After researching the claim, I regret that we cannot reimburse Mr*** for the purchase price of his unit
The claim was submitted on 6/28/and by 7/7/the unit was inspected and deemed irreparableA new unit was put into production and shipped to the consumer by 7/13/
Under the
terms and conditions of the original Limited Warranty, "THE COMPANY WILL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES or losses arising from any cause (e.g.,
water damage to carpet, ceiling, tiles, marble, loss of use, etc.) including but not limited to its own negligence; damages to, respecting, or resulting from: plated
parts when pool and/or spa chemicals are used in the unit or hard water conditions; optional bath equipment not manufactured by the Company but supplied
by a dealer, installer or the Company; the unit's prior usage as an operational display; or defects that should have been discovered before installationThis
exclusion applies even if Company was advised in advance of the possibility of such damagesThis limited warranty does not include: labor, transportation, or
other costs incurred in the removal and/or reinstallation of the original unit and/or installation of a replacement unit; any costs relating to obtaining access
for repair; or loss of use damage, including loss of sales, profit or business advantage of any kind under any circumstances."
As a gesture of good will, we waived the replacement transportation fees associated with this unitAgain, I regret that we cannot offer a reimbursement

Although the customers warranty has expired, we are in process of reviewing his concerns to see if we can offer assistance

The size that is given is the minimum size need to fill just the bathtub itself and does not include any other water consuming appliance. In addition, we do not call out a specification for temperature of the heater to be set to because each hot water heater complies with the manufacture's specifications. If in the event we are contacted in regards to instillation concerns we refer our customer back to the instillation company in order to have water supply evaluated as the tub itself does not supply water and she could be experience a plumbing related issue.
