The house at Windmill as under contact by another Real Estate Broker I was canceled by Mr [redacted] when failed to appraise for the MLS listed price of 252,000...My son wanted to pruchase the home....I wrote a TREC form contract of the full price of 252, Presented it to Mr [redacted] with me getting a 3% commission as stated in the Austin Multiple Listing S ervice.#if you need a copy I will summit one I took the contract to Gracy Title in Georgetown , Tx.....which was given to Mr [redacted] ....I worked with the VA appraiser and it was not for my knownledge of VA loans it would not have appraised With no repairs, full sales price of 252,which was about to thousand more the the contract he canceled....I worked hard to get this done my the contract....full price, not repairs, and close on Time.......and then Mr [redacted] said that I did not earn my commission At the last day he want to not pay the commission He would not close on the house knowing it was my Son purchasing the home.....I would have to give up the commission so my son could have a home....I did everything by the contract The title could not believe that he was pulling this at the last day...they had never had anyone to pull this with all parts of the contract was fulled....then he want me to split the commission with him......I don,t know what his problem was other than he just wanted to beat me out of the commission which he had agreed to pay...even the title company was going by the contract Never had anything like this in my plus years in real estate....He could not got a sweeter contract or closing than this.....Full price....No repairs....Closed on the date in contract......no body could have got this done for him but me....what can I say.....he should have been happy with what I did for bother parties

Complaint: [redacted] I am rejecting this response because: I would have replied sooner but Realtor James Anderson’s message was difficult to discern with many typo’s, misspellings and poor grammar Several statements were also communicated in his reply to the [redacted] ComplaintJames Anderson Stated: “ [redacted] was under contract by another Real Estate Broker and the contract was cancelled by Mr [redacted] .” Statement # Fact : [redacted] was listed as a For Sale By Owner and the Buyers not Mr [redacted] rescinded the contract on August 27th because of funding difficultiesJames Anderson Stated: “ He would not close on the house knowing that my Son purchasing the home“ ( that’s what he wrote ! ) Statement # Fact : I knew that son [redacted] Anderson was a Veteran; as I also We shared this common thread when [redacted] and his wife viewed our home for the first time and he spotted my Navy Cap I wanted to see them purchase the home because of his sacrifice for our countryAlso, I aware at this time that a VA loan was more expensive than a conventional loan to the sellerJames Anderson Stated: “ I don,t know what his problem was other than he just wanted to beat me out of the commission which he had agreed to pay“ Statement # Fact : Realtor James Anderson never mentioned or disclosed to [redacted] or [redacted] that a sales commission would apply to the sale of [redacted] *** In addition to the lack of disclosure, the Sales Contract was altered At the time that my wife and I signed the contract the area for sales commission was blank, with no entry As previously stated James Anderson left our home at Windmill and hand carried the contract to Gracy Title, Georgetown TxOn September 29, I contacted Gracy Title and asked for a final closing statement that was scheduled to close the next day, September After reviewing the Closing Statement I realized the $ dollars for James Anderson’s commission I pulled up the handwritten contract copy that James Anderson had been presented to my wife and I and for the first time I viewed the barely legible (3) with no percent sign, that someone had scribbled inAt this point I felt really felt dumb that I did not catch this addition earlier, guess that my wife and I were too busy in moving and trusted James Anderson I contacted [redacted] Anderson and shared what I discovered and questioned the conversations that we had previous to Dad Anderson entering the picture I told [redacted] that we would still close on September and we did ! I contacted Realtor James Anderson and scolded him for what he had done relating to his sales commission I told Him that his services were not needed because the previous potential buyer and I had consummated a sales contract without the help of a Realtor I also stated to MrJames Anderson that the very least monetary adjustment that I would agree to was $ paid to [redacted] and [redacted] This offer expired on the day of closing September 30, I decided to continue with the contract closing of [redacted] because the buyer and the seller did not need to be inconvenienced further Also I was advised that Realtor James Anderson would most likely place a lien on [redacted] if I backed out of the Contract and I have witness to this statementIn closing, My wife and I showed our home twice to son [redacted] Anderson and wife weeks before Realtor James Anderson crept in to the picture Yes, [redacted] was in the MLS for the purpose of encouraging exposure of our home [redacted] Anderson and I did agree upon an as is sales price of $ 252,with no sales commission Realtor Anderson stated that he worked hard for his commission The reply that he submitted to the complaint should be considered an example of his hard work and his communication abilities as a licensed Real Estate Agent My wife and feel violated and angered by Realtor James Anderson’s actions [redacted] and I still remember what James Anderson said Several times “ I’m just doing this to help the Kids out “ We both trusted his intentionsSincerely, [redacted] and [redacted] Regards, [redacted]

Got the home closed as per contract. Even the Title Company did not have a problem closing per the contract. thanks *** ***
