The gym charged 2 months over what was described in the contract for use of services. The membership was canceled as of Feb 5, refund refused.After the situation described in the following email, no contact was made by the owner of the establishment, despite attempts to contact after discussion with the manager.Hi [redacted],My name is [redacted] and my husband [redacted] and I had a membership to Jackson Sport and fitness for a year and a half. We enjoyed our time working out at your facility, however we have experienced great frustration with canceling our membership. Around Feb 5, 2015 I went to the gym and spoke with [redacted] your general manager about canceling our membership since my husband and I were moving to Memphis. Upon speaking with him, he informed we had to submit a letter in writing to the business office. First off, I think it is absolutely ridiculous to not be able to sign a form to cancel at the very same place we sign up for memberships. Second, in our contract, I believe it states a 30 day notice, [redacted] informed me that we had to pay the full month of Feb and full month of March since it was already the 5th of Feb. That did not seem appropriate, but I agreed to pay the month of March without any argument. It's business, and I understood the automatic debit logistics. However, upon checking my bank account in late March, I discovered there was another payment of $44 debited for the month of April that should never have been taken out, especially considering that we canceled in early Feb by sending a letter to the business office. Within the week of discovery, my husband called the gym to reconcile the account and ensure it was canceled. Whoever he talked to said they would talk to the business office and get back to us with a resolution. No one ever called, so he called again and got the same response. I have recently had a replaced debit card due to fraudulent charges. Yesterday, I received a phone call notifying me that we had an outstanding balance. As you can imagine the frustration I had when receiving the phone call. The girl immediately transferred me to [redacted] and he informed me that we were overdue and he would look into it. I reminded him that I had spoken directly to him back in Feb. We have not used the gym since early Feb and should not have been debited for March and April, but specifically April. [redacted] did not call me back for several hours after our first phone conversation and since I happened to be in Jackson for one of my graduate classes, I decided to personally go over to the gym. After talking with [redacted] he finally decided to fill out a cancelation form himself. If he has the authority to cancel a membership in person, why is it so necessary to send a letter in writing to the business office? And why did it take 2 months of phone calls and me taking precious time to go over there to fix the situation? After enjoying our time at Jackson Sport and Fitness, I now could not be more disappointed. He informed me that he was unable to refund the $44 we paid for the month of April. We never used the facility in March or April, and I would like a full refund for the $44 paid for April since we submitted the required documentation to cancel our membership in Feb. I have heard of other past members having the same problem with being overcharged. I cannot believe that an honest business treats its customers in this way.I appreciate your help in this matter. Please call me with any further questions.Desired Settlement$44.00Business Response Mrs. [redacted] was given cancellation instructions at the gym on a Saturday. The instructions indicated a written letter with terms of 30 days must be written. The instructions as well as the agreement clearly stated the letter needed to be mailed certified, so that there was proof the letter was sent and so that the gym could help with the cancellation if for some reason the letter was lost in delivery. Mrs. [redacted] came in and told [redacted] her husband called the gym to find out if the membership was canceled after $44.00 was deducted from their account that according to them, should not have been withdrawn. When [redacted] asked why they didn't raise any concern when told the membership was NOT cancelled nor scheduled to be cancelled, she stated, "I don't know. I'm busy with nursing school and I told my husband to take care of it." She stated he only called in ONCE. In the email provided, that number has changed to two times. Neither phone call was documented in their member notes, which is company policy. When Mrs. [redacted] came in, [redacted] had already spoke with the owner and received permission to cancel the account at the gym so that they would not have to send in another letter and have a 30 day last draft.Since they have not been in to exercise, we will refund one payment of $44.00.

I HAVE TRIED TO cancel this health club membership since December [redacted] They continue to draft my account.Request for cancellation via, phone; (told I could only suspend the membership over the phone). Sent request via, fax received confirmation page; Sent request via, email 2x to request cancellation. I have been sick, and unable to participate at the health club, and just recently had surgery. I would like $97 that was drafted from my account refunded. $39 annual maintenance. $29 Jan monthly fee $29 Feb monthly feeDesired SettlementI want the $97 refunded, I have requested a cancellation..several times.. and for the Fitness Club..to request that I make this request through certified mail is absurd. If I ask for a cancellation... it should be honored. Business Response Your member notes indicate you were given proper cancellation instructions by our staff on December [redacted] This includes writing and sending a letter to our billing department. That letter was never received and the first correspondence we have since then is January [redacted] You sent an email to the manager asking for a refund and for the membership to be cancelled. The manager cancelled your membership according to our 30 day notice policy as a courtesy without asking you to send in a letter. However, we will waive the 30 day notice and refund you the February dues.
