returned to the property once to repair at no cost to the home owner – repaired the lawn and sod in the area he had the wash out At the time, the owner was advised that the same thing would occur if he left the flow of water over the lawn as it was a new lawn installation and the root system would not have has time to take – there would not be enough of an established root base to absorb the water unless it was redirected to the driveway or elsewhereThe home owner was also advised on that occasion that the mistake/issue was his and we were no longer responsible after we had completed the repair According to the homeowner, a second washout occurred – logic would indicate that if the water was directed from the downspout away from the lawn it would not have happened a second time The homeowner contacted us to go back and complete a second repair and we indicated that not at our cost this time, it was the homeowners responsibility and because he had not redirected the downspout naturally the same thing would repeat and reoccur The staff person who did the lawn installation and repair work has over years experience with our company – he was contacted by us prior to declining to complete the second repair and indicated that the home owner must have left it – otherwise there would be no wash-out/trench created The staff person also indicated he did not advise to redirect the water down the lawn [redacted] Business Manager Newfoundland Lawn and Sod

I am rejecting this response because: The years experience is great for that person, but this person is wrongI could easily get affidavits from both neighbours to state that I put the extender on the drain spout minutes after their staff person fixed the problem and leftI fixed the problem the second time myself but it only washed away again. They did not install correctly, my wife watched them flattened the soil when installing it but did not do the same with the aide where the trench is.
Next, the staff stated that he did not tell me to drain the water in the middle of my lawn but he did do soHe stated that because it was flat in the centre of the lawn it should be fineThe water is rerouted no where near where the trench is.
The staff member did not come back and check to see if the spout was rerouted because if he did, he would have seen what I had doneI feel for the amount of money I spent for half a lawn for it to only wash away and will probably die in the trench, it is sickeningI might just have to seek legal assistance with this
