My father had a stroke which meant I had to move to take care of him Prior to signing the lease break fee I obtained permission to make payments monthly until the balance was paid so that it would not go to collections. I have all intentions of paying this company the money owed I just couldn't do it all at one time because of my situation. Lauren E. Sent me an email stating I could make payments as long as I stayed in contact with them and made a payment each month they would not send it to collections. I then received the balance on February 17, 2020 and also a calol by Tyler E. stating to chip away at the amount monthly and that would be fine. Three days later I was told that it was all due by 28 February or they were going to send it to collections and will not except the fact that their property manager said that I can make payments. I have sent them a copy of the email received from their property manager Lauren and emails stating that I obtained this prior to signing the lease break agreement and they told me they were gonna send it to collections if I didn't pay it by the 28th

Desired Outcome

Other (requires explanation) I would like for them to uphold their end of the bargain and let me make monthly payments. I made one payment on 20 February which was only three days after I receive the full amount. I am trying to show in good faith that I will pay this I just need time because I had to move and did not have a job and that is the reason I obtained the approval prior to moving and prior to signing the lease break agreement. I moved out in December and was told I needed to pay January's rent and I did. I have.

Complainant was aware the Break Lease Fee before lease agreement was executed or move in took place. Complainant was also informed at the time 30 day notice to vacate was submitted on December 27, 2019. Our business demands payment in full at that time of move out, which was Jan 27, 2020; however, we allowed additional time and even followed up with contact before writing off balance Feb 22, 2020.

More lies. Trisha sent me an email saying she would not stand by the email I received from her property manager stating I could make payments and that I would be given until the 10th of March before writing it off. Again no one there can keep an agreement. Now I see it was written off on Feb 22nd. Also I did not receive the certified letter with the amount owed until Feb 17th at which time I contacted the current property manager to make the arrangements I was promised would be made. On this date he called and said to "chip away at it each month until it was all paid". I made a payment the same week. Again if I had known they would not stand by this I would have never signed the lease break fee and would have found another option for my parents.

Please understand the issues that are being presented here do not trump the signed legal documents. I would always recommend referring to the agreement signed by both parties. Complainants notice to vacate was accepted December 27, 2019, therefore there has been 3 month where only $100 has been received towards charges owed. We will extend to April 15, 2020; however, we request payment in full on or prior to the above extension date.
