I hired Jamie Rodgerson and Sons to complete a 24x48 4 foot foundation, install weeping tile, foundation sil plate, excavation, vapor barrier, gravel and will be getting them to do my landscaping in the upcoming spring. Very pleased with the results, met the deadlines and was easy to deal with. Highly recommend this company for anyone looking for these types of jobs.
A couple of weeks ago we had our sewer pipe replaced which involved cutting a path through our ashfault driveway and digging a trench. The pipe was replaced and the trench filled in. The trench settled and the contractor came and filled it in. The trench has settled again and the contractor wants us to pay for the repair. Prior to his work we had a usable driveway now we are parking one vehicle on the street.
Attached are the pictures of the job when I left, as you can see the asphalt and the trench were in place as they should be. The woman wanted a bush of sorts saved by her house which was already low in comparison to the rest of the land layout. Which meant we could not compact the area as well during backfill immediately after. I was hired to offer the excavation of the materials, nowhere in the agreement was it said I would landscape the property or fix the driveway where the trench had passed through, but because the homeowner had been telling me he had a heart attack and health issues I felt bad and thought I would help him out so I offered to repair it for the cost of the asphalt and no additional labour. My recommendation was to leave the trench for a period of time without asphalt to allow for settlement. Both *** and *** were adamant it be done following backfill. "The customer is always right" right? so that's what I did even though they didn't heed my warnings.After a period of her watering the removed and replaced bush the left hand side of the trench had settled (the area that couldn't be compacted as well as the rest to save the bush) the water would pass under the newly patched driveway and cause the air in the particles of soil to disperse, quickly causing settlement. I gladly topped it back up for them at a cost of roughly 200$ out of pocket no charge.Everything was repaired without any sort of acknowledgment or thanks. Fast forward to August 10th when mother nature opened up with torrential downpours and hail, the spot by the bush pooled water which in turn ran under the driveway, and the rest of the trench causing it to settle. *** had contacted me again to now repair the driveway and the rest of said trench. And I replied to her, as seen in the attached picture. You can also see her reply. Following *** and I conversation via messenger, her husband *** writes a recommendation on my business profile on ***. "do not recommend" "if you want to see their finished work come by ***." I then replied through my page and apologized that he felt this way and offered my telephone number so we could talk. Instead of calling me he elaborated more on my business page, publicly slandering me with false information. Following this he writes a message to a plumber who regularly hires me for this work and slanders me saying, " he left my yard and driveway in a mess and refuses to fix it" - false. He then continues with "you should reconsider who you recommend for excavation work".Attached are the pictures of the driveway and yard when I left.I don't receive a phone call from *** until Aug 13Th 2018 where he tells me he is going to take me to small claims court. After explaining the situation and the facts of it all he then tells me he will pay for the repair in a years time If there is no more settlement.I explained I could not do that I have already done the job for a discounted rate through the plumber, charged him 0$ labour on the install of the asphalt and lost an additional 200$ on the second repair.*** finished with "well come fit it tomorrow and I'll pay you". I did not believe this as he clearly has no moral compass or compassion to be going to this length with lies. The following day I drafted up a letter which stated I would top up the driveway and trench at a discounted rate of 70$ per hour. Standard is 85$ per hour and the cost associated with that (asphalt, soil) I left recommendations for the future and details on how to avoid this problem continuing. His lovely wife *** must not have accepted this letter in the mailbox, because I am pleading my case to Revdex.com this morning. I will not work for these people in the future and I pity their lack of understanding. I have been as reasonable and friendly as possible to this point.please find attached below my pictures. here was no recomendation to leave the trench to settle, and fixing the driveway was part of the agreement or I woudnt have employed him.
He told me there was a possibility of settling and he would check on the driveway in the near future, the driveway didnt settle, it collapsed at least 10 inches and to suggest all this was caused by watering a lilac bush is rediculous. When he returned to repair the driveway he could have recommended filling the trench with gravel and letting it settle, instead he put down more asphalt, this was his decision. This repair subsequently collapsed as well, having never been driven on.
As for my entries on his *** page, look up the page and read my comments, I dont think you will find any slander. I have had people stopping and asking who did this to my yard, because I was sattisfied with the work of the plumber I advised him to reconsider who he recommends as it may hurt his reputation.
As for our phone conversation on the 13th, he offered to come on Tuesday the 14th to repair the driveway for the third time, he didnt come to do the work even though I agreed to pay him. As for my compassion and moral compass, I believe that comes close to slander, as does calling me a liar. However, that is a matter for my lawyer, not the Revdex.com.
He is correct, he will not work for us in the future. As for my lack of understanding, I understand that I cant use half my driveway. If he feels slandered let him contact a lawyer. I paid him in full in good faith that his work was good an that I could rely on him to fix any issues. I find his attempt to cast himself as a victim in this pathetic.
