As an allergy practice we are in the business of helping people manage their allergies. Due to the nature of our business, a significant portion of our patients get allergy tested and should they show to be allergic to the panel of items we test for, they may choose to go on allergy shots to manage...

their allergies, etc. When a patient chooses to go on allergy shots, consent forms are signed by the patient (when consent forms are signed a staff member goes over the forms and explains the process to the patient then the patient and staff member sign the forms) giving us permission to actually make the allergy serum, as it is a significant expense to make the allergy serum.  By signing the consent forms the patient acknowledges that they are giving us permission to make the serum as well as accepting financial responsibility (their insurance and/or themselves should insurance not cover the costs) for the first set of serum which includes four different vials (1:1000, 1:100, 1:10 and 1:1) since we have to make the complete set specifically for that particular patient's set of allergies and the serum can only be used by that specific patient. When the patient signs the consent forms giving us permission to make the serum and taking financial responsibility we then and only then make the serum. We never make the allergy serum without a patient's consent. That is what happened in this case - the patient signed the consent forms for the serum to be made and it was made and billed out -- had the patient not agreed and to and signed consent forms the serum would never have been made. Our patients have the choice to do shots or not to do shots. This patient chose to do the shots and signed the consent forms agreeing to do the shots and agreeing to financial responsibility; then when she was called to let her know her serum being ready for her to begin her shots she suddenly changed her mind and decided to call Medicare and tell them she never received services; however the services were provided to her based on her choice to sign the consent forms.

I am rejecting this response because:  This is add on information to my original Revdex.com complaint with West Texas Allergy, PA  Dr. [redacted]This doctor's office will attempt to prove that they had my written consent and authorization  to prepare and make allergens for allergy shots; when in fact I told Dr. [redacted] the last time I saw him on 2/1/16; that I would not be taking allergy shots and he acknowledged that he did hear me.  Dr.[redacted] did not make his staff aware of this information; so they went ahead and made the allergens for allergy shots and submitted a claim to Medicare for payment.   This medical practice will also try to present that I signed a consent form agreeing to allergens being made for allergy shots; when in fact I was completely out of it due to the countless allergy tests they were performing on the entire upper half of my back!   When the allergy tests were performed on my first initial visit I was experiencing very uncomfortable reactions and Dr [redacted] was called into the room where I was laying down.  I told Dr [redacted] that I could not handle any more allergen sticks on my back and he basically ignored me - told me I was alright and kept on sticking me!  I should have got up and walked out right then and there - but I continued to try to get through it - as  I didn't think I would be able to get up!  I was then taken to an examining room and a female staff person came into the room with a form that  showed line by line items that had been checked marked and I was instructed to sign the document.  I can assure you the state I was in - I shouldn't have signed anything and I told the person there with me that?! I was very shocked when I received a call from Dr. [redacted]'s office  a week later informing me that my allergy shots were ready? I asked to speak to  Dr. [redacted] and he stated he did not recall my telling him that I would not be taking allergy shots the last time I saw him on 2/1/16  I also spoke with the doctor's office manager and she was of no help in the matter!? .  The only reason I went to West Texas Allergy PA was because Dr. [redacted] my orthopedic doctor wanted allergy tests performed for metals and antibiotics.  I told Dr. [redacted] that  my immune was very hypersensitive and I had many allergies. Dr. [redacted] was was very concerned as he was looking at  performing surgery on my broken left wrist and inserting metal pins in it. I also had issues with taking antibiotics due to other health issues.   This allergy clinic seemed to care more about performing dozens of allergy tests; that were not ordered or needed by my referring physician and obtaining a consent form and then expecting to be paid for services that were not received.   I have patient statements that were mailed to me for proof of the times and dates in the sequence of events that I have described in this statement!?  It can also be confirmed why I was referred to the West Texas Allergy by Dr. [redacted] office in Midland, Texas.  Dr [redacted]'s office did do a lot of  unnecessary testing; that was not ordered by my referring physician; Dr. [redacted]These are the honest facts as I experienced them in this matter. Click here toReplyorForward
