Our office received a letter stating there was a customer complaint in reference to the property in *** *** *** for an above ground tank removalAfter reviewing the statement from the client we do understand his frustrationWe required a 50% deposit of the base cost for the removal of
the tank which is nonrefundable as stated in the proposal that was submitted to the clientThe Client agreed to the terms and signed the proposal and returned it to our officeThe total amount was $and a deposit was received of $The proper permits and paper work were submitted to the town of *** and once those permits were approved we scheduled him for removalOur Technicians were sent to the site on the of 27th June 2017. Once our technicians arrived there was a guy whom warned the technicians “Good luck the basement is flooded” Once we went to the basement our technicians encountered about 2-inches of waterWe explained to *** *** that if we removed the tank and the minimal amount of oil spilled in that water, we would have to drain the entire area and we would be held responsible for a cleanupIn result we were unable to complete the jobWe explained to him due to us sending our guys there, he would not be refunded the deposit so we can compensate the dayAs stated previously we have a non-refundable deposit policy for all of our removalsIf you have any questions or would like a copy of the contract that he signed, I would be more than happy to provide itThank you

I am rejecting this response because:
As per our conversation on Tuesday June 27, please find my comments below 1- Upon request for service on a tank removal at ** *** *** Request was made to Carmen to remove a gallon oil tank from a retail store basement2- Description of tank and its location was stated as a retail location located off a *** *** in *** NJ with rear access to the basement3- An agreed upon price was provided and stated on your estimate dated May 23, The estimate did provide a price and notated a dollar amount pending a site visitI agreed to the estimate with extras notated on the estimate4- A signed copy of the estimate was returned to your office with a deposit of $on check number *** 5- Approximately one week after I mailed the check I confirmed with your office that the check was cashed and you submitted an application for permits with the Borough of ***The fee amount for the permit was $A check was submitted for $from your company and the additional amount was self-funded6- I contacted your office on multiple occasions to schedule the removal and was told that they would schedule it asapAfter multiple attempts were made I was told that it is sort of a difficult scheduling issue and had to be squeezed in due to the location7- Finally an appointment was made and I was then told that your crew cannot make it to the site the same day that the township inspector was able to meet8- I was then told that they will remove the tank on June 27th and the inspection will be on June 28thI agreed to meet the inspectorI was also told that an additional fee of $was to be charged as you had to return to the site to remove the tank after the inspection or I had the option to dispose of the tank myself(I hired a company to remove the tank and dispose of the tank properly from cradle to grave)I was not going to dispose of the tank9- On June 27th your crew called approximately 1:pm to say they are on the way over to the siteI believe that the crew did not show up until between 3:and 4:pm10- Upon arrival the employee on site opened the basement door and found that there was a little water in the basementAlso I was told that there was some oil that needed to be removed and we were told that the crew only had a 100’ suction lineThis suction line would not have made it to the tank for oil removalI was then told your crew could not have removed the tank because the floor is wet11- I was then called by the owner of the company and I was basically called a liar and that you are going to charge me for a job that was never doneI was told that I said the building was residential which I never said and I was also told that I knew the basement was wet which we never said12- If you didn’t want to perform the job you could of denied the workI have a closing date to meet and now I am not able to meet this date13- As your estimate notes that the job is pending a site inspection and there is no charge for a site inspection14- As no work was performed and your company basically refused to perform the work by telling me first that the job cannot be completed until the middle of July and then informed me to go elsewhere I am now requesting an immediate refund of $This amount is the deposit of $less the permit fee of $As discussed with the owner of your company the permits may be used with another contractor
